HomeMy WebLinkAbout2005-26020 Reso RESOLUTION NO. 2005-26020 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND MIAMI-DADE COUNTY, FLORIDA, FOR THE VENETIAN CAUSEWAY STREETSCAPE IMPROVEMENTS. WHEREAS, on November 20, 1996, Resolution No. 96-22205, authorized execution of an Agreement with the firm of Urban Resources Group (URG) for professional services for the Venetian Causeway Master Plan (the Agreement) (the Project); and WHEREAS, the scope included assessment of conditions, community meetings, workshops, schematic plans, design studies, final master plan and presentations; and WHEREAS, on April 12, 2000, by Resolution No. 2000-23871, the City approved Amendment No. 2 to the Agreement for Phase I of the Project, which included improvements to the Venetian Islands; and WHEREAS, other portions of the Project remained under discussion and it was determined that they necessitated agreement between the City, the City of Miami (Miami) and Miami-Dade County (the County) because all three municipalities have some jurisdiction over the Causeway, and also are part of the planned improvements; and WHEREAS, in 1999, when the General Obligation Bond (GO) was approved by the votes of the City, an allocation of $1,827,000 was included for the master plan portion of the Project, for streetscape improvements and above the surface enhancements to the Causeway, from the City limits to Dade Boulevard; and WHEREAS, during the last few years the City has been involved in negotiations with the County and with Miami to determine how best to implement and fund as much of the Project as possible; and WHEREAS, the result of these discussions and negotiations has led to the preparation of the attached Interlocal Agreement (Interlocal) which delineates the obligations and rights that the City and the County will have in the implementation of the Project and how the funding contribution from the City will be incorporated; and WHEREAS, the Interlocal states that the City will only fund that portion of the Project that is within the City's right of way (ROW), in the amount of $180,000, to be applied toward the retention by the County of a consultant to plan and design the Project in accordance with the master plan previously approved; and WHEREAS, the City will be entitled to participate in the selection of the consultant in a joint evaluation committee with the County, and will have one member in the committee; and WHEREAS, the City will be allowed to participate and comment on the planning and design process and shall have final review and approval of the deliverables from the consultant; and WHEREAS, if the City and the County cannot fully agree on the content of the deliverables, the City's funds can only be used for the above ground improvements agreed to in the Project; and WHEREAS, the Interlocal also stipulates that the scope of work being funded will not include any undergrounding of utilities or infrastructure scope and that funding for any scope other than for the streetscape improvements delineated in the Interlocal shall be provided from sources other than the City's GO contribution; and WHEREAS, the Interlocal addresses only the planning and design portion of the Project and the parties acknowledge that the currently identified funding for the Project is insufficient to fully implement the master plan, and that the actual improvements to be constructed will be identified and mutually agreed to by the City and the County through a prioritization process once the design process is completed; and WHEREAS, based on the extensive discussions and negotiations between the parties, and the provisions and stipulations of the Interlocal Agreement, which clearly delineate the City's involvement, as well as protects the City's investment in the Project, the Administration recommends that the Interlocal Agreement between the City of Miami Beach and Miami-Dade County for the Venetian Causeway Streetscape Improvements be approved. NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve and authorize the Mayor and City Clerk to execute the attached Interlocal Agreement between the City of Miami Beach and Miami-Dade County, Florida, for the Venetian Causeway Streetscape Improvements Project. ADMINISTRATION RECOMMENDATION Adopt the Resolution. BACKGROUND On November 20, 1996, Resolution No. 96-22205, by the Mayor and City Commission of the City of Miami Beach, Florida, authorized execution of an Agreement with the firm of Urban Resources Group (URG) for professional services for the Venetian Causeway Master Plan (the Agreement) (the Project). At the time, the scope included assessment of conditions, community meetings, workshops, schematic plans, design studies, Final Master Plan and presentations. It was intended that once the Master Plan was presented and approved by the City, negotiations for design services and construction documents would occur and an Amendment to the Agreement would be proposed and executed. On April 12, 2000, by Resolution No. 2000-23871 the City approved Amendment NO.2 to the Agreement for Phase I of the Project which included improvements to the Venetian Islands. Other portions of the Master Plan remained under discussion and it was determined that they necessitated an agreement between the City of Miami Beach (the City), the City of Miami (Miami) and the Miami-Dade County (the County) because all three have some jurisdiction over the causeway and also are part of the planned improvements. In 2003 through various discussions between all parties it was agreed that the best way would be for the County and the City to enter into an Interlocal Agreement (the Interlocal) to jointly manage the planning, design and construction of the Venetian Causeway Improvements. The result of these discussions and negotiations has led to the preparation of the Interlocal document presented with this memorandum which delineates the obligations and rights that both parties will have in the implementation of the Project and how the funding contribution from the City will be incorporated. The document states that the City will only fund that portion of the project that is within the City's Right of Way (ROW). The document also states that at this time the City will only provide $180,000 towards the commissioning of a consultant to plan and design the Project in accordance to the Master Plan previously approved. The City will be entitled to participate in the selection of the consultant in a joint evaluation committee with the County and will have one member on the committee. The City will also be allowed to participate and comment on the planning and design process and shall have final review and approval of the deliverables from the consultant. The Interlocal stipulates that if the City and the County cannot fully agree on the content of the deliverables the City's funds can only be used for the above ground improvements agreed to in the Master Plan. The City Commission and the County will jointly review and approve the Concept Plan by the consultant prior to proceeding to the design phase of the Project. The Interlocal also stipulates that the scope of work being funded under this agreement will not include any under grounding of utilities or infrastructure scope. Funding for any scope other than for the streetscape improvements delineated in the Interlocal shall be provided from sources other than the City's GO contribution. The City will be given an opportunity to review documents throughout all phases of the process and shall be jointly involved with the County in the development of the documents. This Interlocal addresses only the planning and design portion of the Project. The parties acknowledge that the currently identified funding for the project is insufficient to fully implement the Master Plan and that the actual improvements to be constructed will be identified and mutually agreed to by the City and the County through a prioritization process once the design process is completed. This document shall also identify improvements that are not feasible with current funding but should be considered in the future if additional project funding becomes available. The final deliverable shall include Budget Level Estimates prepared solely by the Consultant that match Project funding. CONCLUSION Based on the extensive discussions and negotiations between the parties and the provisions and stipulations of the Interlocal Agreement which clearly delineate the City's involvement as well as protects the City's investment in the Project and the City's City Commission Memorandum October 19, 2005 Venetian Causeway Inter/ocal Agreement Page 3 of 3 GO contribution, the Administration recommends that the Interlocal Agreement between the City of Miami Beach and the Miami-Dade County, Florida for the Venetian Causeway Streetscape Improvements Project be approved.
