HomeMy WebLinkAbout2005-26054 Reso RESOLUTION NO. 2005-26054 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AMENDMENT NO. 2 TO THE AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND URS CORPORATION - SOUTHERN, DATED JUNE 27,2001, TO PROVIDE ADDITIONAL PROGRAM MANAGEMENT SERVICES FOR THE REMAINING CONSTRUCTION OF NORMANDY ISLE PARK & POOL FACILITY PROJECT AND DURING THE DESIGN AND CONSTRUCTION PHASES OF THE NORMANDY SHORES GOLF COURSE AND CLUBHOUSE PROJECT, IN THE AMOUNT OF $250,000, TO BE FUNDED BY THE PAY-AS-YOU-GO CAPITAL FUND AND FROM GENERAL FUND CIP SALARY SAVINGS. WHEREAS, on June 27, 2001, the Mayor and City Commission approved Resolution No. 2001-24499, authorizing the City to enter into an agreement with URS Corporation-Southern ("URS") for Program Management Services to manage construction projects for City facilities and parks ("Program"), pursuant to the Request for Qualifications No. 111-99/00 (the Agreement); and WHEREAS, under the Agreement, URS assists City staff in the planning, programming, design review, construction administration, scheduling, budgeting and consultant coordination for the projects included in the Agreement; and WHEREAS, URS has been providing satisfactory professional services and assisting City staff in the planning, programming, design review, construction administration, scheduling, budgeting and consultant coordination for the Normandy Isle Park & Pool Project (the Project); and WHEREAS, the construction of the Project has seen numerous delays that concluded with the default of the general contractor, Regosa Engineering Inc., and subsequent settlement with the surety, The St. Paul Fire Insurance; and WHEREAS, the Project is currently at 600/0 completion and not projected to achieve Substantial Completion until June 2006, and the extended construction schedule will require additional program management and construction administration services; and WHEREAS, the Normandy Shores Golf Course is presently in the 900,10 design stage and will require project and design management, including the review and coordination of contracts; overseeing the preparation of construction contract documents; permitting and coordination of all proposed/required improvements; inspection and warranty administration; management of project budget and schedules, including invoice review and recommendations; and processing of payment applications, change order requests and other submittals; and WHEREAS, after negotiations with the Consultant, CIP determined that the negotiated amount of $250,000 for a period of twelve (12) months is fair and reasonable for the level of effort required from the Consultant; and WHEREAS, this fee is based on actual effort, paid on an hourly basis, and the hourly rates utilized in the calculation of effort are those currently in effect. NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIA~I BEACH, FLORIDA, that the Mayor and City Commission authorize the City to execute Amendment No.2 to the existing Agreement between URS Corporation-Southern and the City to provide additional program management services for the remaining construction of the Normandy Isle Park & Pool Facility Project, and during the design and construction phases of the Normandy Shores Golf Course and Clubhouse Project, in the amount of $250,000, and further appropriate $125,000 from the Pay-As-You-Go Capital Fund to supplement the General Fund CIP Salary Savings. Item Summa IRecommendation: Following the issuance of a Request for Qualifications (RFQ) 111-99/00, and a top ranking from an Evaluation Committee, the firm of URS Corporation was awarded a contract to provide the Program Management Services that included assisting City staff in the planning, programming, design review, construction administration, and scheduling, budgeting and consultant coordination for the projects that included The Normandy Isle Park & Pool. The construction of Normandy Isle Park & Pool has seen numerous delays that concluded with the default of the general contractor Regosa Engineering Inc. and subsequent settlement with the Surety, St. Paul Travelers. The Project is currently at 60% completion and not projected to achieve Substantial Completion until June 2006. Up to this point, URS has provided critical program management, construction management and quality control support. However, with an agreement that expires on 12/31/05, Amendment 2 will be needed to provide additional support services through the extended construction schedule of this difficult project. As a result of recent recruiting difficulties experienced by CIP, additional staffing requirements have been identified. Therefore, the Administration is recommending the approval of additional funding that will allow the continuing participation by URS in providing critical program management services to CIP while recruiting efforts continue. For example, the Normandy Shores Golf Course is presently in the design stage, at approximately ninety percent (90%) completion. It is anticipated that the re-construction of the Golf Course will commence in the third quarter of 2006. The Normandy Shores Clubhouse is presently in the procurement process for a design-build construction contract. It is anticipated that the design and construction of the Clubhouse will commence in the third quarter of 2006. The Administration recommends that the Mayor and City Commission authorize the City to execute Amendment NO.2 to the existing Agreement between URS Corporation-Southern and the City of Miami Beach to provide additional program management services, in the amount of $250,000, for the remaining construction of Normandy Isle Park & Pool facility, and during the design and construction phases of other projects, as needed, such as the Normandy Shores Golf Course and Clubhouse. ANAL YSIS Normandv Isle Park & Pool Facility On June 27, 2001, the Mayor and City Commission approved Resolution No. 2001- 24499, authorizing the City to enter into an agreement with URS Corporation-Southern ("URS") for Program Management Services to manage construction projects for Facilities and Parks, pursuant to the guidelines established in the