~ Amendment No.2 to the Agreement made and entered this ~ day of
~e r , 2004, by and between the CITY OF MIAMI BEACH, a Municipal
Corporation existing under the laws of the State of Florida (hereinafter referred to as
City), having its principal offices at 1700 Convention Center Drive, Miami Beach, Florida
33139, and CH2M HILL, 800 Fairway Drive, Suite 350, Deerfield, Florida 33441
(hereinafter referred to as Consultant).
RECITALS
WHEREAS, on May 16, 2001, the City entered into a Professional Services
Agreement (the Agreement) with CH2M HILL (the Consultant), to perform landscape
architectural, and/or engineering and related professional services relative to the Project,
including: planning, design, bidding and construction administrative services; and
WHEREAS, the Agreement was executed for a not-to-exceed amount of
$620,800; and
WHEREAS, the scope of the Right-of-Way Infrastructure Improvements Program
Neighborhood No. 3 - Normandy Shores Project (the Project) is comprised of
improvements to the following area: Normandy Shores is a residential island with
approximately 200 single family homes and 43 apartment buildings surrounding the
Normandy Shores Golf Course and Fairway Park, which is linked to Miami Beach at 71st
Street; and
WHEREAS, the improvement scope of work include: enhanced landscaping and
street lighting consistent with community preferences; repair, extension or widening of
sidewalks to comply with ADA - Title III; replacement of existing water mains throughout
the community; street resurfacing/pavement markings and improvement of dead end
streets with street lighting, landscaping, fencing, and/or parking, where appropriate;

bicycle paths and pedestrian access ways; incorporation of traffic calming features,
consistent with the community preferences; improved stormwater drainage collection and
disposal infrastructure; and provision of the necessary infrastructure to accommodate the
burial of overhead facilities, incase the residents consider the creation of a special
assessment district to underground electric, cable and telephone services; and
WHEREAS, the Consultant's scope of work includes planning services; design
services; and bidding and award services, as defined in the Schedule "A" - Scope of
Services; and
WHEREAS, Schedule "A" defines Task 6 - Reimbursables with the following
breakdown: reproduction services; travel and subsistence; surveying; geotechnical
evaluation; and undergrounding utility verification; and
WHEREAS, the paragraph defined as ''Task 6.5 - Underground Utility
Verification", as defined in Schedule "A-2" describes the provisions for Additional
Services necessary to perform undergrounding utility verification for the Project.
NOW, THEREFORE, the parties hereto, and in consideration of the mutual
promises, covenants, agreements, terms, and conditions herein contained, and other
good and valuable consideration, the respect and adequacy are hereby acknowledged,
do agree as follows:
1. ABOVE RECITALS
The above recitals are true and correct and are incorporated as a part of this
Amendment No.2.
2. MODIFICATIONS
The Agreement is amended to replace the Additional Services to the Agreement,
by deleting from the Schedule "A" of the Agreement, "Task 6.5 -
UNDERGROUND UTILITY VERIFICATION" in its entirety, and replacing the
paragraph with "Task 6.5 - Underground Utility Verification" as defined in
Schedule "A-2", attached herein.
3. OTHER PROVISIONS.
All other provisions of the Agreement, as amended, are unchanged.
4. RATIFICATION.
The City and Consultant ratify the terms of the Agreement. as amended by this
Amendment No.2.
IN WITNESS WHEREOF, the parties hereto have caused this Amendment No. 2.10 be
executed in their names by their duly authorized officials as of the date first set forth
above.

Dear Mr. Chartrand:
As noted in Task 6.5 of ihe Scope of Services, ROW Program Consultants are responsible for the
implementation of underground utilityfieJd verification efforts on their respective projects, Intended to
further refine contract documents by selectively investigation .spot" locations where proposed
underground infrastructure will intersect existing improvements. To this end. the City typically
provides a reimbursable allowance of -$5,000 for the Consultant's use in retaining the services of a
utility location firm for this effort. At this time, the Normandy Shores Consultant has advised that it is
ready to commence its underground verification work effort. As such, a meeting was held between
the Program Manager and the Consultant to review/agree on the number and location of proposed
test holes to be implemented. As a result of this meeting, we concur with the Consultanfs findings
that the $5,000 allowance is insufficient, and should be increased by an additional not-to-exceed
amount of sixteen thousand three hundred twenty-five dollars ($16,325), to be commensurate with
the required level of effort agreed upon. This will result in a total underground utility verification fee
of $21.325. Please reference the attached fee breakdown for further details. We have reviewed
this request and concur. Hence, we recommend that the Scope of Services, Schedule A, be
amended as follows:
TASK 6.5 - UNDERGROUND UTILITY VERIFICATION, DELETE this paragraph in its entirety
and REPLACE it with the following:
Task 6.5 - Underaround Utility Verification:
CONSULTANT shall arrange for and coordinate the efforts of a company to perfonn test holes
using the vacuum extraction method rpothollngW) for the purpose of Identifying conflicts
between the location of existing underground utilities and the proposed underground
improvements. Actuallocatlon5 shall be as directed by CONSULTANT. This task shall be
utilized as a tooi to verify the horizontal location, elevation, size and type of material of the
existing underground utilities, as deemed necessary by CONSULTANT, up to the maximum
not.to-exceecl amount of twenty-one thousand three hundred twenty-five dollars ($21,325).

Dear Mr. Hoffman:
Pursuant to my fax on the above subject earlier today, I would like to offer the following as
a cost breakdown of services for the underground utility contractor (Ground HOlUld).
Based on the fees quoted by Ground Hound the associated cost for the Normandy Shores
project are:
Grass area Soft Digs - $200 per hole x 26 holes = $5,200
Paved area Soft Digs - $275 per hole x 55 holes = $15,125
Maintenance of Traffic (MOT) - $1,000 (allowance)
Based on the above calculation the total cost of the Soft Digs is $21,325. Since there is
currently $5,000 appropriated for this task we would like to request that a contract
amendment be executed in the ammmt of $16,325.00 to cover the cost of these additional
services.
