2000-23819 RESO RESOLUTION NO. 2000-23819 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AFFIRMING THE DEVELOPMENT REGULATIONS PERTAINING TO THE NORMANDY ISLE P ARK AND WAIVING CERTAIN DEVELOPMENT REGULATIONS DEALING WITH REQUIRED SETBACKS, PURSUANT TO SECTION 142- 425 (D) OF THE CODE OF THE CITY OF MIAMI BEACH, IN ORDER TO CONSTRUCT A NEW SWIMMING POOL FACILITY AND MULTI PURPOSE COURT. WHEREAS, the City is in the process of renovating the Normandy Isle Park; and WHEREAS, pursuant to Section 142-425(d) of the Code of the City of Miami Beach, Florida, the City Commission may waive certain development regulations; and, WHEREAS, as required by the City Code this process requires a public hearing; WHEREAS, as required by the City Code a 15 day notice was given and the notice posted on the property and an advertisement was placed in a newspaper of general circulation and mailed to all property owners within 375 feet; NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby affirm the development regulations pertaining to the Normandy Isle Park and waive 6'- 3" of the required 20' setback from the north property line for the swimming pool facility, and 16'- 9" of the required 20' setback from the south property line for the multi purpose court, pursuant to section 142-425 (d) of the Code of the City of Miami Beach, in order to construct a new swimming pool facility and multi purpose court. ADMINISTRA TION RECOMMENDATION Adopt the Resolution. ANALYSIS The project consists of the construction of a new, replacement, swimming pool facility and a multi-purpose court as well as other improvements associated with the renovation of the Normandy Isle Park. The southerly facade of the existing Pool Building is located adjacent to approximately 500 linear feet of underground storm sewer lines and other underground utility service lines such as FPL and Bellsouth. Along Normandy Drive, on the north, the existing pool deck currently encroaches 5" within the allowable 20' setback. The existing tennis court, located at the southwest corner of the property, also encroaches 4' along Rue Granville, on the west, and 15'-2" along 71st Street, on the south. Moreover, the existing basketball court encroaches 2'-4" along 71st Street. An existing soccer field is located adjacent to the aforementioned underground utility lines on the south side of the pool building. The new and larger replacement pool facility will be constructed, on the site, at the same location as the old structure. The location of the existing soccer field and that of the aforementioned underground utilities impede any construction expansion of the pool building to the south. The cost for their relocation would be, approximately, an additional $165,000 to the current estimated cost of construction. Due to these circumstances, a 6'-3" encroachment within the allowable 20' setback along Normandy Drive, on the north is required. The existing tennis and basketball courts will also be replaced by a new multi-purpose court. The new court will be located at the southwest corner of the site. The 20' setback requirement on the west, along Rue Granville will be complied with. However, due to existing site constraints, and in order to provide the proper working dimensions for the new multi-purpose court, a 16'-9" encroachment along 71 st Street, on the south, is required. This represents an additional 19" to the existing tennis court current encroachment of 15'-2" along the same artery. The Administration is requesting that the City Commission affirm the Planning and Zoning Director's determination that the site should be reviewed under the development regulations of the RM-l District of the Code of the City of Miami Beach pursuant to Section 142-425.a which reads, in part: "The development regulations (setbacks, floor area ratio, signs, parking, etc.) in the GU government use district shall be the average of the requirements contained in the surrounding zoning districts as detennined by the planning and zoning director, which shall be approved by the City Commission." The Administration is also requesting that the City Commission waive certain development regulations regarding setbacks, pursuant to Section 142-425 (d) of the Code which reads, in part: "Following a public hearing, the development regulations required by these land development regulations, except for the historic preservation and design review processes, may be waived by a five-sevenths vote of the City Commission for developments pertaining to governmental owned or leased buildings, uses and sites which are wholly used by, open and accessible to the general public, and for convention center hotels and convention center hotel accessory garages and city utilized parking lots, provided they are continually used for such purposes. Notwithstanding the above, no GU property may be used in a manner inconsistent with the comprehensive plan."... The public hearing on this waiver has been given 15 day notice, the notice has been posted on the property, and advertised in a newspaper of general circulation and mailed to all property owners within 375 feet. In order for the development of the project to proceed, it is necessary to waive the following development regulations: The minimum required front yard setback in the RM-l District is twenty (20') feet. The swimming pool facility is located 13'-9" from the north property line along Normandy Drive. Therefore a waiver of 6' - 3" is required. The multi purpose court, basically a concrete deck at grade, is located 3'-3" from the south property line along 71st Street. A waiver of 16'-9" is required. PUBLIC NOTICE IS HEREBY GIVEN that a public hearing on the resolution will be held by the City Commission on WEDNESDAY, FEBUARY 23,2000 at 2:00 P.M. in the City Commission Chambers, Third Floor, City Hall, 1700 Convention Center Drive, Miami Beach, Florida.
