A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, FINDING AND DECLARING THE EXISTENCE OF AN
EMERGENCY AND ALLOWING THE POLICE ATHLETIC LEAGUE (PAL), A NOT FOR
PROFIT ENTITY, TO UTILIZE THE PUBLIC SWALE AREA LOCATED AT DADE
BOULEVARD AND PRAIRIE AVENUE FOR A FUND-RAISING EVENT TO OPERATE
A FOOD CONCESSION STAND AND PROVIDE ADDITIONAL PARKING FOR THE
DURATION OF THE BOAT SHOW, CURRENTLY SCHEDULED FROM FEBRUARY 17
- 22, 2000; FURTHER PROVIDING THAT THE SW ALE BE UTILIZED EXCLUSIVELY
BY PAL SUBJECT TO THE FOLLOWING CONDITIONS: (1) THAT INGRESS AND
EGRESS TO THE SW ALE BE PROVIDED EXCLUSIVELY FROM PRAIRIE AVENUE
AND NOT MERIDAN; (2) THAT 100% OF THE PROFITS GENERATED FROM THIS
FUNDRAISER BE RETURNED TO PAL FOR ITS EXCLUSIVE USE; (3) THAT PAL AND
THE CITY JOINTLY MONITOR THE USE OF THE SW ALE SO THE SURROUNDING
RESIDENTIAL NEIGHBORHOOD IS NOT ADVERSELY IMP ACTED OR DISTURBED;
(4) IN ORDER TO ACCOMMODATE THE UNIQUE EMERGENCY CREATED BY THE
INCREASED PARKING DEMANDS OF PATRONS ATTENDING THE BOAT SHOW,
THE SUBJECT PERMISSION IS GRANTED WITHOUT ESTABLISHING PRECEDENT
SO AS TO SATISFY THIS UNIQUE EMERGENCY SITUATION; AND (5) THAT PAL
OBTAIN ALL NECESSARY PERMITS TO OPERATE SAID CONCESSION STAND.
WHEREAS, the Administration received a request from the Miami Beach Police Athletic
League (P AL), a not for profit entity, for permission to utilize the public swale area located at Dade
Boulevard and Prairie Avenue (the Swale) for a fund raising event to include a food concession stand
and to provide additional parking for the Boat Show, scheduled in the City of Miami Beach from
February 17 - 22, 2000; and
WHEREAS, the PAL requests to use the Swale one day before the Boat Show begins and
one day after the Boat Show ends; and
WHEREAS, the Administration recommends approval of the PAL's request subject to the
following conditions:
(1) That ingress and egress to the Swale be maintained exclusively on Prairie Avenue
and not Meridian Avenue;
(2) That all profits generated by this fund raising event go exclusively to PAL;
(3) That the Administration and PAL workjointly in preserving the residential character
of the surrounding neighborhood, and that disturbance to these residential areas be
maintained at a minimum; and
(4) In order to accommodate the unique emergency created by the increased parking
demands of patrons attending the Boat Show, the subject permission is granted
without establishing precedent so as to satisfy this unique emergency situation; and
(5) That PAL obtain any and all required permits to operate said concession stand; and
(6) Parking in the Vacant Lot will not occur until the public parking facilities on 17th
Street and the Miami Beach High School parking lot and football field are full.
WHEREAS, the Administration would herein recommend that the Mayor and City
Commission find that an emergency exists with regard to the scarcity of parking during special
events such as the Boat Show, and the need for increased parking during the duration of these events,
and therefore approve the PAL's request, subject to the afore stated conditions, on a one time only
emergency basis.
NOW THEREFORE BE IT RESOL VED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission herein finds and declares the existence of an emergency and allows the Police Athletic
League (PAL), a not for profit entity, to utilize the Swale, located at Dade Boulevard and Prairie
A venue, for a fund-raising event to operate a food concession stand and provide additional parking
for the duration of the Boat Show, currently scheduled from February 17 - 22, 2000; further
providing that the Swale be utilized exclusively by PAL subject to the following conditions: (1) that
ingress and egress to the Swale are provided exclusively from Prairie Avenue; (2) that 100% ofthe
profits generated from this fund raiser be returned to PAL for its exclusive use; (3) that PAL and
the City jointly monitor the use of the Swale so the surrounding residential neighborhood is not
adversely impacted or disturbed; (4) in order to accommodate the unique emergency created by the
increased parking demands of patrons attending the Boat Show, the subject permission is granted
without establishing precedent so as to satisfy this unique emergency situation; and (5) that PAL
obtain all the said necessary permits to operate said concession stand.

ANALYSIS
The Miami Beach Police Athletic League (PAL) desires to use certain properties for the purpose

of raising funds during the 2000 Miami Beach International Boat Show. PAL requests to use this
area, also known as the Dade Boulevard Swale (DBS), for parking and to place and operate a food
concession stand. PAL requests to use the DBS one day prior to the public opening of the Boat
Show, February 16,2000, and one day after the closing of the Boat show, February 23, 2000, for
parking of exhibitor's automobiles. There will be NO parking of any commercial type trucks on the
DBS.
Parking is a major concern during the Boat Show. PAL has been granted permission by thc City
for past Boat Shows to use this property for this purpose under Resolution No. 98-22635. The usc
of this property by PAL has been bencficial to PAL, the City and persons attending this international
event.
In addition, the Police Athletic League will:
1. Hire an off-duty police officer to direct traffic for the ingress and egress on Dade
Boulevard.
2. Obtain a letter from the Mid-Golf Homeowners Association stating that they are in
agreement with the use of this property on this date and thesc times.
3. Submit a plan showing the use of the propcrty to the Planning Department for approval.
4. Supply a lctter from PAL to the owner of the property stating that the property will be
rcturned in the same condition as it was before the use.
5. Obtain a General Liability Certificate oflnsurance naming the City as an additional named
insured.
6. Parking in the Vacant Lot will not occur until the public parking facilities on 17th Street
and the Miami Beach High School parking lot and football field are full.
By adopting the Resolution, the Mayor and City Commission will assist PAL in raising funds for the
youth of our City.
