RESOLUTION NO. 2000-23817
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, GRANTING A
PERPETUAL EASEMENT TO THE FLORIDA DEPARTMENT OF
TRANSPORTATION FOR TWO PARCELS NEAR COLLINS
A VENUE, AT 24TH AND 26TH STREETS, AS DESCRIBED IN THE
ATTACHED PARCEL 800 AND 801 SKETCHES, TO INSTALL AND
MAINTAIN A MAST ARM AND GUARD RAIL ANCHORAGE.
WHEREAS, the State of Florida Department of Transportation (FDOT) proposes to
construct or improve State Road No. A-I-A (Collins Avenue), Financial Project No. 2496871,
Section No.8 7060-2565, in Miami-Dade County, City of Miami Beach, Florida; and
WHEREAS, in the best interest of the City, and for pedestrian and traffic safety, it is
necessary that an easement across the City owned property at 24th and 26th Streets on Collins
Avenue, as described in the attached Parcel 800 and 801 sketches (Attachment #1), be granted to the
FDOT; and
WHEREAS, the FDOT has made application to the City to execute and deliver the attached
Perpetual Easement in favor of the FDOT, for the purpose of installing and maintaining a mast arm
and for guard rail anchorage.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City hereby grants the
State of Florida Department of Transportation a Perpetual Easement, in the form attached in
Attachment #2 herein, for installing and maintaining traffic mast arms and guard rail anchorage on
the City-owned property at 24th and 26th Streets, on Collins A venue.

WITH THE COLLINS A VENUE IMPROVEMENTS BY THE FLORIDA
DEPARTMENT OF TRANSPORTATION.

ANAL YSIS
The Florida Department of Transportation (FDOT) has recently completed construction documents
for the reconstruction of Collins A venue from Lincoln Road to 26th Street. This project includes
new sidewalks, pavement, signalization, street lighting and drainage improvements. The project,
with an estimated cost of $4.3M, is scheduled to be awarded for construction in July 2000. The
estimated construction duration by the FDOT is 22 months.
The drainage improvements in this project require the elimination of stormwater flow from adjacent
properties. The FDOT has designed and included a drainage well system to capture the stormwater
flow from the City's municipal parking lot located east of Collins A venue between 21 st and 22nd
Streets. To construct these wells and drainage piping for the City, the FDOT is requesting a
temporary easement for these areas in subject parking lot.
In addition, the new mast arms for traffic lights and protective guardrails included in this project
at 24th and 2&' Streets, are offset into the adjacent city right-of-way for reasons of traffic and
pedestrian safety. The FDOT is requesting a perpetual easement of the City, to install and maintain
these mast arms and guardrails.

This item was deferred at the December 15, 1999 Commission meeting. The Administration was
directed to meet with the property owners and the FDOT to address concerns over encroachments
and other project details.
On January 27,2000, a meeting between City staff, Collins Avenue property owners and FDOT
representatives was held to discuss the above mentioned issues. At this meeting, City staff
recommended the following:
- Reduce width of the sidewalk to 10 feet to allow certain landscaping encroachments
to remain.
24 hour on-site presence by FDOT during each phase of construction.
Revision of the FDOT landscaping plan to accommodate the existing DRB approved
hotel landscaping features.
- Assurances from the FDOT of time frame for construction work by contractor .
- Assurances that construction crews will park out of the work area, possibly off-site,
with shuttle service and pick-up.
- Storage of non-essential construction equipment at specific location.
FDOT funding of a public relation/liaison person to coordinate all questions and
complaints during construction period.
FDOT publishing and supplying color brochures showing the completed Collins
Avenue project.
FDOT to provide safety personnel during construction hours to assist in pedestrian
crossing at intersections.
- Mitigation of traffic congestion during construction with increased ElectroWave
serVIce.
FDOT has been extremely cooperative in working with the City to resolve our concerns. The
widths of the sidewalks have been reduced to allow for the retention of the distinct architectural
and landscape improvements privately completed by the hotels (i.e.The National Hotel, The Delano
Hotel, etc.). A follow up meeting with FDOT representatives was held on February 2,2000. As
of the writing of this memo, the following items are still under discussion with FDOT:
- Revision to the landscaping plan, to maximize the number of trees. FDOT is currently revising
the landscape plans to accommodate additional trees requested by the City.
- Revised construction schedule and public involvement meetings.
- Redesign of some driveways and funding to relocate City utilities as requested by FDOT (three
properties).
The Administration recommends that the Mayor and City Commission adopt the attached
resolutions, granting a temporary easement to the FDOT within the City's parking lot on Collins
A venue, between 21 st and 22nd Streets, and permanent easements on Collins A venue at 24th and 26th
Streets. I

