RESOLUTION NO. 2000-23862
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AMENDING THE EXISTING
CONTRACT WITH R J. HEISENBOTTLE P. A. ARCHITECTS, IN THE
AMOUNT OF $2,000.00, AND WITH McCARTNEY CONSTRUCTION
COMPANY, IN THE AMOUNT OF $35,979.36, RESPECTIVELY; AND
APPROPRIATING ADDmONAL FUNDING, IN THE TOTAL AMOUNT OF
$37,979.36, TO THE AFORE STATED CONTRACTS FOR ADDITIONAL
HISTORIC RENOVATION WORK IN THE COMMON AREAS ON FLOORS
3-8 OF HISTORIC CITY HALL; AND FURTHER APPROVING CHANGE
ORDERS #1, #2, #5, #6, AND #8 WITH McCARTNEY CONSTRUCTION
COMPANY, TO BE PAID FROM THE ADDITIONAL FUNDING; FOR THE
HISTORIC RENOVATIONS OF HISTORIC CITY HALL.
Whereas, on May 12th 1998, the City issued a purchase order to R.J. Heisenbottle P.A
Architects under its rotational architects agreement for the design, development , and construction
documents for a limited historic and ADA renovation to the Historic City Hall Building located at
1130 Washington Avenue, Miami Beach, Florida; and
Whereas, on March 17,1999, the Mayor and City Commission approved a construction
contract with McCartney Construction Company in the amount of $492,395, pursuant to Bid No. 26-
98/99; and
Whereas, during the construction phase, unforseen conditions were found that required
correction to comply with South Florida Building Codes; and
Whereas, the Administration is requesting the use of the existing contracted architect and
general contractor to provide for a consistency of finishes for additional historic renovation work in
the common areas on Floors 3-8 of the Historic City Hall Building; and
Whereas, additional funding in the amount of $37,979.36, is required beyond the original
Project budget in order to cover the above Change Orders, architectural services and additional
historic renovation work.
NOW, THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission herein amends the existing contract with R. J. Heisenbottle P. A Architects, in the
amount of $2,000,00, and with McCartney Construction Company, in the amount of $35,979.36,
respectively; and appropriate additional funding, in the total amount of$37,979.36, to the aforestated
contracts for additional historic renovation work in the common areas on Floors 3-8 of Historic City
Hall; and further approve Change Orders #1, #2, #5, #6, and #8 with McCartney Construction
Company, to be paid from the additional funding; for the historic renovations of Historic City Hall.

Phil Shor researched the floor sealing. We only had the first floor in our bid and we could not understand
why we bid the project this way. We found Addendum # 1, sent out by the City's Procurement Dire(:tor,
clarified what was to be sealed. On Page 2 it clearly states clay tile conditioning at ground floor inte:rior,
existing.

$2,000.00 AND WITH McCARTNEY CONSTRUCTION COMPANY FOR
$35,979.36 AND APPROPRIATING THE ADDITIONAL FUNDING IN THE
TOTAL AMOUNT OF $37,979.36 TO THE CONTRACTS FOR
ADDITIONAL HISTORIC RENOVATION WORK IN THE COMMON
AREAS ON FLOORS 3-8 OF OLD CITY HALL AND APPROVAL OF
CHANGE ORDERS #1, #2, #5, #6, AND #8 WITH McCARTNEY
CONSTRUCTION COMPANY, TO BE PAID FROM THE ADDITIONAL

ANALYSIS:
On May 12, 1998, the City issued a purchase requisition to R. ], Heisenbottle P.A. Architects under
the rotational architect contract agreement with the City, for the design, development, and
construction documents for a limited Historic and ADA renovation to the Old City Hall Building, On
March 17, 1999, the City Commission approved the award of a contract with McCartney
Construction Company in the amount of $492,395, pursuant to bid # 26-98/99 for the Historic and
ADA renovations of the Old City Hall Building. Notice to Proceed with construction of the project
was given on April 22, 1999. Funding for the project was available through a State Historic
Renovation Grant, Capital Projects Fund #351, and a Miami-Dade County ADA grant. No
contingency funds were included in the original contract or funding sources for any unforseen
circumstances on the project.

