A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND
AUTHORIZING THE PLACEMENT OF SIXTY -FIVE (65) BANNERS
FOR THE 7TH ANNUAL WINTER PARTY, TO BE HELD AT THE
14TH STREET BEACHFRONT ON SUNDAY, MARCH 5, 2000, AS
REQUESTED BY THE APPLICANT AT THE FOLLOWING
LOCA TIONS: 5TH STREET, BETWEEN ALTON ROAD AND
OCEAN DRIVE; COLLINS AVENUE, BETWEEN 12TH STREET
AND 18TH STREET; WASHINGTON AVENUE, BETWEEN 10TH
STREET AND 15TH STREETS; MACARTHUR CAUSEWAY
(ALTON ROAD TO COAST GUARD STATION); ALTON ROAD,
SOUTH OF 5TH STREET; AND DADE BOULEVARD, FROM
PINETREE DRIVE TO MERIDIAN A VENUE; SAID BANNERS TO
BE AFFIXED TO LIGHT POLES IN THE PUBLIC RIGHT -OF-
WAY, MEASURE 3' X 7' AND HAVE COPY AND DESIGN AS
SHOWN ON THE ATTACHED DRAWINGS; THE
ADMINISTRATION FURTHER RECOMMENDS THAT THESE
BANNERS BE INSTALLED NO EARLIER THAN FEBRUARY 21,
2000, AND REMOVED BY MARCH 07, 2000.
WHEREAS, the Winter Party is a fundraising dance party, to be held on the beachfront
at 14th Street on Sunday, March 5, 2000, and to benefit Dade Human Rights Foundation; and
WHEREAS, approximately 70% of the attendance is from out of town visitors staying in
local hotels for approximately five nights; and
WHEREAS, to welcome and promote the 7th Annual Winter Party and draw attention
of the media and the public at large, the applicant, the Dade Human Rights Foundation
(Applicant), has requested light pole banners, measuring 3 feet x 7 feet, to be placed at 5th Street
between Alton Road and Ocean Drive; Collins Avenue, between 12th Street and 18th Street;
Washington Avenue, between 10th Street and 15th Street; MacArthur Causeway (Alton Road to
Coast Guard Station); Alton Road, south of 5th Street; and Dade Boulevard, from Pinetree Drive
to Meridian Avenue; and
WHEREAS, said banners will be installed no earlier than February 21, 2000, and
removed by March 6, 2000; and
WHEREAS, the Applicant, has requested approval and authorization for the placement
of a total of sixty-five (65) banners; and
WHEREAS, the Applicant will post a performance bond to ensure the removal of the
banners by March 7, 2000, and will ensure that any damage to light poles will be repaired at its
expense, and will meet all other applicable City requirements; and
WHEREAS, Section 82-411 (d) of the Miami Beach City Code requires that the Mayor
and City Commission approve the installation of temporary banners.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission herein approve and authorize the placement of sixty-five (65) banners for the 7th
Annual Winter Party, to be held at the 14th Street Beachfront on Sunday, March 5, 2000, as
requested by the Applicant at the following locations: 5th Street, between Alton Road and Ocean
Drive; Collins Avenue, between 12th Street and 18th Streets; Washington Avenue, between 10th
Street and 15 Streets; MacArthur Causeway (Alton Road to Coast Guard Station); Alton Road,
south of 5th Street; and Dade Boulevard, from Pinetree Drive to Meridian A venue; said banners
to be affixed to light poles in the public right-of-way, measure 3' x 7' ,have copy and design as
shown on the attached drawings, and to be installed no earlier than February 21, 2000, and
removed by March 7,2000.

THE ATTACHED DRAWINGS; AND SHALL BE INSTALLED AND
REMOVED IN ACCORDANCE WITH ALL OTHER APPLICABLE CITY
REQUIREMENTS; THE ADMINISTRATION FURTHER RECOMMENDS
THAT THESE BANNERS BE INSTALLED NO EARLIER THAN
FEBRUARY 21, 2000, AND REMOVED BY MARCH 7, 2000.

Adopt the Resolution.
ANALYSIS
The City Code Section 82-411 (d) requires that the City Commission approve the installation of
temporary banners which reads, in part:
(1) The right to install, as well as the number, location and method of installation of banners
shall be subject to the design review process and approved by the city commission and the public
works department.
(2) Banners shall not exceed three feet in width by seven feet in length. Banners may be
double-sided. The color, design and material of all banners shall be approved under the design
review process.

(5) Banners announcing special events either to be held in city or to be associated in some
manner with the city, as determined by the city commission, may be erected up to 30 days prior
to the event being announced and must be removed within seven days after such event. Special
event banners shall require prior approval by the city commission.
(6) A performance bond shall be required to ensure the removal of the banners in case of
advanced deterioration of the banners, or if a dangerous condition presents itself, the city may at
its sole discretion direct banners to be removed at any time.
The purpose of the banners is to welcome and promote the 7th Annual Winter Party. The Winter
Party is a fundraising dance party to benefit Dade Human Rights Foundation. Approximately 70 %
of the attendance is from out of town visitors staying in local hotels for approximately five nights.
If approval is granted, the proposed temporary banners are recommended to be installed no earlier
than February 21, 2000 and removed no later than March 7, 2000, by the banner company.
The City Commission should approve the installation of the subject light pole banners for the 7th
Annual Winter Party.
