A RESOLUTION OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA, AUTHORIZING THE CITY MANAGER
TO SUBMIT AN APPLICATION TO THE MIAMI-
DADE COUNTY OFFICE OF AMERICANS WITH
DISABILITIES ACT, TO RECEIVE A GRANT
AWARD FOR FISCAL YEAR 1999-2000, IN THE
AMOUNT OF $106,643.81; TO EXECUTE THE
GRANT AGREEMENT, IF AWARDED; AND TO
APPROPRIATE THE FUNDS WHEN RECEIVED.
WHEREAS, in July 1990, the American with Disabilities Act (ADA) was
passed by Congress, and Title II of the ADA requires that state and local
governments provide accessibility to their programs and that they do not
discriminate in the provision of employment, goods, services and/or programs, on
the basis of a person's disabilities; and
WHEREAS, as required under Title II of the ADA, the City has
developed a Transition Plan, which describes the facilities owned and/or
controlled by the City and the architectural barriers found in these facilities; and
WHEREAS, the Miami-Dade County Office of ADA Coordination has
grant funds available to assist municipalities in their compliance with ADA
requirements; and
WHEREAS, funds to be received by the City under this grant may be
used to fund the Citywide ADA compliant curb ramp construction program,
acquire additional beach access wheelchairs, pay for the sign language interpreters
and other modifications to City facilities to remove architectural barriers; and
WHEREAS, plans for the expenditure ofthe funds under this grant were
done in consultation with the City's Barrier Free Environment Committee.
NOW, THEREFORE BE IT RESOLVED BY THE MAYOR AND
CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that
the Mayor and City Commission authorize the City Manager to submit an
application to the Miami-Dade County Office of Americans with Disabilities Act,
to receive a grant award for fiscal year 1999-2000, in the amount of $1 06,643.81 ;
to execute the grant Agreement, if awarded; and to appropriate the funds when
received.

r am pleased to tell you that $ 106.643.81 in disabled permit parking fine money is
available for the city of Miami Beach this year To obtain the money. you must submit
an eligible proposal by May 1, 2000.
In accordance with State Law and Section 30-447 of the Code of Miami-Dade County.
parking fine money generated from the misuse of specially marked spaces for people
with disabilities is to be used in the following manner'
(1) One-third of the money is to be used to defray administrative expenses of the
Office of the Clerk of the Courts. and
(2) Two-thirds of the money is to be Llsed to provide funds to improve accessibility
and equal opportunity to Cjualiti.ed physically disabled persons and to pro\'ide
funds to conduct public awareness programs concerning physically disabled
persons.
The two-thirds shall be distributed in the following manner.
Thirty (30) percent is to be retained by the County for county-wide purposes, in
accordance with State law, and seventy (0) percent is to be allocated to the
governmental entity having jurisdiction over the violation.
To be eligible to receive funds each partIcipating city. including the Unincorporated
i\:lunicipal Service Area (lT1\1SA) is required to submit a program plan thar would assure
that these funds would be used in accordance \vith State law. I\loney not distributed to a
city because of the failure of such city to submit or comply with a program plan shall be
placed in a fund for dIsbursement to other complying cities in proportion to the
percentage of paid citations each has issued.

The Commission on Disability Issues (COOl) and the Miami-Dade League of Cities
developed and approved criteria detailing the proper use of these funds in accordance
with State law.
Expenditures must meet the following criteria:
( 1) Each party shall illustrate a maintenance of effort related to providing accessible
programs. services and activitie5 to people with disabilities; disabled parking fine
money shall not substltute for other money allocated for such use;
(2) Each party shall create an advisory council composed of persons representing a
broad range of disabilities who shall provide input as to the use of the funds:
(3) Eligible projects or programs that are mandated by federal, state, or local law,
must be matched by the parties in at least an equal amount by other funding.
Other eligible projects or programs may be funded up to 100 percent by disabled
permit parking fine money:
(4) If only a portion of the project or program is being promoted to benefit people
with disabilities, then only that portion of the project or program may be funded
with these monies:
( 5) The parties are subject to the uniform mInimum standards for County-wide
applicatlon. assessment, monitoring and management evaluation and performance
review for organizations providing community services as specified by
Administrative Order 3 -15, and
(6) Funding is contingent upon proper completion and reporting of previous programs
or projects.
A 1-vards to municipalities are based on a percentage of total revenue that is determined bv
calculating the total amount paid on tickets in a municipality divided by the total numb~r
or tickets paid county-wide. Funding estimates include J. percentage or the spillover
moneys that were not distributed to any municipalities in the previous year.
The deadline for submission of proposals is May 1, 2000. The Office of ADA
Coordination vv'ill review the proposals with recommendations from COOL
If your municipality received funding during the 1998-99 riscal year you must submit a
year-end report in accordance with the terms of the interlocal agreement including all
supporting documentation. Reports are currently due.

enforcement should help generate more funds available to your municipality in the future.

ADMINISTRATION RECOMMENDATION:
Adopt the Resolution.
ANALYSIS:
The American with Disabilities Act (ADA) was signed into law in July 1990 and went into effect
in July 1992. Under Title II of the ADA, state and local governments are required to provide
accessibility to their programs and not discriminate in the provision of employment, goods, services
on the basis of a person's disability. As required by law, the City developed a plan to eliminate
architectural barriers from City-owned facilities and took action to make its programs and services
accessible to persons with disabilities. The Barrier-Free Environment Committee plays an important
role in monitoring and advising the Administration on project priorities. To comply with the law,
funds were appropriated by the Commission to modify City-owned facilities and to remove
architectural and communication barriers.
In addition to its own resources, an ADA grant is made available by the County for the City to apply
to ADA compliance projects. In accordance with State Law and Section 30-447 of the Code of
Miami-Dade County and in accordance with the terms of an interlocal agreement between the City
and the County, the City is eligible to apply for a portion of the money generated from fines for the
illegal use of handicapped parking spaces. Under this agreement, the City may use this fund for
eligible projects or programs that are mandated by federal, state or local law. As required in the
agreement, the City must provide matching funds for at least an equal amount for all eligible
projects. A plan for the expenditure of this grant in the amount of$106,643.81 was coordinated with
the members of the Barrier-Free Environment Committee who approved the plan unanimously in
their regular meeting of Monday March 27,2000 (Attachment 1).
