RESOLUTION NO. 2005-26053
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND
AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE
AMENDMENT No. 4 TO THE CURRENT PROFESSIONAL
SERVICES AGREEMENT BETWEEN THE CITY AND THE FIRM
OF MCHARRY AND ASSOCIATES, INC., DATED JULY 12, 2000,
IN THE AMOUNT OF $33,348, FOR THE PROVISION OF
ADDITIONAL CONSTRUCTION ADMINISTRATION SERVICES,
FOR THE CONSTRUCTION COMPLETION OF A NEW FIRE
STATION No.4.; AND APPROPRIATING $33,348 FROM THE
GENERAL FUND OPERATING CONTINGENCY.
WHEREAS, on March 1,2002, pursuant to an extensive planning and programming period,
City staff reached a consensus to approve the sixth option presented by the City's consultant, MC
Harry and Associates Inc;, (Consultant) to improve Fire Station No. 4 (the Project); and
WHEREAS, on February 5, 2003, the Mayor and City Commission approved an Amendment
to the Agreement with the Consultant, and increased funds to cover the additional architectural and
engineering design fee for the Project; and
WHEREAS, the project construction period has been extended due to some unforeseen
circumstances as well as hurricane delays and additional scope modifications; and
WHEREAS, construction is currently estimated to be at 600/0 completion, with a projected
Substantial Completion by April 2006; and
WHEREAS, the funds appropriated from General Fund Operating Contingency will be
replaced from Miami-Dade County General Obligation Bond funds when they become available; and
WHEREAS, the extended construction period will require the Consultant to provide
necessary additional construction management services from the original Substantial Completion
date of November 2005 to the new date of April 2006.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission adopt a
Resolution to approve and authorize the Mayor and City Clerk to execute Amendment No.4 to the
current Professional Services Agreement between the City and the firm of MC Harry and Associates,
Inc., dated July 12, 2000, in the amount of $33,348, for the provision of additional construction
administration services, for the construction completion of a new Fire Station No.4.; and
appropriating $33,348 from the General Fund Operating Contingency..

Condensed Title:

amendment to the current professional services agreement with MC Harry Associates, Inc. in the amount of
$33,348 for the provision of additional construction administration services during the construction of Fire Station

Issue:
Should the Mayor and City Commission adopt the aforementioned Resolution to approve additional construction
administration fees for MC Har Associates, Inc. as a result of the ro'ect's extended schedule?
Item Summa /Recommendation:
Following the issuance of a Request for Qualifications (RFQ) in January 2000, and a top ranking from an Evaluation
Committee, the firm of MC Harry Associates, Inc. was previously awarded a contract and subsequent amendments
to provide the design and specifications, as well as construction administration services, for the construction of Fire
Station No.4.
The construction is currently estimated to be at sixty percent (60%) completion and - although site conditions and
recent weather events have impacted the project schedule - is projected to achieve Substantial Completion by April
2006. Consequently, the extended construction schedule will require MC Harry, Inc. to provide additional needed
construction administration services for the balance of the construction period. Construction Administration Services
shall be provided in accordance with the Articles described in the Professional Services Agreement to RFQ No. 41-
99/00 that was executed on July 6, 2000 by the City of Miami Beach and MC Harry & Associates, Inc. and shall
include all appropriate reviews, responses and recommendations on such things as Requests for Information
(RFI's), Requests for Change Order (RCO's), Execution of Change Orders, Certification of Payment Applications,
Quality Control Evaluations, Review of As- Built Drawings, Assistance with Project Close-out, Certificates of
Completion, etc.
After negotiations with the consultant, CIP, assisted by program manager URS Corporation, determined that the
negotiated amount of $33,348 was fair and reasonable for the amount of additional construction administration work
required from the consultant. The Administration concurs, and therefore recommends approval of the attached
Resolution by the Mayor and City Commission. Appropriation to be funded from General Fund Operating
Contin enc to be re laced from Miami-Dade Coun General Obli ation Bond funds when the become available.

ANAL YSIS
Following the issuance of a Request for Qualifications (RFQ) in January 2000, and a top
ranking from an Evaluation Committee, the firm of MC Harry Associates, Inc. was
previously awarded a contract and subsequent amendments to provide the design and
specifications, as well as construction administration services, for the construction of a
new Fire Station NO.4.
The Notice to Proceed for the construction of the Fire Station was issued on November 15,
2004, and the contractor proceeded to begin site and foundation work activities. To date,
all structural construction has been completed and interior mechanical, electrical and
plumbing installations are in progress.
The construction is currently estimated to be at sixty percent (60%) completion and
although site conditions and recent weather events have impacted the project schedule
the project is expected to achieve Substantial Completion by April 2006. The original
Substantial Completion date was November 10, 2005 (Exhibit 1) and consequently, the
extended construction schedule will require MC Harry Associates, Inc. to provide an
additional twenty one (21) weeks of construction management services for a fee of
$33,348 - said amount having already been negotiated by City staff with the assistance of
URS, the City's Program Manager (Exhibit 2).

The lump sum fee covers a total of 402.50 hours of construction administration support
from the Architect (Senior Inspector), the Project Manager, Principal, and mechanical,
electrical, plumbing, structural and civil sub-consultants (Exhibit 3).
Construction Administration Services shall be provided in accordance with the Articles
described in the Professional Services Agreement to RFQ No.41-99/00 that was executed
on July 6, 2000 by the City of Miami Beach and M CHarry & Associates, Inc. and shall
include all appropriate reviews, responses and recommendations on such things as
Request for Information (RFI's), Requests for Change Order (RCO's), Execution of
Change Orders, Certification of Payment Applications, Quality Control Evaluations,
Review of As- Built Drawings, Assistance with Project Close-out, Certificates of
Completion, etc.
CONCLUSION
Based on the aforementioned, the Administration recommends appropriating $33,348
from the General Fund Operating Contingency to be replaced from Miami-Dade County
General Obligation Bond funds when they become available.
