HomeMy WebLinkAbout2005-26061 Reso RESOLUTION NO. 2005-26061 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPPROVING, IN SUBSTANTIAL FORM, A COOPERATIVE PURCHASE AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND THE STATE OF FLORIDA COUNTER-DRUG PROCUREMENT PROGRAM OFFICE TO PURCHASE QUALIFYING LAW ENFORCEMENT EQUIPMENT PURSUANT TO NATIONAL DEFENSE AUTHORIZATION ACT SECTION 1122 (TITLE 10 USC 381); AND FURTHER AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE THE AGREEMENT IN FINAL FORM, SUBJECT TO REVIEW BY THE ADMINISTRATION AND CITY ATTORNEY'S OFFICE. WHEREAS, the State of Florida Counter-Drug Procurement Program office is designated as the State point of contact for the State and Local Law Enforcement Equipment Procurement Program, a State of Florida program established and maintained pursuant to National Defense Authorization Act. Section 1122 (Title 10 USC 381) (also known as "the 1122 Program"); and WHEREAS, the State of Florida Counter-Drug Procurement Program permits state and law enforcement agencies to purchase through federal procurement channels law enforcement equipment suitable for use in the performance of counter-drug activities; and WHEREAS, the Program will permit local law enforcement agencies to take advantage of the purchasing power of the federal government to receive discounts commensurate with large volume purchases; and WHEREAS, a Cooperative Purchase Agreement is necessary so that the City of Miami Beach may order qualifying law enforcement equipment under the 1122 Program, through the Florida Counter-Drug Procurement Program; NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve, in substantial form, the attached Cooperative Purchase Agreement between the City and the State of Florida Counter-Drug Procurement Program to purchase qualifying law enforcement equipment pursuant to National Defense Authorization Act Section 1122 (Title 10 USC 381 ); and further authorizing the Mayor and City Clerk to execute the Agreement in final form, subject to review by the Administration and City Attorney's Office. Item Summary/Recommendation: The National Defense Authorization Act, Section 1122 (Title 10 USC 381 ), also known as the "1122 Program", allows state and local law enforcement agencies to purchase law enforcement equipment suitable for use in the performance of counter-drug activities and receive the same U.S. Government pricing from its approved vendors. The 1122 Program for the State of Florida is administered and coordinated by the Florida Counter-Drug Procurement Program office located in the Orange County Sheriff's Office, Orange County, Florida, as designated by the Governor of the State of Florida. The Miami Beach Police Department, as a qualifying law enforcement agency, would receive the same significant discount pricing the federal government receives from its vendors. All law enforcement equipment purchased through the 1122 Program which is managed by the FLCDPP office. The Administration recommends adopting the Resolution. ADMINISTRATION RECOMMENDATION Adopt the Resolution. ANALYSIS Among key positive results reflected in the 2005 City of Miami Beach community survey are safety and City services provided by Police with 78% of residents and 90% of businesses rating the overall services of Police as good or excellent. The survey also reflected some key areas for improvement in Public Safety with 26% for reducing homelessness; 25% increasing visibility of police in neighborhoods; and 23% for preventing crime. The proposed Purchase Agreement between the City of Miami Beach and the Florida Counter-Drug Procurement Program office will present an opportunity for the City of Miami Beach to select from a wide array of modem and up-to-date law enforcement equipment, vehicles and supplies for purchase at the same reduced rates the Federal government receives. In utilizing program approved vendors and law enforcement products supplied by the Florida Counter-Drug Procurement Program office as an option for purchases, the City will be aided in increasing its public safety initiatives and improving an already positive outcome. The National Defense Authorization ACt Section 1122 (Title 10 USC 381), also known as the "1122 Program", allows state and local law enforcement agencies to purchase law enforcement equipment suitable for use in the performance of counter-drug activities December 7, 2005 Page 2 and receive the same pdcing discounts available to the Federal government. The Flodda point of contact for the 1122 Program, designated by the Governor of the State of Florida, is Kevin Beary, Orange County Sheriff, Orange County, Florida. Kevin Beary is also the State Coordinator of the "State and Local Law Enforcement Equipment Procurement Program". The Florida Counter-Drug Procurement Program office (FLCDPP) was further established pursuant to the 1122 Program, as a public-private partnership and designated "State Point of Contact" for the 1122 Program administration. The City of Miami Beach Police Department is a qualifying law enforcement agency under the 1122 Program. Specifications for equipment purchases are submitted to the Flodda Counter-Drug Procurement Program. The FLCDPP reviews the submitted specifications and researches the U.S. Government's approved vendors for a match. For further details about this special purchasing program process, please review Attachment A. Miami-Dade, Broward, Monroe, Palm Beach and Collier County Sheriff's offices, and the Cities of Miami, Coral Gables, Fort Lauderdale, North Miami, Pinecrest, Hallandale Beach,' Pembroke Pines and West Palm Beach Police Departments are all participants in the 1122 Program. The Florida Department of Law Enforcement (FDLE) and Flodda Fish and Wildlife agencies, as well as many other local law enforcement agencies across Flodda, currently participate in the 1122 Program. Attached please find a copy of the