Request of Qualifications No. 111-99/00. Under the agreement, URS assists City staff in the planning, programming, design review, construction administration, and scheduling, budgeting and consultant coordination for the projects covered by the agreement. One of the projects for which URS has been providing satisfactory professional services and assisting City staff in the planning, programming, design review, construction administration, and scheduling, budgeting and consultant coordination is the Normandy Isle Park & Pool facility. Since the commencement of construction, several delays related to coordination, unforeseen conditions, and deletions arose. Although the Administration tried to work with the contractor, Regosa Engineering, Inc., they were defaulted and a settlement agreement was secured with the Surety, St. Paul Travelers. City Commission Memorandum December 7,2005 URS Contract Amendment 2 Page 2 of 3 Subsequently, a Notice to Proceed was issued to a Job Order Contracting (JOC) contractor, PASS International, Inc., to resume construction and, in some cases, redo some of the defective work previously completed by Regosa. The contractor has started to work around the pool deck and pump house, and completing the rough installation of the water and drainage systems. Framing of the structural beams around the multi-purpose building is well underway, awaiting inspection before concrete is poured. For the Park portion of the Project, contractors have been working on the removal of existing basketball courts and miscellaneous structures and the site grading. Additional JOC work orders have been issued to construct the irrigation and drainage systems, underground electrical conduits, the multi-purpose courts, sidewalks, west parking lot, landscaping and perimeter fencing. During this process, URS has provided program management assistance to the CIP Office, including the review and coordination of contracts; overseeing the preparation of updated construction contract documents; permitting and coordination of all proposedlrequired improvements; inspection and warranty administration by the City's consultant and contractors; management of project budgets and schedules, including invoice review and recommendations; and processing of payment applications, change order requests and other submittals. Currently, the project is at sixty percent (600/0) completion with Substantial Completion status projected for June 2006. Up to this point, URS has provided critical program management, construction management and quality control support. However, with an agreement that expires on 12/31/05, Amendment 2 will be needed to provide additional support services through the extended construction schedule of this difficult project. Additional Proiect Manaaement Support Presently, the Capital Improvement Projects (CIP) office has experienced recruiting difficulties in filling vacant budgeted project management positions, as a result of a very competitive market for qualified architects, engineers, and construction management professionals. During the past four months, the CIP office has extended offers to several highly qualified candidates who were identified through a competitive recruitment process. Unfortunately, given the present salary structure, the recruiting effort did not yield desired results. Therefore, the Administration will fund a portion of the costs for the additional URS staffing from General Fund CIP salary savings. A number of projects, such as the Normandy Shores Golf Course and Normandy Shores Clubhouse are presently in the final stages of design, and will require additional project management, including the review and coordination of contracts; permitting; inspection and warranty administration; management of project budgets and schedules, including invoice review and recommendations; and processing of payment applications, change order requests and other submittals. Therefore, the Administration is recommending the approval of additional funding that will allow the continuing participation by URS in providing critical program management services to CIP while recruiting efforts continue. It is anticipated that the re- construction of the Golf Course will commence in the third quarter of 2006. The Normandy Shores Clubhouse is presently in the procurement process for a design- build construction contract. It is anticipated that the design and construction of the Clubhouse will commence in the third quarter of 2006. URS will assist the City with project and design management, overseeing the preparation of construction contract documents; permitting and coordination of all proposed/required improvements; inspection and warranty administration by the City's consultant and contractors; management of project budgets and schedules, including invoice review and recommendations; and processing of payment applications, change order requests and other submittals. Services in the amount of $75,000 will be applied toward the Normandy Isle Park and Pool project and the balance in the amount of $175,000 will be applied to other projects, including the Normandy Shores Golf Course. The extended construction periods, as well as other necessary services, will require URS to provide program management assistance for periods of 120 days for the Normandy Park - Park Portion and 240 days for the Normandy Park - Pool Portion, and for other projects to be determined based on need, such as the Normandy Shores Golf Course and Clubhouse. CONCLUSION: The Administration recommends that the Mayor and City Commission authorize the City to execute Amendment No. 2 to the existing Agreement between URS Corporation-Southern and the City of Miami Beach to provide additional program management services, in the amount of $250,000 (see Exhibit No.1), for the remaining construction of Normandy Isle Park & Pool facility, and during the design and construction phases of other projects, as needed, such as the Normandy Shores Golf Course and Clubhouse. Additionally, the Administration recommends the appropriation of $125,000 from the Pay-As-You-Go Capital Fund to supplement General Fund CIP Salary Savings.
