HomeMy WebLinkAboutReynolds Smith & Hill Amend 9 ~oor-;J..~ g/~ AMENDMENT NO.9 TO THE PROFESSIONAL LANDSCAPE ARCHITECTURAL AND ENGINEERING SERVICES AGREEMENT BETWEEN THE CITY OF MIAMI BEACH, FLORIDA AND REYNOLDS, SMITH AND HILLS, INC, DATED MAY 16, 2001 FOR THE PROVISION OF PROFESSIONAL SERVICES FOR ADDITIONAL SERVICES ASSOCIATED WITH STORMWATER DESIGN IN AN AMOUNT NOT -TO-EXCEED $65,000.00 FOR NEIGHBORHOOD NO.7 - NAUTILUS PROJECT. This Amendment No. 9 to the Agreement made and entered this Ol.jlJ) day of ftAb/Ul/ffL1_, 2005, by and between the CITY OF MIAMI BEACH, a Municipal Corporation existing under the laws of the State of Florida (hereinafter referred to as CITY), having its principal offices at 1700 Convention Center Drive, Miami Beach, Florida 33139, and Reynolds, Smith and Hills, Inc. (RS&H), having its offices at 6161 Blue Lagoon Drive, Suite 200, Miami Florida, 33126 (hereinafter referred to as Consultant). RECITALS WHEREAS, pursuant to Request for Qualifications (RFQ) No.7 -00/01, the Mayor and City Commission adopted Resolution No. 2001-24389, on May 16, 2001, approving and authorizing the Mayor and City Clerk to execute an Agreement with Reynolds, Smith and Hills, Inc, for Professional Services for the Nautilus Streetscape Right-of-Way Neighborhood Project (the Project); and WHEREAS, the Agreement provides for the detailed planning and design services for various streetscape / landscape / utility improvements within the Nautilus neighborhood; and WHEREAS, the Agreement was executed for a not-to-exceed amount of $744,071.00; and WHEREAS, the planning effort for the Nautilus neighborhood has been completed and detail design activities are underway; and WHEREAS, on December 19, 2001, the Mayor and City Commission adopted Resolution No. 2001-24682, approving additional planning services as Amendment No.1 to the Agreement, for AlE services associated with additional planning for the project related to the Orchard Park area within the Nautilus Neighborhood, for an amount of Page 1 0(6 MB: 4007 Amendment No.9 07.01.05 $51,523.00; and WHEREAS, on November 25,2003, the Mayor and City Commission adopted Resolution No. 2003-25394, approving additional design services as Amendment NO.2 to the Agreement, for the development of rear easement, water service relocation drawings (Sketches) for 193 properties in the Nautilus Neighborhood, for an amount of $51,240.00. Note that Amendment No. 2 includes a credit of $2,734.00 for the deletion of approximately 3,015 Linear Feet of watermains identified for replacement from the original scope of services, which the Public Works Department subsequently determined did not require replacement; and WHEREAS, on November 4,2003, Amendment NO.3 to the Agreement was executed, for additional design services associated with complying with the Public Works Department revised lighting design criteria of 0.6 foot-candle (reduced from an already designed 1.0 foot-candle standard), for an amount of $8,167.00; and WHEREAS, on January 16, 2004, Amendment No. 4 to the Agreement was executed, for design and construction administration services associated with the design and construction administration of 1 ,400 feet of 8-inch ductile iron watermain along 42nd Street between Prairie Avenue and Pine Tree Drive, identified by the Public Works Department for replacement after the original scope of the project was developed, for an amount of $14,966.00; and WHEREAS, on November 5,2004, Amendment NO.5 to the Agreement was executed, for the development of rear easement, water service relocation drawings (Sketches) for 39 additional properties within the Nautilus Neighborhood, that were identified for replacement by the Public Works Department after the original project scope was developed, for an amount of $1 0,761.00. Note that this Amendment included a credit of $2,499.00 for the preparation of 18 water service relocation sketches that were previously authorized under Amendment No.2, but subsequently determined not to be required. WHEREAS, on December 6, 2004, Amendment No. 6 to the Agreement was executed, for additional engineering services to design, permit, bid, award and construction administration services for landscaping improvements associated with proposed stormwater easements at the Miami Heart Institute, for an amount of $23,500.00; and WHEREAS, on January 12, 2005, Amendment No. 7 to the Agreement was executed, to collect additional survey data required to proceed with the design of stormwater improvements in the Nautilus Neighborhood, for an amount of $11,518.00; and Page 20f6 MB: 4007 Amendment No.9 07.01.05 WHEREAS, Amendment No.8 to the Agreement is yet to be executed; and WHEREAS, on February 23, 2005, the City Commission adopted Resolution No. 2005-25812 authorizing the execution of Amendment No.9 to the Agreement, consisting of additional design services for stormwater improvements for the Nautilus neighborhood, for an amount of $65,000.00; and WHEREAS, this proposal has been evaluated by Hazen & Sawyer, the City's Program Manager, and the CIP Office. NOW. THEREFORE. the parties hereto, and in consideration of the mutual promises, covenants, agreements, terms, and conditions herein contained, and other good and valuable consideration, the respect and adequacy are hereby acknowledged, do agree as follows: 1. ABOVE RECITALS The above recitals are true and correct and are incorporated as a part of this Amendment No.9. 2. MODIFICATIONS The Agreement is amended as defined in Schedule "A-9", attached herein. 3. OTHER PROVISIONS. All other provisions of the Agreement, as amended, are unchanged. 