grantor, to the STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION, its
successors and assigns, grantee.
WITNESSETH: That the grantor for and in consideration of the
sum of One Dollar and other valuable considerations paid, the
receipt and sufficiency of which is hereby acknowledged, hereby
grants unto the grantee, its successors and assigns, a perpetual
easement for the purpose of installing and maintaining a
mast arm and for guard rail anchorage in, over, under, upon and
through the following described land in Miami-Dade County, Florida,
viz:

A parcel of land being a portion of the Right of Way of 24th
Street, Miami Beach, Florida, lying immediately West of State Road
A-1-A (Collins Avenue), as located on the AMENDED MAP OF THE OCEAN
FRONT PROPERTY OF THE MIAMI BEACH IMPROVEMENT COMPANY, as recorded
in Plat Book 5, Page 7, of the Public Records of Miami-Dade County,
Florida, and also in the State of Florida Department of
Transportation Right of Way Maps for State Road A-1-A, State
~roject No. 87060-MISC-2, lying in the Southeast one-quarter (SE ~)
of Section 27, Township 53 South, Range 42 East, being more
particularly described as follows:
COMMENCE at the point of intersection of the South Right of Way
line of said 24th Street with the East Right of Way Line of said
State Road A-I-A; THENCE N70"02'42"W, along the Westerly extension
of said South Right of Way Line of 24th Street, a distance of
22.860 meters (75.00 feet), to the point of intersection with the
West Right of Way Line of said State Road A-I-A, said point also
being the POINT OF BEGINNING; THENCE N04041'41"E a distance of
20.142 meters (66.08 feet); THENCE S67019'36"E a distance of 6_535
meters (21.44 feet); THENCE S23"37'29"W a distance of 19.161 meters
(62.86 feet) to the POINT OF BEGINNING.
Said land located within the City of Miami Beach, Miami-Dade
County, Florida containing an area of 62.6 square meters (674
square feet), more or less.

and assigns forever, together with immunity unto the said grantee,

the following Resolution was adopted:
WHEREAS, the State of Florida Department of Transportation
proposes to construct or improve State Road No. A-1-A, Financial
Project No. 2496871, Section No. 87060-2565, in Miami-Dade County,
Florida: and
WHEREAS, it is necessary that an easement across certain lands
now owned by the City of Miami Beach, Florida, be acquired by the
State of Florida Department of Transportation: and
WHEREAS, said use is in the best interest of the City: and
WHEREAS, the State of Florida Department of Transportation has
made application to said City to execute and deliver to the State
of Florida Department of Transportation a perpetual easement, or
easements, in favor of the State of Florida Department of
Transportation for the purpose of installing and maintaining a mast
arm and for guard rail anchorage, and said request having been duly
considered.
NOW THEREFORE, BE IT RESOLVED by the Board of City
Commissioners of the City of Miami Beach, Florida, that the
application of the State of Florida Department of Transportation
for a perpetual easement, or easements, is for transportation
purposes which are in the public or community interest and for
public welfare; that a perpetual easement, or easements, in favor
of the State of Florida Department of Transportation in the City of
Miami Beach, Florida, should be drawn and executed by this Board of
City Commissioners. Consideration shall be $
BE IT FURTHER RESOLVED that a certified copy
