Amendment No. 8 AMENDMENT NO. 8 TO THE PROFESSIONAL LANDSCAPE ARCHITECTURAL AND ENGINEERING SERVICES AGREEMENT BETWEEN THE CITY OF MIAMI BEACH, FLORIDA AND REYNOLDS, SMITH AND HILLS, INC, DATED SEPTEMBER 5, 2001 FOR THE PROVISION OF PROFESSIONAL SERVICES TO DESIGN VARIOUS STREETSCAPE IMPROVEMENTS AND A TRAFFIC STUDY IN AN AMOUNT NOT-TO-EXCEED $22,829 FOR NEIGHBORHOOD NO. 5 - LA GORCE PROJECT. T/~Amendment No. 8 to the Agreement made and entered this .~tb~ day of ~cc~'[~ ,2005, by and between the CITY OF MIAMI BEACH, a Municipal Corporation existing under the laws of the State of Florida (hereinafter referred to as CITY), having its principal offices at 1700 Convention Center Drive, Miami Beach, Florida 33139, and Reynolds, Smith and Hills, Inc. (RS&H), having its offices at 6161 Blue Lagoon Drive, Suite 200, Miami Florida, 33126 (hereinafter referred to as Consultant). RECITALS WHEREAS, pursuant to Request for Qualifications (RFQ) No. 10-0001, the Mayor and City Commission adopted Resolution No. 2001-24551, on September 5, 2001, approving and authorizing the Mayor and City Clerk to execute an Agreement with Reynolds, Smith and Hills, Inc, for Professional Services for the La Gorce Streetscape Right-of-Way Neighborhood Project (the Project); and WHEREAS, the Agreement provides for the detailed planning services for various streetscape /landscape / utility improvements within the La Gorce neighborhood; and WHEREAS, the Agreement was executed for a not-to-exceed amount of $185,291; and WHEREAS, the planning effort for the La Gorce neighborhood has been completed and detail design activities are underway; and WHEREAS, on May 29, 2002,, the Mayor and City Commission adopted Resolution No. 2002-24857, approving additional design services as Amendment No. 1 to the Agreement, for planning, design, permitting, bidding / award and construction administrative services for the Cherokee Avenue Sea wall improvements within the La Gorce neighborhood for a not-to-exceed amount of $45,000:00; and Page f of 5 MB: 4005 Amendment No. 8 06 20 05 WHEREAS, on January 8, 2003, the Mayor and City Commission adopted Resolution No. 2003-25096, approving additional design services as Amendment No. 2 to the Agreement, for design, permitting, bidding / award and construction administrative services for various streetscape / landscape / utility improvements within the La Gorce neighborhood and includes Cherokee Avenue Seawall rehabilitation/replacement for a not-to-exceed amount of $333,932.00; and WHEREAS, on October 15, 2003, the Mayor and City Commission adopted Resolution No. 2003-25362, approving additional design services as Amendment No. 3 to the Agreement, for design, permitting, bidding / award services for the relocation of existing utility improvements currently located along rear easements of approximately 153 properties, for an amount of $35,999; and WHEREAS, on June 21,2004, Amendment No. 4 to the Agreement was executed, to perform percolation tests and collect additional survey data, to proceed with the design of stormwater improvements within the La Gorce neighborhood, for a not-to-exceed amount of $8,709.00; and WHEREAS, on November 18, 2004, Amendment No. 5 to the Agreement was executed, to include the development of sketches for alternative traffic flow improvement within the La Gorce Park area, for a not-to-exceed amount of $3,604.00; and WHEREAS, on February 23, 2005, the City Commission adopted Resolution No. 2005-25813 authorizing the execution of Amendment No. 6 to the Agreement, to include a Scope of Work which consists of additional design services for stormwater improvements for the La Gorce neighborhood, for a not-to-exceed amount of $42,000.00; and WHEREAS, Amendment No. 7 to the Agreement is to be executed, to include the verification of additional underground utilities to avoid conflicts in 90 boring sites, for a not-to-exceed amount of $22,150.00; and WHEREAS, Amendment No. 8 to the Agreement is to include design of various streetscape improvements and a traffic study in the La Gorce Neighborhood, for a not-to- exceed amount of $22,829.00; and WHEREAS, this proposal has been evaluated by Hazen & Sawyer, the City's Program Manager, and the CIP Office. NOW, THEREFORE, the parties hereto, and in consideration of the mutual promises, covenants, agreements, terms, and conditions herein contained, and other good and valuable consideration, the respect and adequacy are hereby acknowledged, do agree as follows: Page 2 of 5 MB: 4005 Amendment No. 8 06 20 05 ABOVE RECITALS The above recitals are true and correct and are incorporated as a part of this Amendment No. 8. MODIFICATIONS The Agreement is amended as defined in Schedule "A-8", attached herein. OTHER PROVISIONS. All other provisions of the Agreement, as amended, are unchanged. RATIFICATION. The City and Consultant ratify the terms of the Agreement, as amended by this Amendment No. 8. Consultant is to design permitable streetscape modifications in the areas as noted in Attachment B. The La Gorce Park area is characterized by a group of streets, Alton Road extension, La Gorce Drive extension, Pine Tree Drive Extension, North Bay Road, and Pine Tree Drive Circle. The northern boundary is the entrance to La Gorce Island, eastern boundary is Alton Road extension, western boundary is Pine Tree Drive, and southern boundary is West 63rd Street, The proposed La Gorce Park area streetscape improvements are as shown in Attachment B. The streetscape modifications included reconfiguration of the geometry of the intersections and