"') 3,l..(J Tb,is Amendment No. 6 to the Agreement made and entered this l>( day of fb-73iU/1-fUt ' 2005, by and between the CITY OF MIAMI BEACH, a Municipal Corporation existing under the laws of the State of Florida (hereinafter referred to as CITY), having its principal offices at 1700 Convention Center Drive, Miami Beach, Florida 33139, and Reynolds, Smith and Hills, Inc. (RS&H), having its offices at 6161 Blue Lagoon Drive, Suite 200, Miami Florida, 33126 (hereinafter referred to as Consultant). RECITALS WHEREAS, pursuant to Request for Qualifications (RFQ) NO.1 0-0001, the Mayor and City Commission adopted Resolution No. 2001-24551, on September 5, 2001, approving and authorizing the Mayor and City Clerk to execute an Agreement with Reynolds, Smith and Hills, Inc, for Professional Services for the La Gorce Streetscape Right-of-Way Neighborhood Project (the Project); and WHEREAS, the Agreement provides for the detailed planning services for various streetscape / landscape / utility improvements within the La Gorce neighborhood; and WHEREAS, the Agreement was executed for a not-to-exceed amount of $185,291.00; and WHEREAS, the planning effort for the La Gorce neighborhood has been completed and detail design activities are underway; and WHEREAS, on May 29, 2002" the Mayor and City Commission adopted Resolution No. 2002-24857, approving additional design services as Amendment NO.1 to the Agreement, for planning, design, permitting, bidding / award and construction administrative services for the Cherokee Avenue Sea wall improvements within the La Gorce neighborhood for a not-to-exceed amount of $45,000:00; and Page 10f5 MB: 4005 Amendment No.6 06 20 05 WHEREAS, on January 8, 2003, the Mayor and City Commission adopted Resolution No. 2003-25096, approving additional design services as Amendment No.2 to the Agreement, for design, permitting, bidding / award and construction administrative services for various streetscape /Iandscape / utility improvements within the La Gorce neighborhood and includes Cherokee Avenue seawall rehabilitation/replacement for a not-to-exceed amount of $333,932.00; and WHEREAS, on October 15, 2003, the Mayor and City Commission adopted Resolution No. 2003-25362, approving additional design services as Amendment No.3 to the Agreement, for design, permitting, bidding / award services for the relocation of existing utility improvements currently located along rear easements of approximately 153 properties, for an amount of $35,999.00; and WHEREAS, on June 21 , 2004, Amendment No.4 to the Agreement was executed, to perform percolation tests and collect additional survey data, to proceed with the design of stormwater improvements within the La Gorce neighborhood, for a not-to-exceed amount of $8,709.00; and WHEREAS, on November 18, 2004, Amendment No. 5 to the Agreement was executed, to include the development of sketches for alternative traffic flow improvement within the La Gorce Park area, for a not-to-exceed amount of $3,604.00; and WHEREAS, on February 23, 2005, the City Commission adopted Resolution No. 2005-25813 authorizing the execution of Amendment No.6 to the Agreement, to include a Scope of Work which consists of additional design services for stormwater improvements for the La Gorce neighborhood, for a not-to-exceed amount of $42,000; and WHEREAS, this proposal has been evaluated by Hazen & Sawyer, the City's Program Manager, and the CIP Office. NOW. THEREFORE. the parties hereto, and in consideration of the mutual promises, covenants, agreements, terms, and conditions herein contained, and other good and valuable consideration, the respect and adequacy are hereby acknowledged, do agree as follows: 1. ABOVE RECITALS The above recitals are true and correct and are incorporated as a part of this Amendment NO.6. 2. MODIFICATIONS The Agreement is amended as defined in Schedule "A-6", attached herein. The City and Consultant ratify the terms of the Agreement, as amended by this Amendment No.6. B ATTEST: City Clerk ATTEST: SMITH AND APPROVED AS TO FORM & LANGUAGE & FOR EXECUTION Page 3 of 5 MB: 4005 Amendment No.6 062005 21zk:r Date SCHEDULE "A-51' SCOPE OF SERVICES Schedule "A" entitled, "Scope of Services", is amended as follows: TASK 5 - ADDITIONAL SERVICES, after the language added for Amendment No.3, please insert the following: Task 5.2 - Additional Stormwater Desiqn Services: The original design concept for the La Gorce neighborhood assumed a gravity based stormwater disposal system via two new outfalls. However, as a result of final topographic survey findings, the Consultant determined that incorporation of two existing outfalls were required to provide requisite disposal capacity. In addition, ten (10) additional gravity disposal wells were required to properly dispose of the first 1-inch of stormwater runoff to meet regulatory agency mandated treatment requirements. Also, although the Lakeview area of the La Gorce neighborhood east of Cherokee Avenue is not considered a priority drainage basin, during the Community Design Review Planning process, the City's Public Works Department requested that all roadway corridors in the Lakeview area, regardless If they were within a priority basin or not, be repaved to assist with stormwater conveyance. To this end, the Consultant was required to develop ten additional paving, grading and drainage contract drawings to address these improvements. This work was not originally contemplated by the