98-22643 RESO RESOLUTION No. 98-22643 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING THE SECOND AMENDMENT TO THE POLICE CONFISCATION TRUST FUND FOR FISCAL YEAR 1997/98, IN THE AMOUNT OF $189,261, TO BE FUNDED FROM THE PROCEEDS OF STATE CONFISCATED FUNDS FOR: THE CONSTRUCTION OF A "MEMORIAL" IN THE COURT YARD OF THE POLICE FACILITY; FOR TRAINING/TRAVEL FOR THE MBPD SWORN AND CIVILIAN PERSONNEL; FOR PHASE III OF THE AUTOMATION PROGRAM; REIMBURSEMENT TO THE GENERAL FUND OVERTIME; AND MATCHING FUNDS FOR A GRANT UNDER THE FLORIDA DEPARTMENT OF TRANSPORTATION. (Second Amendment FY 97/98) WHEREAS, Section 932.705, Florida Statutes, addresses the purposes and procedures to be utilized for the appropriation and expenditures of the Police Confiscation Trust Fund; and WHEREAS, the Chief of Police of the City of Miami Beach has determined that the need for appropriation and expenditures exists and the appropriation and expenditure of forfeiture funds is in compliance with Section 932.705, Florida Statutes, and with Federal guidelines; and WHEREAS, such funds are available in the Police Confiscation Trust Fund. NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby adopt the Second Amendment to the 97/98 Police Confiscation Trust Fund Budget for the City of Miami Beach, in the amount of $189,261, as reflected in the attached Exhibit "A". (Second Amendment FY 97 / 9 8 ) ADMINISTRATION RECOMMENDATION Adopt the Resolution. BACKGROUND The Chief of Police of the City of Miami Beach has determined that the need for the appropriation and expenditures is in compliance with Section 932.705, Florida State Statutes. ANALYSIS The Administration requests authorization to adopt a Second Amendment to the operating budget for the FY 97/98 Police Confiscation Trust Fund in the amount of $189,261 from State funds to provide for the expenditures listed in Exhibit "A". In accordance with Florida State Statute 932.705, forfeiture funds have been deposited in the Police Confiscation Trust Fund and the City has complied with all statutory procedures involved in the transaction of these funds. CONCLUSION The attached Resolution provides for a Second Amendment to the FY 97/98 Police Confiscation Trust Fund in the amount of $189,261 to be used for the expenditures listed in Exhibit "A".
