HomeMy WebLinkAbout2005-26036 Reso RESOLUTION NO. 2005-26036 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AMENDMENT NO. 1 TO THE AGREEMENT WITH HARGREAVES ASSOCIATES, INC., DATED JANUARY 12, 2005; SAID AMENDMENT, IN THE AMOUNT OF $1,322,373, FOR THE REMAINING PROFESSIONAL SERVICES, INCLUDING DESIGN DEVELOPMENT, CONSTRUCTION DOCUMENTS, BID AND AWARD, AND CONSTRUCTION ADMINISTRATION FOR THE SOUTH POINTE PARK IMPROVEMENTS PROJECT, AS CONTEMPLATED AND PROVIDED BY RFQ NO. 39- 03/04. WHEREAS, in 1996, the City adopted a Parks Bond Master Plan that included major improvements to South Pointe Park (the Park); and WHEREAS, in 1997, the Mayor and City Commission approved a Resolution authorizing the City to enter into an agreement with Bermello and Ajamil (B&A) for the design of improvements to the Park (the B&A Agreement); and WHEREAS, a minimal degree of planning of the Park improvements was completed by 2002, and B&A and the City mutually agreed to terminate the B&A Agreement; and WHEREAS, the City Commission authorized the issuance of (a new) RFQ No. 16- 02/03 for architecture and engineering services for the design of Park improvements; and WHEREAS, at approximately the same time, the City's options for settling the long standing land use litigation related to the Alaska Parcel expanded to include the possible addition of approximately two acres to the Park; and WHEREAS, due to the negotiations on the Settlement of the Alaska Parcel and modifications to the project scope, RFQ No. 16-02/03 was cancelled by the City Commission on February 25, 2004; and WHEREAS, on July 28,2004, the City reached a settlement on the long standing Alaska Parcel land use litigation and as part of the settlement agreement, the developer, the Related Group (TRG), is obligated to perform the improvements to the Park, at cost, without overhead, if the City notifies TRG of its concept plan by July 28, 2005; and WHEREAS, if the notification timeline was not met, the City would need to bid and build the Park according to its standard procedures; and WHEREAS, construction by TRG at its cost represents a projected substantial cost and time savings to the City; and WHEREAS, on September 8,2004, the City Commission authorized the issuance of RFQ No. 39-03/04 for the South Pointe Park Improvements (the Project), which included a revised scope of services that addressed the land being added as part of the Alaska Parcel Settlement Agreement and related issues; and WHEREAS, on January 12, 2005, the City Commission authorized the execution of a professional services agreement with Hargreaves Associates, Inc. (Hargreaves), as the successful proposer pursuant to RFQ No 39-03/04; however, the agreement was initially limited to the planning phase of the Project; and WHEREAS, the Notice to Proceed was issued to Hargreaves on January 18, 2005, and the Project planning process has followed the standard park improvement project sequence, from project kickoff meeting to Community Design Workshops (COW); and WHEREAS, on July 27, 2005, the Basis of Design Report (BOOR) for the Park was presented to the City Commission for approval; and WHEREAS, the Mayor and City Commission approved Resolution No. 2005-25978, which approved the BOOR as presented; approved the exercise of the option in the Alaska Parcel Settlement Agreement to have TRG complete the design and construction of the Project, at cost, as stated in the Alaska Parcel Settlement Agreement; and approved the appropriation of $14,130,000 from Miami Beach Redevelopment Agency funds to completely fund the Project, $5,000,000 of which would be refunded when Miami-Dade County General Obligation Bond Funds become available; and WHEREAS, by approving the BOOR and the appropriation, the Administration will be able to proceed with the design development, construction documents, bidding and award, and construction administration phases of the Project; and WHEREAS, on July 27, 2005, the Administration presented to the Mayor and City Commission the Administration's intent to enter into negotiations with Hargreaves for the remaining services including design development, construction documents, bid and award, and construction administration phases of the Project; all as contemplated by.and as provided in RFQ No. 39-03/04 and; WHEREAS, accordingly, as Hargreaves' Agreement was initially limited to the planning phase, the City and the Consultant have negotiated Amendment No.1 to the Agreement, for the aforestated remaining professional services required for the completion of the Project; and WHEREAS, the Administration recommends approval of Amendment No.1, in the amount of $1 ,322,373. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve and authorize the Mayor and City Clerk to execute Amendment No.1 to the Agreement with Hargreaves Associates, Inc., dated January 12, 2005; said Amendment, in the amount of $1,322,373, for the remaining professional services, including design development, construction documents, bid and award, and construction administration for the South Pointe Park Improvements Project, as contemplated in and provided by RFQ No. 39-03/04. Issue: Shall the City Commission adopt the Resolution awarding additional services to Hargreaves Associates, Inc. for the South Pointe Park 1m rovement Pro'ect? Item Summary/Recommendation: In 1996, the City adopted a Parks Bond Master Plan that included improvements to South Pointe Park. In 1997, the City entered into an Agreement with Bermello and Ajamil (B&A) for the design improvements to South Pointe Park (the Project). In 2002, B&A and the City mutually agreed to remove this scope of work from the agreement with B&A. On January 12, 2005, the City Commission authorized the execution of an Agreement between the City and Hargreaves Associates Inc. (Hargreaves). Hargreaves' Scope of Services was limited to the Planning Phase of the project. On July 27, 2005, the Basis of Design Report (BOOR) was presented to the City Commission for approval. The proposed improvements include: redesigned park entrance, pavilion building with a small concession area, restroom facility, pedestrian