4. RATIFICATION. The City and Consultant ratify the terms of the Agreement, as amended by this Amendment No.9. However, as a result of final topographic survey findings, the CONSULTANT determined that two additional outfalls, along with the integration of two existing outfalls into the proposed system layout, were required to provide requisite disposal capacity. As available corridors for the routing of the two new additional outfalls were limited because of existing improvements in the neighborhood, the CONSULTANT was also required to coordinate its efforts with the Miami Heart Institute (MHI), to facilitate the execution of easements with MHI for two proposed stormwater outfalls. In addition, it was determined that the Nautilus neighborhood had a "low lying area" that would require the design of two pump stations and ancillary injection wells. This work was also not originally contemplated by the base scope of services. Based on these criteria, the City and Consultant agreed that $65,000.00 represented a fair and reasonable fee adjustment for the level of effort required to develop an additional 15 contract drawings, as well as facilitate the MHI easements. TIME OF COMPLETION Design revisions contemplated by this Amendment are to be included with the 60% design completion stage document submittal currently scheduled for June 20, 2005. Notice to Proceed for this work was issued on March 17, 2005, as the City Commission approved the work via Resolution No. 2005-25812 on February 23, 2005. PAYMENT AND COMPENSATION The method for calculating the fees for the aforementioned proposed engineering services (Task 5.2 is established in Exhibit "A' attached, based on estimated labor plus direct costs. The total fee proposed for this Scope of Work shall be on a not- to-exceed basis in the amount of $65,000.00. Invoicing will be monthly and based on hourly rates as defined in the current agreement between RS&H and the City of Miami Beach. The approved fee is considered to be all inclusive towards producing 100% construction documents and obtaining a permitable stormwater design from the various governmental authorities that have jurisdiction over the project. This request also includes the fee proposal for the design of the pump stations required in Basin 92 and Basin 97. The attached letter from our subconsultant, RJ Behar, provides a comprehensive description of the additional services provided and the scope of work associated with the design of the pump stations. The total fee requested for the additional services is $65,000, as shown on the attached Fee Schedule Summary Sheet. In addition, it is necessmy to design 2 stOlmwater pumping stations and pressmized injection wells in order for the proposed stOImwater system to meet criteria established in the City's StOlmwater Master Plan based on actual site conditions. The additional services included in this request are as follow: 1. Revise ConceDt to Include Existine Outfalls & Add New Outfalls The original design concept in the planning phase (BODR) for the Nautilus neighbOIhood assumed a gravity based stormwater disposal system via three new outfalls, one new outfall in each of the three stormwater basins (Basins 92, 97 & 99). However, as a result of final topographic smvey findings and modeling the system with this data, the extl'emely lmge size of the required outfalls would have resulted in vmious constructability issues. In order to reduce the required sizes, the three new outfaIls were integrated along the three existing outfa1ls into :the proposed system layout. 1bis combination is required to provide the necessmy disposal capacity in order to meet the City's StOlmwater Master Plan (SWMP) criteria 2. Coordination fol' Easements for' Two ProDOsed Outfalls As available conidors for the !Outing of the two of the three proposed new outfalls were limited because of existing improvements in the neighborhood, we were required to coordinate our effOlts with the Miami Hemt Institute (Mill), to facilitate the execution of easements for the two plOposed stormwater outfaIls The outfall for Basin 99 will be located on the west side of the pmking area adjacent to the Alton Road Bridge at W. 48th Street. The other outfall, for Basin 97, will be }o<mted at the south side of the MHI between the pmking stIuctU1e and the W, 47th Street Bridge, 3. PurnD Station. Plans and Calculations (Basins 92 and 97) Dming the COUlse of our design development and modeling effOIts, it was deteImined that the Nautilus neighbolhood has "low lying meas" in two of the pliOIity basins (Basin 92 & 97) that will requiIe two pump stations and pressmized injection wells, combined with the originally planned gravity wells.. The "low lying al'eas" were discovered upon review of the completed topographic sUlvey fOl the neighb01hood, The gravity system OIiginally proposed could not eliminate the significant level of flooding in those areas due to the lack of available driving head, The two pump stations (one per basin) are necessary in order to meet the City's SWMP criteria fot allowable flooding and required quality treatment The design of the pump stations and pressutized injection wells (including calculations and plans) and revision of the system layout to incorporate the pump stations and pressutized injection wells was not included in Out' base scope of services We estimate that the pump station plans and pressutized injection wells will require an additional 15 plan sheets as shown in Attachment A Attached please find a breakdown of our fee request for the additional work effott outlined above, We respectfully request that RS&H pursue this request for additional funds.
