2000-23768 RESO RESOLUTION No. 2000-23768 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AMENDMENT NO.1 TO THE AGREEMENT WITH GAMBACH - SKLAR ARCHITECTS, INC. IN THE AMOUNT OF $39,380, FOR ADDITIONAL SERVICES TO REVISE THE DESIGN OF THE MARSEILLE DRIVE STREETS CAPE PROJECT TO INCLUDE LANDSCAPING AT THE NORTH END OF RUE NOTRE DAME, ADDITIONAL STREET TREES AND OTHER DESIGN ENHANCEMENTS; AND FURTHER APPROVING THE REALLOCATION OF $3,484 REMAINING IN THE QUALITY OF LIFE PROJECT ALLOCATION FROM THE WESTERN ENTRANCE SIGN LINE ITEM, TO THE 77TH STREET/MARSEILLE DRIVE LINE ITEM, TO PROVIDE SUFFICIENT MONEY TO FUND THE ADDITIONAL SERVICES. WHEREAS, on September 13, 1995, an Agreement between the City of Miami Beach and Gambach-Sklar Architects, Inc. For Professional Architectural, Engineering and Land Surveying Services For Various City Capital Projects Where Basic Construction Cost Does Not Exceed $500,000 Per Project For a Two (2) Year Period (the Agreement) was executed between the City and Gambach-Sklar Architects, Inc. (Consultant); subsequent thereto, a Service Order was issued to develop plans and construction documents for the renewal of the streetscape on Marseille Drive, between Bay Drive and Rue Notre Dame; and WHEREAS, pursuant to the Agreement, the Consultant completed certain design drawings, specifications and construction documents; and WHEREAS, the City has determined that the submitted drawings need to be substantially revised before construction; and, WHEREAS, the Consultant has submitted a proposal for the cost of the requested revisions; and, WHEREAS, the Administration recommends approval of the reallocation of $3,484 of FY 1996/97 Quality of Life Funds from the Western Entrance Lighting line-item, to the 77th Street/Marseille Drive Improvement line item; and, WHEREAS, the Administration recommends the Mayor and City Commission approve and authorize the Mayor and City Clerk to execute the attached Amendment No.1 to the Agreement, providing for the completion of the proposed work, for the lump sum fee as set forth therein. NOW, THEREFORE BE IT DUL Y RESOL VED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission approve and authorize the Mayor and City Clerk to execute the attached Amendment No.1 to the Agreement with Gambach-Sklar Architects, Inc., in the Amount of $39,380, for Additional Services to revise the design of the Marseille Drive Streetscape Project to include landscaping at the north end of Rue Notre Dame, additional street trees and other design enhancements; further, approving the reallocation of$3,484 remaining in the Quality of Life Project allocation from the Western Entrance Sign line item, to the 77th Street/Marseille Drive line item to provide sufficient money to fund the additional services. ADMINISTRATION RECOMMENDATION Adopt the Resolution. AMOUNT AND FUNDING $50,000 was authorized and appropriated in FY 1995/96 for the design of the project to improve Marseille Drive through the Quality of Life program; of this amount, $29,012 has been spent to date. The additional funding requested for the professional services to modify the design as requested total $36,380.00, plus a $3000.00 allowance for reimbursables, for a total of$39,380.00. Subtracting the funds already spent from the prior allocation, leaves a balance available for the new work of$20,988. This results in a funding shortfall of $18,392. This amount is available from the 1996-97 Quality of Life budget, subject to the reallocation of certain funds as described herein. ANALYSIS On September 13, 1995, an Agreement between the City of Miami Beach and Gambach-Sklar Architects, Inc. For Professional Architectural, Engineering and Land Surveying Services for Various City Capital Projects Where Basic Construction Cost Does Not Exceed $500,000.00 per Project For a Two (2) Year Period, was executed. This type of Agreement is known as a "Rotational Contract" with a consultant. AGENDAITEM~ DATE~ Pursuant to the contract, a Consultant Service Order was issued to Gambach-Sklar Architects, Inc. on June 27, 1996, for Professional Services to design roadway improvements for Marseille Drive from Bay Drive to Rue Notre Dame, for Rue Versailles from Normandy Drive to Marseille Drive, and for Rue Notre Dame from Normandy Drive to Marseille Drive. The proposed improvements included sidewalks, valley gutters, drainage system to re-use existing catch basins where possible, drainage wells as required, paved angle parking including handicapped parking, landscaping and irrigation. The Architect was to attend a Community Meeting to explain the scope and character of the project to neighborhood residents. On February 5, 1997, drawings were submitted to the City for review. However, as funding was not identified for the project, no action was taken. In October 1998, sufficient funding was reserved for the project, based on the cost estimate submitted. The plans were reviewed and returned to the Consultant for revision. Final plans and specifications were received by the City on September 2l , 1999, and the project was slated to be put out to bid during the month of October 1999. Prior to issuance of the Request for Bids, the drawings were submitted to the City's Planning Department for their final review, pursuant to the recently passed Ordinance requiring Planning Department review of proposed streetscape projects. During the examination of the proposed plans, the Planning Department identified a number of elements within the design which they felt should be modified before going forward with construction. The Consultant was called in for two meetings to discuss the proposed changes, in some cases sketches of the desired revisions were submitted to the Consultant. On the basis of these meetings, the Consultant submitted a new price proposal for the design work needed to modify the design of the proposed project to incorporate the requested reVISIons. The proposed revisions include the following changes to the plans: Delete the median at Marseille and Bay Drive, and provide angle parking instead of parallel parking. Move curbs and provide bulb-out planters at the intersection of Marseille and Bay Drive. Revise planter locations to more closely match existing driveways and building entrances. Remove curb cuts in front of illegal private parking spaces and replace with legal on-street parking. On Rue Notre Dame and Rue Versailles, narrow the driving lane and move the parallel parking lane to add a 5' grass planter and trees every 25-30 feet. Extend the