98-22701 RESO RESOLUTION NO. 98-22701 A RESOLUTION AUTHORIZING A THREE MONTH EXTENSION (APRIL 1, 1998 - JUNE 30,1998) OF THE CURRENT MEMORANDUM OF AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION (FOOT), FOR THE MAINTENANCE OF THE LANDSCAPING FOR STATE ROAD AlA (MAC ARTHUR CAUSEWAY), FROM THE EAST END OF WATSON ISLAND TO THE WEST END OF EAST CHANNEL BRIDGE FOR AN ADDITIONAL COMPENSATION OF $37,500, PAID BY FOOT TO THE CITY OF MIAMI BEACH. WHEREAS, the Florida Department of Transportation (FOOT) has landscaped the State Road AlA (Mac Arthur Causeway) from the east end of Watson Island to the west end of the East Channel Bridge; and WHEREAS, the City and FOOT entered into a Memorandum of Agreement (Agreement) in March of 1995 for the City to maintain the landscaping on the Mac Arthur Causeway; and WHEREAS, the FOOT has agreed to compensate the City $37,500 per quarter, for a total of$150,000 per year, for the cost of the City maintaining said landscaping, pursuant to the existing Agreement; and WHEREAS, the FOOT has asked that the City extend the existing Agreement for three more months to have the next one year renewal option concurrent with the agency's fiscal year; and WHEREAS, the FOOT will compensate the City an additional $37,500 for said extension period; and WHEREAS, the Agreement is in its final year and will expire on June 30, 1998; and WHEREAS, the FOOT has indicated its intent to develop a new agreement to take effect on July 1, 1998. NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City Commission hereby authorize the Mayor and City Clerk to execute a three month extension of the current Memorandum of Agreement with the Florida Department of Transportation (FOOT) for the maintenance of the landscaping for State Road AlA (Mac Arthur Causeway) from the east end of Watson Island to the west end of East Channel Bridge, for an additional compensation of$37,500, to be paid by the FOOT to the City. ADMINISTRA TION RECOMMENDATION: Adopt the Resolution. r BACKGROUND: On July 13, 1994, the City approved a Memorandum of Agreement with FDOT to provide for maintenance oflandscaping along the Mac Arthur Causeway from the east end of Watson Island to 5th Street. In accordance with this agreement, FDOT pays to the City $150,000 annually, for landscape maintenance of the area. The City subsequently bids the services stipulated in this Agreement to a private landscape maintenance company. There is currently an agreement for these services with Recio and Associates, Inc, in an annual amount of $98, 134.90. This agreement was approved by the City Commission on September 26, 1996, and is renewed annually, for a second and third year, at the City's discretion. The current Memorandum of Agreement with FDOT expires on March 31, 1998. FDOT has requested that the city extend the current Agreement until June 30, 1998 to coincide with their agency's Fiscal year. At the conclusion of this extension (June 30, 1998), the Memorandum of Agreement will expire. Prior to the expiration of this extension, it is the Florida Department of Transportation's stated intention to prepare a new agreement with the City of Miami Beach that will coincide with the beginning and ending dates of the FDOT fiscal year. The appropriate legislation to enter into a new agreement will be submitted to the Commission for approval prior to the expiration of this three month amendment. 62 AGENDA ITEM C. 1 E:.. DATE~ ANALYSIS: Approval of the amendment is necessary to ensure the funding is in place to continue the ongoing maintenance in this area and allow any future contract period to coincide with the FOOT fiscal year. CONCLUSION It is recommended that the City Commission adopt the attached resolution authorizing the extension of the agreement with FOOT in order to provide for continued maintenance of the landscaping on the Mac Arthur Causeway.
