Amendment No. 4 - Consultant Request for Additional
Fees to Attend Monthly Progress Meetings
Dear Mr. Hemstreet:
In accordance with Task 2.2 of the scope of services, TT-WHS (Consultant) is required to attend
monthly design progress meeting for the duration of the design period. This period was defined as
308 working days from the Task 2 Notice-to-Proceed, which equates to approximately fourteen (14)
months and lor meetings. With the Notice to Proceed for Task 2 on this Project having been issued
on June 21, 2002, as of this date the Consultant has attended seventeen (17) design progress
meetings. Review of our records indicate that various conditions outside of the Consultant's control,
including extended 30% and 60% design submittal review periods, resolution of design issues
necessitated by the failed Guardhouse initiative, and similar conditions, have resulted in the design
period extending beyond the original contract duration. To this end, the Consultant has participated
in three (3) additional design progress meetings. In addition, it is anticipated that remaining
unresolved issues outside of the Consultant's control, inclusive of sidewalk infill issues, the potential
implementation of a street-end by a Developer, and other miscellaneous items, will likely extend the
design period further past the original contract schedule. As a result, the Consultant has requested
that the City consider the attached additional fee request in the proposed lump sum amount of
$11,187, or $932.25 per meeting for a total of twelve (12) meetings.
We have reviewed this request and offer the following for City consideration:
. We concur that the Consultant, has to date attended three additional meetings that resulted
from circumstances outside of its direct control
. With regard to future meetings, it has recently come to our attention that the Consultant's
90% design completion stage cost estimate indicates a significant budget shortfall that had
not been previously identified during the 30% and 60% design review stages.
. As such, it would appear that the Consultant has now created a situation where it is directly
responsible for delays to the design completion. Although it is important to note that the City
is also, on a parallel path, continuing to resolve issues that are preventing the design from
being completed as well (Developer agreement for Rue Granville, sidewalk infjll coordination
with residents)_
As the City is currently in the process of reviewing an additional design services request to
implement the results of the Normandy Sud Re-Planning Study, it would appear that remaining
design issues, for which meetings would have to be scheduled, would fall under three categories:

. Category 1: Meetings required to address budget shortfalls identified by the Consultant at
the 90% design completion stage. These would not appear to be eligible for additional
compensation.
. Category 2: Meetings required to review design progress on the Normandy Sud Re-Planning
Study. These should be included in the re-design effort authorization.
. Category 3: Meetings required to review and input City resolutions for outstanding issues
such as sidewalk infi", Developer implementation of streetends, and any other City initiated
design revisions. This category would appear to merit that the City consider authorizing a
select number of additional meeting. The Program Manager suggests that five meeting for
this purpose be approved by the City.
To this end, we recommend that the City consider issuing an Amendment be approved for a not to
exceed amount of $7,458, which equates to a total of eight additional design progress meeting. This
should be sufficient to compensate the Consultant for the additional three meetings that they have
already attended, plus up to four additional meetings to address City originated design revisions.
Attached for your review is the Consultant original fee request.
Since Article 1.16 of the Agreement allows the City's authorized representative to approve additional
expenses that are less than $25,000 in value, please review the enclosed, and if in agreement, sign
and return to our office. Once received, it will be forwarded to the Consultant and serve as the
Notice-to-Proceed. Should you have any questions, please do not hesitate to contact our office.