project boundary to include the dead-end section of Rue Notre Dame to the north of Marseille Drive, develop this street-end with on-street parking and a landscaped green space adjacent to the water. Add pedestrian crosswalks at Marseille and Versailles, and mid-way between Rue Versailles and Rue Notre Dame. Add additional trees and planters at the street intersections. Revise the bid documents to reflect the modifications. Conduct periodic site visits during the construction period to observe the work, and provide certification of contractor payment requests. Revise the construction documents to permit the work on Rue Versailles and/or Rue Notre Dame to be treated as deductive alternates, so that one or both of these segments of the project may be deleted if necessary to keep the project within the budget allocation. For these services Gambach-Sklar has requested a fee of $36,380, plus $3,000 reimbursables. The revisions are expected to take approximately six weeks to complete after notice from the City to proceed. The proposed changes are expected to raise the cost of the project to approximately $600,000, based on a preliminary estimate. A detailed cost estimate is not yet available, and will be prepared when the drawings are substantially completed. Previously, $422,000 of Community Development Block Grant (CDBG) funds have been reserved for the construction of this project. The additional cost resulting from the proposed revisions are expected to be paid from bond funds, or from a supplementary allocation of CDBG funds. The Quality of Life funding allocation approved by Commission Memorandum No. 311-97, on May 7, 1997, provides funding for a number of projects, including funding for a sign at the western entrance. This line item has $3,484 in funds which have not been used. The Administration recommends that this balance be re-allocated to the 77th Street/Marseille Drive Improvement Plan line item, which will make available $18,400 in this line item for use in the completion of the Marseille Drive project design work. CONCLUSION: The Administration requests approval and execution of Amendment No.1 to the Agreement with Gambach - Sklar Architects, Inc. in the amount of$36,380 for the proposed work described above, plus $3,000 for reimbursables, for a total commitment of$39,380. It is recommended that the Mayor and City Commission adopt the Resolution authorizing the Mayor and City Clerk to execute Amendment No. 1 to the Agreement with Gambach-Sklar Architects, Inc. in the Amount of $39,380, for additional services to revise the design of the Marseille Drive Streetscape Project to include landscaping at the north end of Rue Notre Dame, additional street trees and other design enhancements, further, approving the reallocation of $3,484 remaining in the Quality of Life Project allocation from the Western Entrance Sign line-item to the 77th StreetIMarseille Drive line-item to provide sufficient money to fund the additional services. .~~4 fJ.tt? FOR PROFESSIONAL ARCHITECTURAL, ENGINEERING AND LAND SURVEYING SERVICES FOR VARIOUS CITY CAPITAL PROJECTS WHERE BASIC CONSTRUCTION COST DOES NOT EXCEED $500,000.00 PER PROJECT FOR A TWO (2) YEAR PERIOD This Amendment No.1, dated as of 20 JP.1Ij(jM~, 2000, to that certain Agreement, dated September 13, 1995, by and between the City of Miami each, Flonda (CIty) and Gambach-Sklar Architects, Inc. (Consultant). WHEREAS, the Agreement, and the subsequent Service Order issued thereunder provides for the preparation of plans, specifications and construction documents for a project described therein; and WHEREAS, plans and specifications have been completed subsequent thereto, however, the City is desirous of modifying the design and this Amendment incorporates the revisions to the Agreement agreed to by the parties to effect these modifications. NOW THEREFORE, the parties hereto have agreed as follows: 1. ABOVE RECITALS The above recitals are true and correct and are incorporated as a part of this First Amendment. 2. MODIFICATIONS The Agreement is amended to add the following additional services: a. Exhibit "A," entitled Scope of Services/Compensation for Additional Services. 3. OTHER PROVISIONS. All other provisions of the Agreement, as amended, are unchanged. 4. RATIFICATION. The City and Consultant ratify the terms of the Agreement, as amended, as modified by this Amendment No.1. Extend the project boundary to include the dead-end section of Rue Notre Dame to the north of Marseille Drive, develop this street-end with on-street parking and a landscaped green space adjacent to the water. · Add pedestrian crosswalks at Marseille and Versailles, and mid-way between Rue Versailles and Rue Notre Dame. · Add additional trees and planters at the street intersections. · Increase the size of all trees specified. · Provide additional planters to achieve 50' spacing on the South side of the street. · Provide additional street lighting. · Provide the bidding and construction documents to reflect the complete project, as modified. · Conduct periodic site visits during the construction period to observe the work, and provide certification of contractor payment requests. · Revise the construction documents to permit the work on Rue Versailles and/or Rue Notre Dame to be treated as deductive alternates, so that one or both ofthese segments of the project may be deleted if necessary to keep the project within the budget allocation. · Review any shop drawings submitted by the contractor. · Respond to any requests for information during the bidding period and the construction period. · Conduct periodic site visits during the construction period. · Review and approve Certifications for Payment to the contractor during the construction process. · Review and approve any requested change orders during the construction period. · Attend meetings required to clarify and explain the project, and for coordination purposes during the construction period. Compensation: Total fee for the above described services is $36,380, plus $3,000 for reimbursables, as defined in the Agreement. The revisions are expected to take approximately five weeks to complete after Notice to Proceed is issued by the City. Payments to the Consultant will be made as follows: Phase I: 80% of total fee payable upon receipt of completed Construction Documents and Specifications. Phase II: 20% oftotal fee payable for construction administration, monthly during the construction period, in proportion to the percentage completion of the construction project.
