A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH RATIFYING AMENDMENT NO.3 TO THE
AGREEMENT BETWEEN THE MIAMI BEACH REDEVELOPMENT
AGENCY AND KIMLEY -HORN AND ASSOCIATES, INC., FOR
PROFESSIONAL ENGINEERING AND LANDSCAPING SERVICES, IN
AN AMOUNT NOT -TO-EXCEED $70,925.00, FOR SURVEYING OF
PHASE II OJ' THE SOUTH POINTE STREETSCAPE
WHEREAS, on January 20, 1999, the Chairman and Members of the Miami Beach
Redevelopment Agency (RDA) authorized the Executive Director and RDA Staff to negotiate an
Agreement with Kimley-Hom and Associates, Inc. (the Agreement) to provide professional
engineering and landscaping architectural services for design of street improvements in the South
Pointe Redevelopment Area (the Project); and
WHEREAS, Staff negotiated a not-to-exceed fee of $170,760 for the preparation of the
final Master Plan and opinion of probable cost for the entire Project; and
WHEREAS, the scope of services included in the initial phase of work consisted of data
collection and a review of existing documents, resulting in the preparation of a Master Plan and
surveying for the Phase I improvements; and
WHEREAS, on May 26, 1999, the RDA approved Amendment No.1 to the Agreement,
which included a not -to-exceed fee, in the amount of $3 89,100, for the preparation of construction
documents, permitting and bidding services for Phase I; and
WHEREAS, on May 26, 1999, the RDA approved Amendment No.2 to the Agreement,
which included a not-to-exceed fee, in the amount of $1 03,800, including surveying, Master Plan
design, preparation of bidding and construction documents and permitting for the Washington
A venue extension; and
WHEREAS, in order to meet the time schedule prepared as part of the Master Plan,
Phase II surveying was scheduled to begin simultaneously with the completion of the ninety
percent plan for Phase I; and
WHEREAS, Phase II includes the following streets: (1) Lenox Avenue (from Fifth Street
to Fourth Street); (2) Michigan Avenue, Jefferson Avenue and Meridian Avenue (from Fifth
Street to Second Street); (3) Euclid Street (from Fifth Street to Third Street); (4) Fourth Street
(from Alton Road to Washington Avenue); and (5) Second Street (from Alton Road to
Washington Avenue); and
WHEREAS, in the Master Plan, Second Street is Phase III; however, due to the fact that
the surveying will need to be within 100 feet on either side of the intersecting north/south streets
for Phase II construction documents, it has been included within Phase II surveying services; and
WHEREAS, the proposed not-to-exceed fee for Phase II is $ 70,925 with the following
defined tasks: Phase II survey - $54,300 and reimbursements - $16,625 (consisting of geo-
technical studies - $4,500, aerials - $9,625 and direct expenses - $2,500); and
WHEREAS, the South Pointe Advisory Board voted in favor of the Phase II work at its
meeting of October 14th, 1999 and, accordingly, Staffhas negotiated an Amendment No.3 to the
Agreement; and
WHEREAS, the Executive Director and RDA Staff will herein recommend that the Mayor
and City Commission ratify said Amendment No.3 to the Agreement.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission herein ratify Amendment No.3 to the Agreement between the Miami Beach
Redevelopment Agency and Kimley-Horn and Associates, Inc., for professional engineering and
landscaping services, in an amount not-to-exceed $70,925.00, for surveying of Phase II of the
South Pointe Streetscape Area.
PASSED and ADOPTED this 20th day of October, 1999.

BACKGROUND
On January 20, 1999, the City Commission authorized the Administration to negotiate an
agreement with Kimley-Hom and Associates, Inc. The Administration negotiated a not-to-exceed
fee of $170,760 for the preparation of the final master plan and opinion of probable cost for the
entire project. The scope of services included in the initial phase of work consisted of data
collection and a review of existing documents resulting in the preparation of a master plan and
surveying for the Phase I improvements.
Amendment No.1 approved on May 26, 1999 included a not-to-exceed fee in the amount of
$389,100 for the preparation of construction documents, permitting and bidding services for
Phase 1.
Amendment No.2 approved on May 26, 1999 included a not-to-exceed fee in the amount of
$103,800 included surveying, master plan design, preparation of bidding and construction
documents and permitting for the Washington Avenue extension.

