98-22653 RESO RESOLUTION NO. 98-22653 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE PLACEMENT OF NINETY (90) BANNERS FOR CARNA V AL SOUTH BEACH TO BE HELD IN LUMMUS PARK FROM 5TH TO 15TH STREETS ON MARCH 1, 1998, AS REQUESTED BY THE APPLICANT, THE KIWANIS CLUB OF LITTLE HAVANA, AT THE FOLLOWING LOCATIONS: 1-395 MCARTHUR CAUSEWAY, STARTING AT MIAMI BEACH CITY LIMITS; 5TH STREET, FROM ALTON ROAD TO OCEAN DRIVE; WASHINGTON AVENUE, FROM 17TH STREET TO DADE BOULEV ARD; AlA COLLINS AVENUE, FROM 5TH STREET TO 41ST STREETS; 17TH STREET, FROM MERIDIAN TO W ASHINGTON AVENUES; HARDING A VENUE, FROM 71ST TO 87TH STREETS; AND 41ST STREET, FROM ALTON ROAD TO COLLINS A VENUE; FURTHER REQUIRING THAT THESE BANNERS MEET ALL CITY REQUIREMENTS AND BE INStALLED NO EARLIER THAN FEBRUARY 19, 1998, AND REMOVED BY MARCH 3, 1998. WHEREAS, Carnaval South Beach has been held successfully at Lummus Park in Miami Beach last year; and WHEREAS, in order to publicize this event, and the City's importance in the international tourist world, light pole banners measuring 2.4 feet x 6 feet have been requested to be placed at 1-395 McArthur Causeway, starting at Miami Beach City Limits; 5th Street, from Alton Road to Ocean Drive; Washington Avenue, from 17th Street to Dade Boulevard; AlA Collins Avenue, from 5th Street to 41st Streets; 17th Street, from Meridian to Washington Avenue; Harding Avenue, from 71st to 87th Streets; and 41st Street, from Alton Road to Collins Avenue; and WHEREAS, the said banners will be installed no earlier than February 19, 1998, and removed by March 3, 1998; and WHEREAS, the Applicant, The Kiwanis Club of Little Havana, on behalf of Carnaval South Beach has requested approval and authorization for the placement of a total of ninety (90) banners; and WHEREAS, the Applicant will post a performance bond to ensure the removal of the banners by March 3, 1998 and to ensure that any damage to light poles will be repaired at their expense; and WHEREAS, Section 9-3.CA of the City's Zoning Ordinance (Ordinance No.89-2665) requires that the Mayor and City Commission approve the installation of temporary banners; and WHEREAS, the City will receive positive publicity, nationally and internationally, as a result of the upcoming Carnaval South Beach. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein approves and authorizes the placement of ninety (90) banners for Carnaval Miami South Beach to be held in Lummus Park on March 1, 1998, as requested by the Applicant, The Kiwanis Club of Little Havana, at the following locations: 1-395 McArthur Causeway starting at Miami Beach City Limits; 5th Street, from Alton Road to Ocean Drive; Washington Avenue, from 17th Street to Dade Boulevard; AlA Collins Avenue, from 5th Street to 41st Streets; 17th Street, from Meridian to Washington Avenues; Harding Avenue, from 71st to 87th Streets; and 41st Street, from Alton Road to Collins Avenue; provided that said banners meet all City requirements and be installed no earlier than February 19, 1998, and removed no later than March 3, 1998. It will be a four color screen printed process. The text of the light pole banner is the name of the event which constitutes the overall image of the pole banner. The logo of General Motors is one square foot of the total area of the pole banner. The logo of the event itself is at the bottom an is % of one Square foot. ADMINISTRA TION RECOMMENDATION Approve the resolution. BACKGROUND Carnaval Miami South Beach is a festival to celebrate the advent of the spring season. The event brings people from throughout South Florida and is broadcast internationally to millions of viewers. It is a day celebrated with music, entertainment, floats, a parade, sports activities, specialty foods and fun for the whole family, including a large designated children's area. The event is sponsored by the General Motors Corporation and is now in its second year. The attached application was sent to Design Review and approved on January 26, 1998. ANALYSIS The purpose of these banners is to welcome and promote this event in South Florida, and specifically in Miami Beach. The presence of these banners will also do much to publicize the City's importance in the international tourist world, drawing attention of the media, and the public at large. Section 9-3.CA of the Zoning Ordinance requires that the AGENDA ITEM DATE L/C 2.-,+-q~ City Commission approve the installation of temporary banners. That section reads, in relevant part: Light Pole Banners affIxed to light poles or other similar structures on the public right-of- way shall be subject to the following regulations: a. The right to install, as well as the number, location and method of installation of banners shall be subject to the Design Review process and approved by the City Commission and the Public Works Department. e. Banners announcing special events, either to be held in Miami Beach or to be associated in some manner with Miami Beach, as determined by the City Commission, may be erected up to thirty days prior to the event being announced and must be removed within seven days after said event. f. A performance bond shall be required to ensure the removal of the banners in case of advanced deterioration of the banners, or if a dangerous condition presents itself, the City may at its sole discretion direct the banners to be removed at any time. If approval is granted, the proposed temporary banners are recommended to be installed no earlier than February 19, 1998 and removed by March 3, 1998.
