Re: VITRI PROJECT: ALLEY VACATION AND RELOCATION NO OBJECTION LETTER Dear Raul: Subject to satisfaction by 535 West Avenue LLC ("Developer") with each and every one of the conditions set forth in that certain Resolution #2005-25869 of the Mayor and City Commission of the City of Miami Beach, Florida, which Resolution was passed at the City Commission Meeting on April 20, 2005, and a copy of which is attached hereto as Exhibit A, including without limitation satisfaction and continuing compliance with conditions numbered 5, 6 and 8 of the Resolution, and based upon representations by the City of Miami Beach that the contemplated alley vacation and relocation will not adversely impact Mau-Mau-Corporation's development rights at the property known as 1220-1234- 6t~ Street, Miami Beach, Mau-Mau Corporation has no objection to the alley vacation and relocation contemplated by said Resolution.
