Attached, please find copies of Joint Resolutions adopted by the Historic Preservation and Planning Boards at
their June 28, 2005 workshop. The Boards are urging the City Commission to take the following action:
1. Adopt the proposed revisions to the Land Development Regulations of the City Code pertaining to
Nonconforming Buildings, and Engineer and Reconstruction Requirements.
2. Adopt the proposed revisions to the City Code pertaining to Building Recertification Procedures.
The Nonconforming Ordinance and the Engineer and Reconstruction Requirements Ordinance are on the July
11, 2005 agenda of the Land Use and Development Committee. It is anticipated that both Ordinances will be
considered by the City Commission on September 7,2005.

HISTORIC PRESERVATION BOARD AND PLANNING BOARD
JOINT RESOLUTION
WHEREAS, the City of Miami Beach Planning and Historic Preservation Boards are
charged by Ordinance as serving in an advisory capacity to the City Commission and other
City Boards on issues affecting Ordinance Amendments, as well as the City's architecture,
design, historic districts and structures; and
WHEREAS, the Historic Preservation and Planning Boards strongly supports the
efforts of the Mayor's Blue Ribbon Panel on the Structural Integrity of Historic Buildings to
address the issues of demolition by neglect and the failure of property owners to maintain
existing historic structures; and
WHEREAS, the final report of the Mayor's Blue Ribbon Panel on the Structural
Integrity of Historic Buildings recommmended that the building recertification procedures
should be amended to shorten the amount of time in between required recertifications for
structures located in historic districts.
THEREFORE, it is hereby resolved that the Historic Preservation Board and the
Planning Board strongly urge the City Commission to adopt the proposed revisions to the
City Code pertaining to Building Recertification Procedures.

WHEREAS, the City of Miami Beach Planning and Historic Preservation Boards are

City Boards on issues affecting Ordinance Amendments, as well as the City's architecture,
design, historic districts and structures; and
WHEREAS, the Historic Preservation and Planning Boards strongly supports the

WHEREAS, the final report of the Mayor's Blue Ribbon Panel on the Structural
Integrity of Historic Buildings recommended that the nonconforming building regulations,
(as well as all related regulations) be amended to assure the protection of existing
structures by creating tangible disincentives for demolition by neglect; and
WHEREAS, the Historic Preservation and Planning Boards strongly support the
disincentives proposed for non-conforming structures being extended to conforming
structures; and
WHEREAS, the Historic Preservation and Planning Boards strongly support the
proposal for an independent Structural Engineer to evaluate demolition requests, on a
case-by-case basis.
THEREFORE, it is hereby resolved that the Historic Preservation Board and the
Planning Board strongly urge the City Commission to adopt the proposed revisions to the
Land Development Regulations of the City Code pertaining to Nonconforming Buildings,
and Engineer and Reconstruction Requirements.
