98-22664 RESO RESOLUTION No. 98-22664 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING THE THIRD AMENDMENT TO THE POLICE CONFISCATION TRUST FUND FOR FISCAL YEAR 1997/98, IN THE AMOUNT OF $455,600.00, TO BE FUNDED FROM THE PROCEEDS OF STATE CONFISCATED FUNDS FOR THE PURCHASE OF TWENTY (20) EQUIPPED VEHICLES TO BE USED TO CONTINUE THE IMPLEMENTATION OF THE FRATERNAL ORDER OF POLICE VEHICLE TAKE HOME PROGRAM. (Third Amendment FY 97/98) WHEREAS, Section 932.705, Florida Statutes, addresses the purposes and procedures to be utilized for the appropriation and expenditures of the Police Confiscation Trust Fundi and WHEREAS, the Chief of Police of the City of Miami Beach has determined that the need for appropriation and expenditures exists and the appropriation and expenditure of forfeiture funds is in compliance with Section 932.705, Florida Statutes, and with Federal guidelinesi and WHEREAS, such funds are available in the Police Confiscation Trust Fund. NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby adopt the Third Amendment to the 97/98 Police Confiscation Trust Fund Budget for the City of Miami Beach, in the amount of $455,600.00, as reflected in the attached Exhibit "A". (Third Amendment FY 97/98) ADMINISTRATION RECOMMENDATION Adopt the Resolution. BACKGROUND The Police Take Home Program was agreed upon and is outlined in the October 1st, 1994 Labor Agreement between the City of Miami Beach and the Fraternal Order of Police. The agreement sets goals for the program and outlines the funding mechanism for the purchase of the vehicles. The funding comes from the Police Department Confiscation Trust Fund. The agreement states that after satisfying all current appropriations, as of Nov. 16, 1994, all additional funds are allocated on a 60%/40% ratio with 60% of the total going to the Police Department to satisfy the needs of the Department and 40% going for the purchase of the vehicles for the Police Vehicle Take Home Program. The Chief of Police of the City of Miami Beach has determined that the need for the appropriation and expenditures is in compliance with Section 932.705, Florida State Statutes. ANALYSIS The Administration requests authorization to adopt a Third Amendment to the operating budget for the FY 97/98 Police Confiscation Trust Fund in the amount of $455,600.00 from State funds to provide for the expenditures listed in Exhibit "A". AGENDA ITEM C.l F 2-\~.9~ DATE In accordance with Florida State Statute 932.705, forfeiture funds have been deposited in the Police Confiscation Trust Fund and the City has complied with all statutory procedures involved in the transaction of these funds. CONCLUSION The attached Resolution provides for a Third Amendment to the FY 97/98 Police Confiscation Trust Fund in the amount of $455,600.00 to be used for the expenditures listed in Exhibit "A".