walkways, playground, dog integrated park area without a fenced enclosure, extensive landscaping, irrigation, and site lighting. The Mayor and City Commission approved the Basis of Design Report (BOOR) as presented, approved the exercise of the option in the Alaska Parcel Settlement Agreement to have the developer complete the design and construction of the Project, at cost, and approved the appropriation of $14,130,000 from the Redevelopment Agency to completely fund the Project, $5,000,000 of which would be refunded when Miami-Dade County General Obligation Bond Funds become available (Resolution No. 2005-25978 and Resolution No. 512-2005). On July 27, 2005, the Administration further presented to the Mayor and City Commission the Administration's intent to enter into negotiations that would retain involvement by Hargreaves in the continuing development of the park design, and the City Commission was in favor of this approach. In approving the BOOR and the appropriation, the City could now proceed with the remaining phases of the project; however, since Hargreaves' Agreement was limited to the planning phase, the City and the Consultant negotiated additional professional services required for the completion of the Project (Detailed Design, Bidding and Award, and Construction Administration services) in the amount of $1,322,373. This amount represents a fee of eleven percent (11 %) of the construction costs of the Project which are currently estimated at $11 ,200,000 plus an additional allowance of $500,000 for Art in Public Places. If the additional Planning services of the original Agreement are included, the percentage will be thirteen percent (13%). Both percentages are within the industry standards for a project of this size and complexity and take into consideration the commissioning of a world class consultant such as Hargreaves. The City, The Related Group, and Hargreaves have agreed to continue participating in the design, permitting and construction of the park project as a team and to address issues and to establish the schedule with the contribution of all three parties. The Agreement with Hargreaves takes into consideration the un-traditional approach to the construction of the project due to Related's involvement. IN THE AMOUNT OF $1,322,373.00 FOR ADDITIONAL PROFESSIONAL SERVICES FOR THE SOUTH POINTE PARK IMPROVEMENTS PROJECT. Subject: ADMINISTRATION RECOMMENDATION Adopt the Resolution. FUNDING Although originally funded in part by City General Obligation Bond funds, the South Pointe Park Improvements project is currently budgeted to be funded from South Pointe RDA Tax Increment Financing (TIF) Funds and Miami-Dade County General Obligation Bond Funds when made available. ANAL YSIS On June 19, 1996, the City adopted a Parks Bond Master Plan that included major improvements to South Pointe Park. On July 16, 1997, the Mayor and City Commission approved a Resolution authorizing the City to enter into an Agreement with Bermello and Ajamil (B&A) for the design of improvements to South Pointe Park. Because a minimal degree of planning of the park improvements was completed by 2002, B&A and the City agreed to remove this scope of work from the agreement with B&A and the City Commission authorized the issuance of a new Request for Qualifications (RFQ) for architecture and engineering services for the design of the park improvements. Responses to the RFQ were received in 2003, and an Evaluation Committee was appointed to short-list the top ranked firms. At approximately the same time, the City's options for settling the long standing land use litigation related to the Alaska Parcel expanded to include the addition of approximately two acres of land to the South Pointe Park. Exercising this option, the City substantially affected the scope of services for the project outlined in the RFQ. Therefore, the RFQ for architect and engineering services for the park was terminated by the City Commission on February 25, 2004. On September 8, 2004, the City Commission authorized the issuance of RFQ No. 39-03/04 which included a revised scope of architect and engineering services for the park improvements. Six responses were received. An Evaluation Committee was appointed by the City Manager to short-list the top ranked firms. Hargreaves Associates, Inc. As part of bidding and award services, Hargreaves will provide assistance to the developer, as applicable, in the pricing and bidding of the project, will review the contractor's cost proposal, and will assist the City in the award of the construction contract. As part of construction administration services, Hargreaves will attend and participate in the project's City Commission Memorandum October 19, 2005 Hargreaves Amendment NO.1 Page 3 of 3 pre-construction meeting, attend and participate in regular progress meetings, prepare field observations, respond to RFls (Request for Information) and CDCs (Contract Document Clarification), review shop drawings, review requests for changes to construction cost and/or schedule, and provide Project Closeout services. The Administration also intends to enter into an Agreement with the Related Group (Related) for the construction of the project as part of the Settlement Agreement on the Alaska Parcel. The intent is for Related to construct the park in conjunction with the construction of their Apogee Project. The City, Related, and Hargreaves have agreed to continue participating in the design, permitting and construction of the park project as a team and to address issues and to establish the schedule with the contribution of all three parties. The Agreement with Hargreaves takes into consideration the un-traditional approach to the construction of the project due to Related's involvement. ADMINISTRATION RECOMMENDATION The Administration recommends that the Mayor and City Commission adopt the Resolution approving and authorizing the Mayor and City Clerk to execute Amendment No.1 to the Agreement with Hargreaves Associates, in the amount of $1,322,373, for additional professional services for the South Pointe Park Improvements project.