Cooperative Purchase Agreement for the purchase of law enforcement equipment under the 1122 Program, between the City of Miami Beach and the State of Florida Counter-Drug Procurement Plan office. CONCLUSION The Administration recommends that the Mayor and City Commission of the City of Miami Beach, Florida, adopt the resolution to approve, in substantial form, a Cooperative Purchase Agreement between the City of Miami Beach and the State of Florida Counter- Drug Procurement Program ofr~,e to purchase qualifying law enforcement equipment pursuant to National Defense Authorization Act, Section 1122 (Title 10 USC 381), and further authorizing the Mayor and City Clerk to execute the Agreement in final form, subject to review by the Administration and City Attorney's Office. Memo.doc ATTACHMENT A State of Florida Counter Drug Procurement Program Sheriff Kevin Beary Governor Jeb Bush Law Enforcement Procurement Program The National Defense Authorization Act of 1994 established the Law Enforcement Procurement Program. It allows state and local law enforcement agencies (LEAs) to purchase law enforcement equipment for use in counter-drug, anti-drug, and drug interdiction campaigns from the Federal Government at substantial savings. In Florida, LEAs must make purchases through the Counter-Drug Procurement Program. This program is not a replacement for the Excess Property Program, but a powerful additional tool to enable LEAs to wage war on drugs in their communities. Through this procurement program, LEAs are able to leverage their buying power to take advantage of the U.S. Government's massive contract vendor system. This program gives LEAs the ability to purchase exactly what their agency needs. Here is a partial list of what can be purchased through the program: · Communications equipment · Electronics and surveillance equipment, to include night vision goggles · Cameras, film, binoculars and accessories · Body armor, restraining equipment, personal law enforcement equipment and vehicles · Drag testing equipment and kits The vendors are leaders in their fields: RBR Armor Motorola Safariland Peerless Handcuffs ITT American Body Armor Ford Litton Program Procedures: )~ LEAs tell us what their requirements are and supply us with the National Stock Number (NSN), manufacturer, item type/number, specifications. We go through our sources to find who has the item and at what cost savings. We fax a Pro Forma Invoice with the price quote to the LEA. The LEA sends us a Purchase Order to secure funds for the cost of the equipment. We place the order. Shipments are made directly to the LEA to avoid shipping delays. Upon receipt of the equipment, the LEA forwards a check to FLCDPP. The money is deposited into a dedicated FLCDPP account. FLCDPP pays the vendor invoice when the LEA acknowledges receipt of the equipment. This is a no-risk program for the LEAs. They decide if the government's negotiated prices are better than their vendors. Even if the prices only match - our quotes can be used for additional negotiating power. The Florida Counter-Drug Procurement Program is a program with allows state and local governments to purchase law enforcement equipment through certain Federal procurement channels, provided that the equipment is used in the performance of counter-drug activities. The program affords state and local governments the opportunity to maximize their use of taxpayer dollars by taking advantage of the purchasing power of the Federal Government to receive discounts commensurate with large volume purchases. What is the authority for the Procurement Program? Section1122 of the fiscal year 1994 National Defense Authorization act established the authority for this procurement program. Thus, the authority for the Florida Counter-Drug Procurement Program resides with the Department of Defense. Why is the Procurement Program referred to as the "1122 Program"? "1122" refers to the section of the fiscal year 1994 National Defense Authorization Act which established the program; thus the program is commonly referred to as the "1122 Program." What agencies are involved in the 1122 Program? The U.S. Army, the General Services Administration (GSA), the Defense Logistics Agency (DLA) and the Department of Justice (DO J) are actively involved in the 1122 program. As the Executive Agent of the program, the U.S. Army has formed a steering committee consisting of representatives from GSA, DLA and DOJ to oversee the implementation of the program. What GSA products are available under the 1122 Program? Currently, state and local governments may purchase motor vehicles from GSA as well as items from the GSA Federal Supply Service (FSS) Schedules or Contracts listed in the Law Enforcement Equipment and Supplies Catalog. How may I obtain a copy of these Schedules? Under the provisions of the statute, GSA is responsible for the development of a catalog, which not only explains the 1122 Program, but also delineates those products that may be procured under the program. GSA is also responsible for providing state agencies with training on the use of the catalog, as well as in ordering procedures under the program. How does the 1122 Program work? Each state participating in the 1122 Program designated a State Point of Contact (SPOC) to administer the state's activities under the program, by validating the counter-drug mission of each procurement request and by ensuring the availability of funds. Are there any restrictions for state and local law enforcement agencies regarding the use of products available under the 1122 Program? The statute limits the use of the 1122 Program to items specifically used in the performance of counter-drug activities. Thus, the program cannot be used for routine law enforcement purposes. How many states are currently participating in the 1122 Program? Currently at least 45 states have elected to participate in the 1122 Program.