pavement narrowing at three (3) locations as shown in Attachment B. The CONSULTANT shall prepare design documents in this area as agreed to by residents as "Beautification" improvements. The City does not anticipate that a traffic study will be required. In the event that Miami-Dade Public Works Department Traffic Engineering Division (MD-PWDTED) requests that a traffic study be prepared for the proposed La Gorce Park area improvements, the CONSULTANT shall prepare and forward a letter to the City with its recommendations as to whether or not it agrees with MD-PWDTED's position on a traffic study and the reasoning behind this opinion. Based on the CONSULTANT's letter, the City may choose to revisit the issue with the County independently. Note that a separate Notice to Proceed is required for the preparation of a traffic study and analysis. Even though it is included in the scope of this Amendment, it is not the City's intent to proceed with this study until all other means are exhausted. Intersection of 51st Street and Cherokee Avenue In accordance with Amendment No.2, the CONSULTANT performed a traffic study along West 51st Street to justify stop signs at the intersection of West 51st Street and Cherokee Avenue. The traffic study confirmed that stop signs could not be supported at this intersection. At CDRM No.1 on September 13, 2004, residents voiced concerns with respect to perceived speeding problems along West 51st Street. Alternative traffic calming measures were discussed and consensus was reached with residents to implement a "beautification" traffic circle at this intersection, subject to MD-PWDTED approval. Page 4 of 5 MB: 4005 Amendment No.8 06 20 05 The CONSULTANT has opined that a traffic study will need to be performed in support of the proposed traffic circle. The CONSULTANT shall design one (1) traffic circle at the intersection of W. 51st Street and Cherokee Avenue as per the schematic illustration shown in Attachment A. In this effort, the CONSULTANT shall utilize the existing traffic study completed in accordance with Amendment No.2 to obtain MD-PWDTED conceptual acceptance of the "beautification" circle. In the event that MD-PWDTED requests that a traffic study be prepared for the proposed traffic circle, the CONSULTANT shall prepare and forward a letter to the City with its recommendations as to whether or not it agrees with MD-PWDTED's position on a traffic study and the reasoning behind this opinion. The fee associated with this request is $22,829, as shown in the attached Summary Sheet. The services to be provided are as follows: c~ Design of one (1) traffic island at the intersection of W. 51st Street and Cherokee Avenue as per the schematic shown in Attachment A. Revise Opinion of Probable Construction Cost to include the proposed modifications. The additional design services to be provided are based on the following assumptions: c~ The landscaping scheme and geometry for the remainder of the W. 51~ Street corridor will remain as currently shown in the plans. c~ The landscaping scheme for the La Gorce Park area will remain as currently shown in the plans. c~ Additional landscape design for the La Gorce Park area, for the modified intersect/ohs described above, is not included in the fee. ~ The design of lighting and/or irrigation elements is not included in the fee. ~ Permit costs, where required, are not included in the fee. The study will specifically address traffic impacts along North Bay Road, Pine Tree Drive, La Gorce Drive, Pine Tree Drive Circle (in the La Gorce Park area) and the intersection of West $1 Street and Cherokee Avenue. Scope og Services Task A -Tuming Movement Count_s: Manual turning movement counts will be conducted to establish traffic flow patterns in the study network. Turning movement counts will be conducted on typical weekdays during the AM, PM peak periods (2-hrs. each period). Turning movement counts will be collected at the following intersections: 1. West 63r~ Street and Pine Tree Drive 2. West 63rd Street and La Gorce Drive 3. Pine Tree Drive, La Gorce Drive and North Bay Road 4. Pine Tree Drive and Pine Tree Drive Circle 5. West 51 Street and Cherokee Avenue Task B - Automatic Machine Count.~: Automatic traffic counts will be conducted to establish daily traffic flow patterns for the network. Automatic machine counts will be collected on typical weekdays for a continuous 72-hour period. The machine counts shall be collected at the following locations: 1. North Bay Road north of West 63rd Street 2. Pine Tree Drive north of West 63rd Street 3. La Gorce Drive north of West 63rd Street 4. 51 ~ Street and Cherokee Avenue (all approaches) Task C - Evaluation of Proposed Road Improvements: An evaluation will be conducted for the proposed roadway improvement schemes (see Attachments A and B). The evaluation will assess the expected impact on traffic flow patterns, safety, and intersection operations. Task D - Documentation: Recommendations will be developed based on findings from the study. The data collection, findings and recommendations will be documented in a technical memorandum format and submitted to the City of Miami Beach Public Work Department and the Miami-Dade Public Works Department for review and authorization. Schedule It is estimated that the Traffic Study will be completed within five (5) weeks from receipt of authorization to proceed. Based upon the recommendations of the Traffic Study, the permitting phase will be completed approximately sixteen (16) weeks from receipt of authorization to proceed.
