A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, REQUESTING A PUBLIC PURPOSE
CONVEYANCE FROM THE FLORIDA DEPARTMENT OF
TRANSPORTATION, OF A PORTION OF THE RIGHT-OF-WAY ON
TERMINAL ISLAND, FOR THE PURPOSE OF CONSTRUCTING A
WATER BOOSTER PUMP STATION.
WHEREAS, the City needs a water booster pump station to maintain the pressure and supply of
potable water to Palm, Hibiscus and Star Islands and the South Beach area; and
WHEREAS, such a pump station was designed within a City easement on a Florida Department of
Transportation (FDOT) right-of-way on Terminal Island, over a piping network infrastructure constructed
during a previous construction project on MacArthur Causeway; and
WHEREAS, on June 6, 1995, the Design Review Board granted approval to a glass enclosure
elevated pumping station, with architectural features, for a Terminal Island Booster Station; and
WHEREAS, to construct such a structure, the City has requested a deed of said parcel from FDOT,
and the FDOT has reviewed said request, together with the Miami-Dade Transit Authority, which is planning
to construct a Light Rail Transit (LRT) line within this right-of-way; and
WHEREAS, the City has agreed to modify the proposed Terminal Island Booster Station enclosure
to conform to MDTA's Fire Code requirements when the Light Rail Transit (LRT) line is scheduled for
construction.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission
herein request a public purpose conveyance from the Florida Department of Transportation (FDOT), of a
portion of the right-of-way on Terminal Island, as shown in the attached Exhibit "A", for the purpose of
constructing a water booster pump station.

This is to advise that the Florida Department of Transportation is ready to proceed with the public
purpose donation of the subject parcel. The Miami-Dade Transit Agency in conjunction with FOOT
has approved the revised pump station design.
At this time the Department requests the City of Miami Beach to please submit an adopted resolution
which states the justification and purpose of this conveyance. The Department has requested
provisions in the resolution include the pump station will confonn to MDT A's fire code. Also, kindly
prepare a specific purpose survey and legal description in accordance with the enclosed guidelines.
The instrument of conveyance will be a Public Purpose Quitclaim Deed with a mineral rights
reservation clause and a reverter clause allowing FDOT to recover the land in the event it is ever
devoted to other than the specified public purpose.

Adopt the Resolution.
BACKGROUND
The water booster pump station serving Star, Palm and Hibiscus Islands, and the South Beach area
has been out of service since 1988. The replacement pump station was delayed until it was included
in the City's Pump Station Upgrades project. The design of these Pump Station Upgrades was
awarded to Camp Dresser & McKee (CDM) in July 1992. In 1992, when the Florida Department
of Transportation (FDOT) was reconstructing the MacArthur Causeway, a new water main was
installed on the causeway, and in anticipation of the new Terminal Island Pump Station, a piping
network infrastructure consisting of large valves, fittings, pipe branches, and interconnects was
constructed within the City's easement located within the FDOT Right-of-way on Terminal Island.
In 1995, plans for an elevated, glass enclosed pump station structure to be located in Terminal Island,
were approved by the City's Design Review Board. Due to restrictions on the land lease for the
FDOT right-of-way, the City requested of the FDOT to quit-claim a portion of said right-of-way
for the construction of this permanent structure. During the review of this request, the FDOT
required the City to relocate the proposed structure to accommodate a future light rail transit line
planned by the Miami-Dade Transit Agency (MDT A).
After several meetings with the FDOT and the MDTA, the City finalized the location of the
proposed pump station and the required parcel. A provision required by the FDOT was to modify
the glass structure ofthe building to meet MDT A's fire code requirements, at the time the light rail
transit is constructed adjacent to this pump station.

ANALYSIS
The City of Miami Beach is supplied its drinking water from the Miami-Dade Water and Sewer
Department (MDW ASD) through large transmission pipelines at each of the four major causeways
to the City (MacArthur, Venetian, Julia Tuttle and 79th Street Causeways). Since the City is
responsible for water pressures within its limits, an additional pressure boost is required for
distribution to City customers. The water boosters are used additionally as backup, in case of a
sudden pressure loss at the County's pumps, and to maintain a minimum specified pressure for fire
fighting.
The existing water booster pump station in the MacArthur Causeway pipeline has been out of service
for some time. This pump station served the entire South Beach area. As peak demands for water
increased, the need for a new water booster pump station became a priority.
The Florida Department of Transportation has requested the City to provide a resolution stating the
justification and purpose of the conveyance (Attaclunent No.1). The instrument of conveyance will
be a public purpose quit-claim deed with a mineral rights reservation clause and a reverter clause
allowing the FDOT to recover the land in the event it is ever devoted to other that the specified
public purpose.
CONCLUSION
The City Commission should adopt the attached Resolution requesting of the FDOT the parcel of
land described in the attached Exhibit "A".
