97-22599 RESO RESOLUTION NO. 97-22599 A RESOLUTION OF THE MAYOR AND CITY COMMISSION APPROVING AND AUTHORIZING THE PLACEMENT OF ONE HUNDRED FORTY -NINE (149) BANNERS FOR ART MIAMI '98 TO BE HELD AT MIAMI BEACH CONVENTION CENTER FROM JANUARY 9 THROUGH JANUARY 13, 1998, AS REQUESTED BY THE APPLICANT, AT THE FOLLOWING LOCATIONS: 1-395 MCARTHUR CAUSEWAY, STARTING AT MIAMI BEACH CITY LIMITS; 5TH STREET, FROM ALTON ROAD TO OCEAN DRIVE; WASHINGTON AVENUE, FROM 17TH STREET TO DADE BOULEVARD; AlA COLLINS A VENUE, FROM 5TH STREET TO 41ST STREETS; 17TH STREET, FROM MERIDIAN TO WASHINGTON AVENUES; CONVENTION CENTER DRIVE; AND 41ST STREET, FROM ALTON ROAD TO COLLINS A VENUE; FURTHER RECOMMENDING THAT THESE BANNERS BE INSTALLED NO EARLIER THAN JANUARY 5, 1998, AND REMOVED BY JANUARY 15, 1998. WHEREAS, the Art Miami International Art Exposition (Art Miami) has been held successfully at the Miami Beach Convention Center for the past seven years and is the largest mid- winter contemporary art fair in the country; and WHEREAS, in order to publicize this event, and the City's importance in the international art world, light pole banners measuring 2.4 feet x 6 feet have been requested to be placed at 1-395 McArthur Causeway, starting at Miami Beach City Limits; 5th Street, from Alton Road to Ocean Drive; Washington Avenue, from 17th Street to Dade Boulevard; AlA Collins Avenue, from 5th Street to 41st Streets; 17th Street, from Meridian to Washington Avenue; Convention Center Drive; and 41st Street, from Alton Road to Collins Avenue; and WHEREAS, the said banners will be installed no earlier than January 5, 1998, and removed by January 15, 1998; and WHEREAS, Art Miami has requested approval and authorization for the placement of a total of one hundred forty-nine (149) banners; and WHEREAS, Art Miami will post a performance bond to ensure the removal of the banners within seven days after the event and to ensure that any damage to light poles will be repaired; and WHEREAS, Section 9-3.C.4 of the City's Zoning Ordinance (Ordinance No.89-2665) requires that the Mayor and City Commission approve the installation of temporary banners; and WHEREAS, the City will receive positive publicity, nationally and internationally, as a result of the upcoming Art Miami. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein approves and authorizes the placement of one hundred forty-nine (149) banners for Art Miami '98 to be held at the Convention Center from January 9, 1998 through January 13, 1998, as requested by the applicant, at the following locations: 1-395 McArthur Causeway starting at Miami Beach City Limits; 5th Street, from Alton Road to Ocean Drive; Washington Avenue, from 17th Street to Dade Boulevard; AlA Collins Avenue, from 5th Street to 41st Streets; 17th Street, from Meridian to Washington Avenues; Convention Center Drive; and 41st Street, from Alton Road to Collins Avenue; provided that said banners be installed no earlier than January 5, 1998, and removed no later than January 15, 1998. ADMINISTRA TION RECOMMENDATION Approve the resolution. BACKGROUND The Art Miami International Art Exposition has been held successfully in Miami Beach at the Convention Center for the past seven years. It has become the largest mid-winter contemporary art fair in the country. Organized by International Fine Art Expositions, the event showcases high quality international and Latin American Contemporary An. This upscale event regularly draws more than 35,000 attendees each year. The attached application was sent to Design Review and approved on November 4, 1997. ANALYSIS The purpose of the banners is to welcome and promote events in South Florida, including Miami Beach. However, the presence of these banners will also do much to publicize the City's importance in the international art world, drawing attention of the media, visiting art dealers and the public at large to Agenda Item Lie Date /2- ~- 9, , this extraordinary event. Section 9-3.C.4 of the Zoning Ordinance requires that the City Commission approve the installation of temporary banners. That section reads, in relevant part: Light Pole Banners affIXed to light poles or other similar structures on the public right-of- way shall be subject to the following regulations: a. The right to install, as well as the number, location and method of installation of banners shall be subject to the Design Review process and approved by the City Commission and the Public Works Department. e. Banners announcing special events, either to be held in Miami Beach or to be associated in some manner with Miami Beach, as determined by the City Commission, may be erected up to thirty days prior to the event being announced and must be removed within seven days after said event. f. A performance bond shall be required to ensure the removal of the banners in case of advanced deterioration of the banners, or if a dangerous condition presents itself, the City may at its sole discretion direct the banners to be removed at any time. If approval is granted, the proposed temporary banners are recommended to be installed no earlier than January 5, 1998 and removed within seven days of the event, or no later than January 15, 1998.
