THEN PERSONALLY APPEARED BEFORE ME, an officer duly authorized to administer oaths and
accept acknowledgments within the State of Florida, Neisen Kasdin, as Mayor of th~ City of Miami Beach,
Florida, and Robert Pa'rcher, as City Clerk of the City of Miami Beach, Florida, who, well known to me and
being duly sworn by me, did depose and state:
That The City of Miami Beach, Florida (the "Grantor") is the fee owner of the real property described
as Lot 13, Block 21 of Alton Beach Realty Company's Amended Golf Course Plat, according to the Plat
thereof filed in Plat Book 6 at Page 26 of the Public Records of Miami-Dade County, Florida.
That the above described property is free and clear of all liens, taxes, encumbrances and claims of every
kind, nature and description whatsoever, except for real estate and personal property taxes for the year
2000.
That there has been no labor performed or materials furnished on or about the premises hereinabove
described for the past ninety (90) days for which payment(s) has/have not, as yet, been made and that
there are no mechanics', materialmen's or laborers' liens against the hereinabove described property.
4. That there are no violations of municipal ordinances pertaining to the above described property.
That there are no leases in effect with respect to the subject property and the Grantor is in exclusive
possession thereof.
That no judgment or decree has been entered in any court of this state or the United States against the
Grantor which remains unsatisfied.
That at the time of execution of this Affidavit, there are no matters pending against the Grantor that could
give rise to a lien that would attach to the subject property between the date hereof and the recording of
the Deed conveying the property to Gary Davenport as Trustee and further that the Grantor has not, and
covenants not to execute any instrument that would adversely affect title to the subject property.
That this Affidavit is made for the purpose of inducing Gary Davenport as Trustee to purchase the
property and ATTORNEYS TITLE INSURANCE FUND, INC. to issue its policy at closing without
general exceptions 1 and 4. Affiants are familiar with the nature of an oath and with the penalties for
perjury under the laws of the State of Florida.
FURTHER AFFIANTS SAYETH NOT.
