AMENDMENT NO.4
TO THE
PROFESSIONAL SERVICES AGREEMENT
BETWEEN
CITY OF MIAMI BEACH, FLORIDA
AND
MC HARRY ASSOCIATES, INC., DATED JULY 12, 2000; SAID AMENDMENT,
IN THE AMOUNT OF $33,348, FOR THE PROVISION OF ADDITIONAL
CONSTRUCTION-ADMI,NISTRATION SERVICES, FOR THE CONSTRUCTION
COMPLETfON OF A NEW FIRE STATION No.4.
THIS AMENDMENT NO.4, DATED AS OF DECEMBER 7, 2005, TO THAT
CERTAIN AGREEMENT, DATED JULY 12, 2000, BY AND BETWEEN THE
CITY OF MIAMI BEACH, FLORIDA (CITY), AND MC HARRY ASSOCIATES,
INC. (CONSULTANT).
RECITALS
WHEREAS, on January 20, 2000, Request for Qualifications (RFQ) No.
41-99/00, was issued for architectural and engineering services for design and
construction administration for the rehabilitation of the existing building and an
addition to Fire Station No.4; and
WHEREAS, on July 12, 2000, the Mayor and City Commission approved
a Professional Services Agreement, in the amount of $160,636, with the firm of
MC Harry Associates, Inc. (Consultant), for design and construction
administration services for the rehabilitation of the existing Fire Station No.4, as
well as an addition to the building to house dormitories and fire apparatus, plus a
not to exceed amount of $5,000, for reimbursable expenses, (the Agreement);
and
WHEREAS, construction is currently estimated to be at 600/0 completion,
with projected Substantial Completion by April 2006; and
WHEREAS, the extended construction period will require the Consultant
to provide necessary additional construction management services; and
WHEREAS, the City wishes to amend the Agreement, and increase funds,
in the amount of $33,348, available from Undesignated Fund 301 Balance; and
WHEREAS, this Amendment has been evaluated by URS, the City's
Program Manager, and the CI P Office, and determined to be necessary;
NOW, THEREFORE, The City and Consultant agree to amend the
Agreement as follows:

This is a revised fee proposal from our August 24, 2005 letter.
We respectfully submit herewith our request for authorization for EXTENDED CONSTRUCTION
ADMINISTRATION SERVICES in accordance with paragraph 2.10.12 (page 12) oftheAE agreement.
The original construdion schedule showed 360 calendar days; and this expires November 11, 2005.
The contrador is not progressing on schedule, and their latest schedule shows March 31,2006 as the
completion date.
Our request at this time is to obtain authorization for the extended time period known today. Our LUMP
SUM fee proposal shown below is based on estimated hours as negotiated last week

1. ABOVE RECITALS
The above recitals are true and correct and are incorporated as a part of
this Amendment NO.4.
2. The Agreement is amended to provide for additionql construction
administration services by Consultant, in the amount of $33,348, as more
particularly set forth in Exhibit "A" to this Amendment, attached hereto and
incorporated herein.
3. RATIFICATION.
The City and Consultant ratify the terms of the Agreement, as amended by
this Amendment NO.4.
