A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, AUTHORIZING, BY 5/7THS VOTE, THE WAIVER OF FORMAL
COMPETITIVE BIDDING AND AWARDING PURCHASE ORDERS FOR THE
PURCHASE OF BULLETPROOF VESTS TO LOU'S GUNSHOP AND POLICE SUPPLY;
HARRISON UNIFORM COMPANY; AND MIAMI POLICE SUPPLY, IN THE TOTAL
AMOUNT OF $57,251.76.
WHEREAS, on June 16, 1998, the Bulletproof V est Partnership Grant Act of 1998 (the Act)
was signed into law (Public Law 105-181); and
WHEREAS, the purpose of the Act is to save the lives of law enforcement officers by
helping states, units of local government, and tribal governments equip their law enforcement
officers with bulletproof vests; and
WHEREAS, the United States Department of Justice (DOJ) created the Bulletproof Vest
Partners Grant Program to assist state and local law enforcement agencies in the purchase of
bulletproof vests; and
WHEREAS, funding is available as follows:

WHEREAS, the grant will reimburse the Police Confiscations account $29,271.51; and
WHEREAS, on May 26, 1999, the Mayor and City Commission, by Resolution No. 99-
23174, authorized and approved the Police Department to apply for the aforestated grant funds; and
WHEREAS, a requirement of the grant is that any vests that are purchased, have to be a
approved for use by police officers, according to the National Institute of Justice Standards, and that
they be purchased from a DOJ approved vendor; and
WHEREAS, In the Miami-Dade County area, DOJ has approved Lou's Gunshop and Police
Supply, Harrison Uniform, and Miami Police Supply as the authorized vendors for purchase of vests
under the Grant Program; and
WHEREAS, the DOJ would only reimburse grant participants whose officers purchased
approved vests from approved vendors, and accordingly, the Administration and the Police
Department would recommend that the Mayor and City Commission waive competitive bidding, and
authorize the purchase of the vests with the aforestated approved vendors.
NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISISON OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission, by 5/7ths vote, authorize the waiver of formal competitive bidding and award
Purchase Orders for the purchase of bulletproof vests to Lou's Gunshop and Police Supply; Harrison
Uniform Company; and Miami Police Supply, in the total amount of$57,251.76.

ANAL YSIS
On June 16, 1998, the Bulletproof V est Partnership Grant Act of 1998 was signed into law (Public
Law 105-181). The purpose of the Act is to save the lives of law enforcement officers by helping
states, units of local government and tribal governments equip their law enforcement officers with
bulletproof vests. The United States Department of Justice (DOJ) has created the Bulletproof Vest
Partners program that will assist state and local law enforcement agencies in the purchase of
bulletproof vests.
The Program would fund up to 50% of the purchase price of new bulletproof vests for police

officers. The City will be eligible to participate this fiscal year and the next two fiscal years of the
Program, for a total grant period of three years.
Each vest costs approximately $525 and has a service life of five years. Currently, the contractual
Agreement between the Fraternal Order of Police and the City requires that the City reimburse the
Police Officer up to a maximum of $450 per vest. The funds for reimbursement are derived from
the Police Confiscations Account. The Police Officer is responsible for paying the difference between
the cost ($525) and the $450 contractual reimbursement. Based on an anticipated purchase of375
vests over three years, the City would realize a savings of approximately $98,437.
On May 26, 1999, the Mayor and City Commission, Resolution No. 99-23174, authorized and
approved the Police Department to apply for these funds.
The grant requires that the vests are approved for use by police officers according to the National
Institute of Justice standards and are purchased from a Department of Justice approved vendor. In
the Miami-Dade County area, the United States Department of Justice approved Lou's Gunshop and
Police Supply, Harrison Uniform, and Miami Police Supply as the authorized vendors for purchase
of vests under the Grant Program.
The Police Department obtained the appropriate information on the type of vests permitted to be
purchased and the authorized vendors. Prior to verifYing with the Procurement Division the existence
of a State Contract and seeking City Commission approval, police officers were permitted to purchase
vests from these Department of Justice approved vendors. It was believed that these Department of
Justice approved vendors were part of the State of Florida approved list of contractors, therefore, no
competitive bidding would be necessary. However, these vendors were only approved by the
Department of Justice and were not on the State contractors list.
The Administration believes that this was an error in good faith and recommends that the Resolution
be ad~oPted.