base scope of services. TIME OF COMPLETION Design revisions contemplated by this Amendment are to be included with the 90% design completion stage document submittal currently scheduled for August 5, 2005. Notice to Proceed for this work was issued on March 17, 2005, as the City Commission approved the work via Resolution No. 2005-25813 on February 23, 2005. PAYMENT AND COMPENSATION The method for calculating the fees for the aforementioned proposed engineering services (Task 5.2 is established in Exhibit "A' attached, based on estimated labor plus direct costs. The total fee proposed for this Scope of Work shall be on a not- to-exceed basis in the amount of $42,000.00. Invoicing will be monthly and based on hourly rates as defined in the current agreement between RS&H and the City of Miami Beach. The approved fee is considered to be all inclusive towards producing 100% construction documents and obtaining a permitable stormwater design from the various governmental authorities that have jurisdiction over the project. Dear Mr" Mistry: As per the negotiation meeting held on January 12, 2005, this letter is to submit a revised request for additional design fees for services performed outside the current scope of work for the subject project. The services consist of additional design associated with the proposed paving and grading plans, and Improvements to the stormwater system. The total fee requested for the additional services is $42,000, as shown on the attached Fee Schedule Summary Sheet, The following Is a desaiption of the additional services: Revise Umits of Paving and Grading During the Community Design Review Planning process, the City agreed to repave all roadways in the La Gorce Neighborhood to assist with stormwater conveyance.. Under the current scope of work, milling and resurfacing of the roadways was limited to North Bay Road (from Alton Road to 63rd Street) and 51st Street (from Alton Road to La Gorce Drive). In order to comply with the City's directive to repave all roadways, various design sheets had to be added or modified. The work includes defining the limits of milling and resurfacing, providing typical pavement design sections, a uniform radII at every Intersection, new asphalt driveway aprons where none currently exists, and extending existing sidewalks to the edge of pavement to meet ADA requirements, The breakdown of the effort associated with the additional paving and grading design services is shown on the attached Fee Schedule Summary Sheet. The following sheets are affected by the requirement to repave all roadways: 2A, 3A, 3B, 4A, 4B, SA, 5B, 7A, 7B, 8B,9A, lOB, 11A, 11B, 14A, and 14B. stonnwater System Improvements The attached letter from our subconsultant, RJ Behar & Company provides a comprehensive description of the additional services provided to comply with the criteria established in the Oty's Stormwater Master Plan. In addition, RS&H expanded a substantial amount of effort to coordinate the services and implement the changes in the design documents. The breakdown of the effort associated with the additional stormwater system design services is shown on the attached Fee Schedule Summary Sheet. Dming the course of advancing the project to the 60% submittal stage, we perfoImed a number of additional sezvices beyond the scope of the original contract. OutfalJs & Add New OutfaUs The original design concept in the planning phase (BODR) for the La Gorce neighbOIhood assumed a gzavity based stOJmwater disposal system via two new outfaIls, one each, in stormwate1 Basins 103 & 117/118, Howeve1, as a result of final topogzaphic SUIvey findings and modeling the system with this data, it was deteIDUned that the zequjred size for the two proposed new outfalls would be extremely large and result in . various conmuctability issues., In ordet. to reduce the required siies, the two new outfaIls were integzated along the tWo existing outfaIls iilto the pIoposed system layout. This combination is required to provide the necessary disposal capacity in ordez to meet the City's Stormwater Master Plan (SWMP) crite1ia. 2. Additional Gr'avitv Injection Wells & French Drains An additional 10 gravity injection wells are required fOJ Basin 103 in order to meet the regulatory agencies cziteria for water quality treatment, The oIiginal design concept in the planning phase (BODR) included 7 gravity wells. However, as a result of final topogzaphic SU1vey findings and modeling the syStem with this data, it waS determined that 17 gzavity wells will be required for the basin to comply with the minimum water quality criteIia from the Dep8.1tment ofEnvllonmental ResoUI'ce Management. .. I The estimated length of French Drains in Basins 1117 and 118 used dming the planning phase (BODR) was based on an assumed peI'cola~oh late of the soil in the ar'ea because actual data was not available. Therefore, a Ieasonable assumption was made using a pe1'colation rate ii-om a test performed on the near'by FDOI Alton Road project. Upon review of the actual pe1colation tests pe1fOlmed within Basin 117 and 118, we reaIized the actual percolation Iates were less favoIable than originally anticipated, This resulted in the water quality calculation requiring 2,300 LF of French Drains and 4 gzavity injection wells instead oft ,200 LF of French Dzains originally estimated with the assumed percolation rate, Attached please find ow. fee Iequest fOI the additional wOIk effOlt outlined helem.
