97-22603 RESO RESOLUTION No. 97-22603 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING THE FIRST AMENDMENT TO THE POLICE CONFISCATION TRUST FUND FOR FISCAL YEAR 1997/98, IN THE AMOUNT OF $114,600, TO BE FUNDED FROM THE PROCEEDS OF CONFISCATED FUNDS ($94,600 FROM STATE FUNDS AND $20,000 FROM FEDERAL FUNDS) . WHEREAS, Section 932.705, Florida Statutes, addresses the purpose and procedures to be utilized for the appropriation and expenditures of the Police Confiscation Trust Fund; and WHEREAS, the Chief of Police of the City of Miami Beach has determined that the need for appropriation and expenditures exist and the appropriation and expenditure of forfeiture funds is in compliance with Section 932.705, Florida Statutes, and with Federal guidelines; and WHEREAS, such funds are available in the Police Confiscation Trust Fund. NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby adopt the First Amendment to the 97/98 Police Confiscation Trust Fund Budget for the City of Miami Beach, in the amount of $114,600, as reflected in the attached Exhibit "A". DEPARTMENT OF JUSTICE IICOPS MOREll GRANT; TO FUND THE CHILD IDENTIFICATION PROGRAM AND FOR ADDITIONAL FUNDS FOR THE REMODELING OF THE REPORT CONTROL CENTER (FIRST AMENDMENT FY 97/98) SUBJECT: ADMINISTRATION RECOMMENDATION Approve the Resolution BACKGROUND Florida Statute 932.705 provides for, but is not limited to, expenditure of forfeiture funds for crime prevention, other law enforcement purposes and contribution to an organization that benefits the youth of Miami Beach. The Chief of Police of the City of Miami Beach has reviewed and identified the need for the appropriation and the expenditures of forfeiture funds is in compliance with Section 932.705, Florida State Statutes. ANALYSIS The Administration requests authorization to adopt the First Amendment to the operating budget for the FY 97/98 Police Confiscation Trust Fund in the amount of $114,600 from State and Federal funds to be used to provide funds for the expenditures listed in Exhibit "A". AGENDA ITEM Q 1 l:L DATE J2-3~9~ , In accordance with Florida State Statute 932.705 and federal guidelines as found in the "Guide to Equitable Sharing of Federally Forfeited Property for State and Local Law Enforcement Agencies", forfeiture funds have been deposited in the Police Confiscation Trust Fund. The City has complied with all statutory procedures involved in the transaction of these funds. CONCLUSION The attached Resolution provides for the First Amendment to the FY 97/98 Police Confiscation Trust Fund in the amount of $114,600 to be used for the expenditures listed in Exhibit "A". ^ a; JGEV': RB: ep d1:- POLICE CONFISCATION TRUST FUND FIRST BUDGET AMENDMENT FISCAL YEAR 97/98 STATE FUNDS: MATCH FOR A GRANT UNDER THE US DEPARTMENT OF JUSTICE "COPS MORE" (Making Officer Redeployment Effective). This is a grant program designed to redeploy police officers to community policing duties through the use of technology equipment. CHILD IDENTIFICATION PROGRAM - PHASE III This program consists of photograph of a total of 1,267 children currently enrolled in kindergarten and pre- kindergarten throughout of the City of Miami Beach and providing parents with a DNA KIT.
