98-22686 RESO RESOLUTION No. 98-22686 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING THE FOURTH AMENDMENT TO THE POLICE CONFISCATION TRUST FUND FOR FISCAL YEAR 1997/98, IN THE AMOUNT OF $215,295, TO BE FUNDED FROM THE PROCEEDS OF STATE CONFISCATED FUNDS ($193,295) AND FROM FEDERAL FUNDS ($22,000). WHEREAS, Section 932.705, Florida Statutes, addresses the purposes and procedures to be utilized for the appropriation and expenditures of the Police Confiscation Trust Fund; and WHEREAS, the Chief of Police of the City of Miami Beach has determined that the need for the appropriation and expenditures exists and the appropriation and the expenditure of forfeiture funds is in compliance with Section 932.705, Florida Statutes, and with Federal guidelines; and WHEREAS, such funds are available in the Police Confiscation Trust Fund. NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby adopt the Fourth Amendment to the 97/98 Police Confiscation Trust Fund Budget for the City of Miami Beach, in the amount of $215,295, as reflected in the attached Exhibit "A". There is no other funding source for these programs. To fund initiative addressing serious organized juvenile gang problems in the South Beach area. Program will be in conjunction with the combined Multi-Agency Gang Task Force, MAGT AF, and will be used to pay overtime for the officers assigned to the Task Force. To underwrite the Hispanic American Police Command Officer Association (HAPCOA), 25th Annual Training Conference, which will bring 400 command level Police Officers and Senior Federal Officers to Miami Beach for three days of intensive training in police related matters. The Conference is being co-hosted by Miami and Miami-Dade Police Departments. BACKGROUND Florida Statute 932.705 provides for, but is not limited to, the expenditure of forfeiture funds for crime prevention, other law enforcement purposes, and for contributions to organizations that benefit the youth of Miami Beach. The Chief of Police of the City of Miami Beach has reviewed and identified the need for the expenditures and the appropriation offorfeiture funds is in compliance with Section 932.705, Florida State Statutes and federal guidelines.. ANALYSIS The Administration requests authorization to adopt the Fourth Amendment to the operating budget for the FY 97/98 Police Confiscation Trust Fund in the amount of$215,295 from State and federal funds to be used to provide funds for the expenditures listed in Exhibit" A". The City has complied with all statutory procedures involved in the transaction of these funds. CONCLUSION The attached Resolution provides for the Fourth Amendment to the FY 97/98 Police Confiscation Trust Fund in the amount of$215,295 to be used for the expenditures listed in Exhibit "A".