During the demolition portion ofthe project, the contractor found multiple Fire Code violations that
had been left from the 1987 refurbishment project of the building, These included plumbing chases
that had not been fire sealed at each floor level, and existing doors to the stairways that were not fire
rated as required by Code. In addition, existing electrical conduits found above the existing ceilings
had to be relocated to comply with the historic design requirements of the building and the air
conditioning equipment located above the existing ceilings had to be re-secured due to deterioration
of the existing hanging straps.
On March 15, 2000, a meeting was held to discuss the required change orders and the associated
costs. The meeting included representatives from R. 1. Heisenbottle, McCartney Construction, and
Property Management. Of the $27,268,36 in submitted change order requests made by McCartney
Construction, only $9,284.36 was agreed upon as unforseen conditions or work beyond the scope
of the original contract. The $9,284.36 is the change order funding requested in this resolution and
represents change order #1, #2, #5, #6, and #8.
During the construction project, R. 1. Heisenbottle also provided paint specifications for the walls and
doors finishes in the common areas of the 3rd through 8th floors of the building. Additionally, R. 1.
Heisenbottle provided specifications for the historic floor curbs on these floors as well as carpet
specifications to match the historic finishes of the building. Because of the unique historic paint
requirements needed to match the wall colors in the restored lobby, McCartney Construction was
requested to provide estimates for the additional work. The quotes for the additional work are as
follows:
1) Historic painting of the common area lobbies on floors 3-8
a. Prime walls with two coats of paint
b. Install historic glaze, single color as selected from 1 st floor lobby color. Specifications
to match 1 st Floor Lobby.
c. Paint lobby side of three hollow metal doors per floor, solid color.
d. Faux Paint three hollow metal frames in each floor lobby with wood grain finish.
e. Faux Paint two elevator jambs per floor with wood grain finish.
f. Work includes minor patching of existing plaster.
Price per floor = $2,052 Total Item #1 for floors 3-8 = $12,312.00
2) Faux Painting existing concrete curbs and cove base.
a, Concrete stripping and preparation.
b. Faux Painting process.
Price per floor = $420,00 Total Item #2 for floors 3-8 = $ 2,520.00
3) Custom Carpet
a. Remove existing carpeting and floor preparation.
b. Install Masland Agenda custom carpet on floors 3-8 as per architect's specifications,
Price per floor = $1977.17 Total Item #3 for floors 3-8 = $11,863.00
4) Additional services of R. J. Heisenbottle Architects for construction administration of work
performed for the typical common area lobbies on floors 3-8 as per work outlined above:
Lump sum price = $2,000.00
The total funding requests for historic renovation work for all listed items on floors 3-8 including
related architectural services = $28,695.00.
As per the Commission's directive that all renovation work performed in the Historic City Hall
Building be submitted to Design Review and Historic Preservation for approvals of appropriateness
for the historic building, R. 1. Heisenbottle provided samples and color boards for this review. The
City's Planning Department has approved all items in this request as appropriate for the Historic City
Hall Building.
CONCLUSION:
Due to the unique nature and speciality of historic renovation work and the craftsmanship required
and the need to provide a consistent match with the new first floor lobby finishes, the Administration
recommends that the current contracts with McCartney Construction Company and R. J.
Heisenbottle be amended to reflect the additional historic renovation work requested and the required
funding requirements ($28,695) be approved as outlined in this resolution for additional historic
renovation work. The Administration also recommends the approval of funds ($9,284.36) to
McCartney Construction Company to cover change order #1, #2, #5, #6, and #8 as outlined in this
resolution. The total requested funding for both items is $37,979.36.
