A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, APPROVING THE APPROPRIATION OF $2.5 MILLION FOR THE
CONSTRUCTION OF THE PROPOSED MIAMI CITY BALLET FACILITY FROM
TOURIST CONVENTION CENTER EXPANSION AUTHORITY (TCCEA) FUNDS AS
PART OF THE PROPOSED CULTURAL ARTS COMPLEX; FURTHER AUTHORIZING
THE EXPENDITURE OF SAID FUNDS,
WHEREAS, in April, 1994, the Mayor and City Commission executed a Ground Lease
Agreement (Ground Lease) between the City of Miami Beach and the Miami City Ballet,
Inc., for a proposed permanent facility, which terms included a grant from the Tourist
Convention Center Expansion Authority (TCCEA) the form of a matching grant, up to
$2.5 million, to pay for developing the land and constructing the building; and
WHEREAS, on June 18, 1997, the Mayor and City Commission approved a First
Amendment to Ground Lease changing the location of the designated site for the
proposed Ballet facility to the Collins Park District of Miami Beach; and
WHEREAS, on October 21,1997, the Mayor and City Commission approved a Second
Amendment to Ground Lease providing, among other things, that the Ballet must have
$2.5 million in matching cash and/or pledges available prior to the disbursement of the
City's $2.5 million grant; and
WHEREAS, a report by the City Manager to the Mayor and City Commission on
November 19, 1997 presented the Convention Center Capital Plan, which includes $2.5
million targeted for the proposed Ballet facility; and
WHEREAS, on June 11, 1997, the Tourist Convention Center Expansion Authority
(TCCEA) approved the motion to set aside $2.5 million for the development and
construction of the Miami City Ballet facility.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission herein approve the appropriation of $2.5 million for the construction of the
proposed Miami City Ballet facility as part of the proposed Cultural Arts Complex;
further authorizing the expenditure of said funds, said source of funding to be provided
from the Tourist Convention Center Expansion Authority (TCCEA)

Approve the resolution.
BACKGROUND:
On April 13, 1994, the Mayor and City Commission executed a Ground Lease Agreement
between the City of Miami Beach and the Miami City Ballet, Inc., for the proposed
permanent facility, which included in Section 27.01 a commitment of funds up to $2,5
million from funds previously committed by TCCEA to pay the cost of developing the land
and constructing the building in the form of a matching grant (the Grant).
The Ground Lease was amended on June 18, 1997 by the Mayor and City Commission
changing the location of the designated site for the proposed permanent facility for the
Miami City Ballet to the Collins Park District of Miami Beach.
The-Ground Lease was further amended on October 21, 1997 by the Mayor and, City
Commission and identified and designated the site for the proposed Miami City Ballet
permanent facility, and further clarified certain terms and conditions of the ground lease
agreement as well as incorporated the terms of the construction agreement. Included
among the amendment was a provision that the tenant has $2.5 million in cash and
pledges available prior to the disbursement of the Grant.
Further, a report by the City Manager to the Mayor and City Commission on November 19,
1997 presented the Convention Center capital plan which included the $2.5 million for the
Miami City Ballet facility.

ANAL YSIS:
On November 12, 1997, a memorandum from the Miami City Ballet to the City reported
that the required 1:1 matching funds have been secured. The Administration has reviewed
the documents and confirms that cash and pledges have been received.
The Miami City Ballet has requested that the City make the $2.5 million grant available by
January 5, 1998 in order to submit a strong grant application to the State of Florida for an
additional $500,000.
On June 11, 1997, TCCEA agreed to fund $2.5 million for the development and
construction of the Miami City Ballet facility. The appropriation and expenditure of these
funds will enable land development and construction of the facility for the Miami City Ballet.
CONCLUSION:
Approve the resolution to authorize the appropriation and expenditure of $2.5 million for
construction of the Miami City Ballet building as part of the Cultural Arts Campus.
