HomeMy WebLinkAboutAmendment 2 PSA w/ URS ;1J1P~-1-t,os-f c '/ j) - I ~~"'- AMENDMENT NO.2 TO THE PROFESSIONAL SERVICES AGREEMENT BETWEEN CITY OF MIAMI BEACH, FLORIDA AND URS CORPORATION - SOUTHERN, DATED, June 27, 2001, IN AN AMOUNT OF $250,000, TO PROVIDE ADDITIONAL PROGRAM MANAGEMENT SERVICES FOR THE REMAINING CONSTRUCTION OF NORMANDY ISLE PARK & POOL FACILITY AND ADDITIONAL PROJECT MANAGEMENT SUPPORT TO THE CAPITAL IMPROVEMENT PROJECTS (CIP) OFFICE This Amendment No.2, Dated as of December 7, 2005 to that certain Agreement, dated June 27, 2001, by and between the CITY OF MIAMI BEACH, FLORIDA (City), and URS CORPORATION - SOUTHERN ("URS") (Consultant). RECIT ALS WHEREAS, on June 27, 2001, the Mayor and City Commission approved Resolution No. 2001-24499, authorizing the City to enter into an agreement with URS Corporation-Southern (UURS") for Program Management Services to manage construction projects for City facilities and parks ("Program"), pursuant to Request for Qualifications No. 111-99/00 (the Agreement); and WHEREAS, under the Agreement, URS assists City staff in the planning, programming, design review, construction administration, scheduling, budgeting, and consultant coordination for the projects included in the Agreement; and WHEREAS, U RS has been providing satisfactory professional services and assisting City staff in the planning, programming, design review, construction administration, scheduling, budgeting and consultant coordination for the Normandy Isle Park & Pool Project (the Project); and WHEREAS, the construction of the Normandy Isle Park and Pool Project has experienced numerous delays that concluded with the default of the general contractor, Regosa Engineering Inc., and subsequent settlement with the surety, The St. Paul Fire Travelers; and WHEREAS, the Project is currently at 60% completion and not projected to achieve Substantial Completion until June 2006; and the extended construction schedule will require additional program management and construction administration services; and WHEREAS, the Capital Improvement Projects (CIP) office has experienced recruiting difficulties in filling vacant project management positions; and WHEREAS, a number of projects, such as the Normandy Shores Golf Course and Normandy Shores Clubhouse projects are presently in the final stages of design, and will require additional project management, including the review and coordination of contracts; permitting; inspection and warranty administration; management of project budgets and schedules, including invoice review and recommendations; and processing of payment applications, change order requests and other submittals; and ~X#18Ir A Normandy Isle Park & Pool Work Wk Hrs per Total Rate Fee (4 Month Extension) Wk Hrs Senior Project Manager 16 40 640 $ 109.79 $ 70,265.60 Program Manager 16 1 16 $ 162.30 $ 2,596.80 Reimbursables Total (M] Cellular Telephone 4 $ 90.00 $ 360.00 Vehilcle 4 $ 207.00 $ 828.00 Reproduction Cost 4 $ 250.00 $ 1,000.00 $ - Sub-Total $ 75,050.40 Other Projects Work Wk Hrs per Total Rate Fee (8 Month Extension) Wk Hrs Senior Project Manager 36 40 1440 $ 109.79 $ 158,097.60 Program Manager 36 1 36 $ 162.30 $ 5,842.80 Document Control Clerk 52 4 208 $ 23.19 $ 4,823.52 Reimbursables Total (M) Cellular Telephone 8 $ 90.00 $ 720.00 Vehilcle 8 $ 207.00 $ 1,656.00 Reproduction Cost 8 $ 250.00 $ 2,000.00 Computer & Software 1 $ 2,000.00 Sub-Total $ 175,139.92 Total Fee $ 250,190.32 Rounded Downward $250,000 11-28-05 Normandy Isle Park _Extended PM Services.xls WHEREAS, after negotiations with the Consultant, CIP has determined that the negotiated amount of $250,000 is fair and reasonable for the level of effort required from the Consultant; and WHEREAS, this fee is based on actual effort, paid on an hourly basis, and the hourly rates utilized in the calculation of effort are those currently in effect. NOW, THEREFORE, the parties hereto, and in consideration of the mutual promises, covenants, agreements, terms, and conditions herein contained, and other good and valuable consideration, the respect and adequacy are hereby acknowledged, do agree as follows. 1. ABOVE RECITALS The above recitals are true and correct and are incorporated as a part of this Amendment No.2. 2. The Agreement is amended to provide additional project management services as more particularly set forth in Exhibit "A" to this Amendment, attached hereto and incorporated herein. 3. RATIFICATION.
