A RESOLUTION OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA OPPOSING THE PROPOSED AMENDMENT
TO THE MIAMI-DADE COUNTY ZONING CODE
PERTAINING TO REGULATION OF SIGNS AND
ENFORCEMENT OF SIGN REGULATIONS.
WHEREAS, the Miami-Dade County Commission is considering an amendment to the
Miami-Dade County Zoning Ordinance; and
WHEREAS, the proposed amendment would require all sign permits in incorporated
municipalities, including Miami Beach, to first be approved by County Planning & Zoning
staff and then be forwarded back to County staff upon approval; and
WHEREAS, the City of Miami Beach issues hundreds of sign permits per year, and the
sign regulations of the Miami Beach Land Development Regulations are stricter than the
Miami-Dade County zoning ordinance, and do not permit general advertising signs or
billboards; and
WHEREAS, the City Commission believes that this amendment, if adopted, would
negatively impact the business community of Miami Beach, by subjecting sign permits to
several weeks of unnecessary delay; and
WHEREAS, this type of intrusion by the County Planning & Zoning Department into
local municipalities traditional authority over building, permitting and land use decisions is
an unwise precedent and will increase the workload and staff time of the Building and
Planning Departments;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE
MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby oppose the proposed amendment of
the Miami-Dade County zoning ordinance to extend County
permitting authority for sign permits to incorporated
municipalities.

The Miami-Dade County Commission is considering an amendment to the Miami-Dade County Zoning
Ordinance that would require all sign permits in incorporated municipalities, including Miami Beach, to first
be approved by County Planning & Zoning staff and then be forwarded back to County staff upon approval.
The proposed amendment appears to be in response to excessive billboard type signage in certain other
municipalities.
The City of Miami Beach issues hundreds of sign permits per year, and staff analysis of the proposed
County amendment indicates that this amendment, if adopted, would negatively impact the business
community of Miami Beach, by subjecting sign permits to several weeks of unnecessary delay. The
proposal, if adopted, will be certain to increase the workload and staff time of the Building and Planning
Departments.
The attached resolution expresses the concern of the City Commission to oppose the amendment.
The Administration recommends approval of the Resolution.

ANALYSIS
The Miami-Dade County Commission is considering an amendment to the Miami-Dade
County Zoning Ordinance that would require all sign permits in incorporated municipalities,
including Miami Beach, to first be approved by County Planning & Zoning staff and then be
forwarded back to County staff upon approval.
The proposed amendment appears to be in response to excessive billboard type signage
in certain other municipalities. The sign regulations of the Miami Beach Land Development

workload and staff time of the Building and Planning Departments.
This intrusion by the County Planning & Zoning Department into local municipalities
traditional authority over building, permitting and land use decisions, simply because of an
isolated problem in one municipality, is an unwise precedent, and should be opposed. The
amendment is scheduled for public hearing on June 14, 2005 in front of the County's
Infrastructure and Land Use Committee. The attached resolution expresses the concern of
the City Commission to oppose the amendment.