In order to meet the time schedule prepared as part of the master plan, Phase II surveying was
scheduled to begin simultaneously with the completion of the ninety percent plan for Phase I.
Phase II includes the following streets:

Professional Services Agreement (Agreement), dated February 17, 1999, by and between the

RECIT ALS
WHEREAS, the Agreement provides for the preparation of the final Master Plan for the
South Pointe Redevelopment Area Project; and
WHEREAS, this Amendment No.3 to the Agreement provides for surveying Phase II

Exhibit "A", entitled "Scope of Services/Fee", is amended to add the work attached
hereto and incorporated herein as Exhibit "A-I" of this Amendment.
Exhibit "C", entitled "Schedule", is amended to add the schedule attached hereto and
incorporated herein as Exhibit "C-l" to this Amendment.
3. OTHER PROVISIONS
All other provisions of the Agreement, as amended, are unchanged.
4. RATIFICATION
The RDA and Consultant ratify the terms of the Agreement, as modified by this
Amendment No. 3.
IN WITNESS WHEREOF, the parties hereto have caused this Third Amendment to be

SCOPE OF SERVICES
Task 1 - Survey Services
Kimley-Hom and Associates will provide the following survey services:
a) The consultant will place and locate I I aerial targets for use in providing Raster aerial
imagery, The aerial targets will be set at the locations as specified by the
photogrammetist.
b) Ground control (horizontal) will be established along Second Street, Fourth Street, Fifth
Street, Lenox Avenue, Michigan Avenue, Jefferson Avenue, Meridian Avenue, and
Euclid A venue corridors, Additional control will be required in the future for the
development of other roadway corridors.
c) A centerline of construction will be calculated for Second Street, Fourth Street, Fifth
Street, Lenox Avenue, Michigan Avenue, Jefferson Avenue, Meridian Avenue, Euclid
Avenue and Alton Road, Minimal right-of-way and/or property monuments will be
located,
A bench level run will be perfonned and bench marks wiII be set along the Second
Street, Fourth Street, Fifth Street, Lenox Avenue, Michigan Avenue, Jefferson Avenue,
Meridian A venue, and Euclid A venue corridors. The elevations of the bench marks will
reference the local- Miami Bay Datum. These bench marks wiII be set outside the limits
of construction (where possible), and referenced by station and offset to the center line of
cO'nstruction,
d) A field topography survey (survey points only) will be perfonned along the existing
roadway corridor (Second Street, Fourth Street, Lenox Avenue, Michigan Avenue,
Jefferson A venue, Meridian A venue, and Euclid Avenue). The survey limits are to the
buildings or to 10 feet beyond the right-of-way (whichever comes first), subject to
accessibility. Survey limits of Fifth Street are the south one-half of the roadway. Trees,
street signs and driveway profiles will not be surveyed.
e) The location, pipe size, rim and invert elevations will be obtained for accessible drainage
structures and gravity flow sewers within the existing roadway corridors (Second Street,
Fourth Street, Fifth Street, Lenox A venue, Michigan A venue, Jefferson A venue,
Meridian Avenue and Euclid Avenue), Confined space entry surveys of structures will
not be perfonned.
f) The above ground (surface) utilities associated with underground utilities (such as valves,
meters, fire hydrants, etc.) wi\I be located,
g) Field surveys will be suitable for preparing engineering and construction drawings,

Note: AI! references to survey associated with Fifth Street are limited to the south half of
the roadway, All references to survey associated with AIton Road are limited to the
locations of intersecting streets at this time,
Task 2 - Reimbursements
a) Kim ley-Horn will have geotechnical data gathered consisting of five (5) percolation tests
and three (3) pavement cores within the project area. The percolation test will be
performed in general accordance with the Usual Open-Hole Constant head procedures
suggested by South Florida Water Management District (SFWMD) to a depth of IS feet
to provide data required for drainage evaluation at the subject site.
b) Kim ley-Horn will have professional photogrammetric services flown including aerial
photography, aerial triangulation, and raster imagery (Descartes format),
Task 3 - Additional Services
Upon your authorization, we will provide any additional services that may be required beyond
those described in Task I. These services may include but are not limited to such items as the
following:
a) Preparation of right of way acquisition sketches or descriptions.
b) Construction Documentation for Phase II through V
c) Conducting subsurface geotechnical investigations.
d) Providing construction phase services,
e) Making traffic counts or undertaking other traffic related analysis.
f) Traffic signal plans.
