99-23397 RESO RESOLUTION NO. 99-23397 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, DECLARING A CITYWIDE PARKING EMERGENCY FOR THE MILLENNIUM WEEKEND OF DECEMBER 31,1999, ALLOWING FOR THE USE OF VACANT SURF ACE LOTS FOR PARKING CITYWIDE AND FURTHER AUTHORIZING THE CITY MANAGER TO EXTEND THE EMERGENCY FOR ADDITIONAL DATES ASSOCIATED WITH THE MILLENNIUM WEEKEND. WHEREAS, the City of Miami Beach has experienced parking shortages during major events such as NFL Weekend 1999, the Boat Show, Graphics of the Americas, and the Auto Show; and WHEREAS, there are multiple events scheduled on Miami Beach in celebration of the Millennium, and the Administration has determined that there will be a severe parking shortage for the Millennium Weekend of December 31, 1999; and WHEREAS, during some weekends throughout the year, severe parking shortages lead to mobility problems and ultimately gridlock on our City's roadway system; and WHEREAS, the creation of additional parking opportunities for visitors to the City during high impact events, coupled with an enhanced Electrowave circulator program, will alleviate the mobility problems and gridlock anticipated during the multi-event weekend of the Millennium. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MAIMI BEACH, FLORIDA, that the Mayor and City Commission declare an emergency parking situation for the Millennium Weekend of December 31, 1999 through January 2, 2000, and authorize the use of vacant surface lots Citywide to be utilized for valet parking and self-parking. SHORT TERM PAR(<ING AGREEMENT This Short Term Parking Agreement, is made as of this ~day of December, 1999, by and between the CITY OF MIAMI BEACH (City) and PORTOFINO GROUPt INC. (Portofmo). 1. TERMS AND AGREEMENT The parties hereto agree and acknowledge that the upcoming proposed MillelUlium celebrations are expected to place a particular burden on the City of Miami Beach's infrastructure; especially with regard to increased traffic and parking demands as a result of the anticipated unusually large number of local visitors, as well as tourists, to the area To that end, in order to address and minimize the disturbance to the City's residents and visitors, the City and Portofino agree to enter into the following Short Term Lease Agreement wherein the City agrees to lease the following lots, owned by Portofmo as described in Exhibit "A" attached hereto (collectively, the Lots), to manage and operate short term parking facilities. The City's authorized use of the Lots is for the sole purpose of management of the City's parking operation and, in this case, to provide additional parking to accommodate the anticipated increase in traffic and vehicles in the City for the Millenniwn weekend. Accordingly, throughout the Term of this Agreement, the City will provide, at its sole cost and expense, the necessary staffing, as it deems appropriate. in its sole discretion, for collection of parking fees; security, as it deems appropriate and at the City's sole discretion; and daily routine for cleaning oftrnsh and debris during homs of operation. This Short Term Parking Agreement shall commence on December 31, 1999, and terminate at 12:01 a.m. on January 2, 2000. 2. RENT At the commencement oithe Term of this Agreement, the City shall pay Portofmo a flat fee. in the amount of $5tSOO, for use of the aforestated Lots. Payment of rent shall be made to Portofino Group, Inc_ at 404 Washington Avenue, Suite 120, Miami Beach, Florida 33139. 3. TERMINATION Either party may terminate this Agreement for cause in the event that the breaching party violates any of the tenns and conditions of the Agreement as set forth herein. 4. ASSIGNMENT The City shall not be authorized to assign this Agreement to any other party. 5. LAWS, REGULA TIONS~ PERMITS The City shall comply with all applicable statutes, ordinances, rules, orders, regulations, and requirements of the City, Federal, State, and County agencies. Ifrequired, and so requested by Portofmo in writing prior to the commencement of this Agreement, the City shall provide proof of compliance with applicable required licenses, permits, and other legal requirements, prior to the execution of this Agreement. 6. ~SURANCE Prior to the commencement of this Agreement, the City shall furnish Portofmo with proof of self-insurance; said self insurance covering the City's proposed operation on the Lots. 7. RIGHT OF ENTRY Porto fino, or any of its agents or representatives, shall have the right to enter upon the Lots during all working hours during which the City operates same, to examine the Lots and monitor condition of same. 8. SECURITY If the City determines, at its sole discretion and determination, that security is required on all or a portion of the Lots. the City shall provide such security presence on site during time of its parking operation, and it is further expressly agreed and understood that Portofino shall in no way be or assume responsibility for the personal safety of the City's employees, invitees or any other person entering the Lots in connection with this Agreement, as well as any equipment or personal property brought into the Lots whether as a result of loss, theft, damage or any other type of casualty which may occur. 9. MAINTENANCE The City sha1J. at its sole cost and expense, maintain the Lots in a clean and sightly condition, not allowing refuse or debris to accumulate. Prior to commencement of the Agreement, Portofmo shall mow and clean the Lots of any refuse or debris, and the City and Porto fino shall make a joint inspection of the Lots to assess and determine the condition of same prior to the City taking possession pursuant to this Agreement. At the expiration or other termination of this Agreement, the Lots shall be in substantially the same condition in which the City found them except for reasonable wear and tear, or other natural disaster. 2 10. NQTICES All notices, requests, demands, consents, approvalSl and other communication which are required to be served or given hereunder shall be in writing and shall be hand-delivered to the appropriate party to receive such notices as follows: To CITY: Lawrence A. LIMIT A nON OF Ll~B{LITY The City desires to enter into this Agreement only if in so doing the City can place a limit on the City's liability for any cause of action for money damages due to an alleged breach by the City of this Agreement, so that its liability for any such breach never exceeds the sum of$5AOO. Portofino hereby expresses its willingness to enter into this obligation imposed upon the City by this Agreement Nothing contained in this paragraph or elsewhere in this Agreement is in anyway intended to be a waiver of the limitation placed upon the City's liability as set forth in Florida Statutes, Section 768.28. 12. VENUE This Agreement shall be enforceable in Miami-Dade County, Florida, and if legal action is necessary by either party with respect to the enforcement of any or all of the terms or conditions herein exclusjve venue for the enforcement of same shall lie in Miami-Dade County. RECOMMENDATION Adopt the Resolution. ANALYSIS The City of Miami Beach has experienced parking shortages during major events such as NFL Weekend 1999, the Boat Show, Graphics of the Americas and the Auto Show. There are multiple events scheduled on Miami Beach in celebration of the Millennium, and the Administration has determined that there will be a severe parking shortage for the Millennium Weekend of December 31, 1999. During Some weekends throughout the year, severe parking shortages lead to mobility problems and ultimately gridlock on our City's roadway system. This fact was most recently experienced during NFL Weekend 1999. The creation of additional parking opportunities for visitors to the City during high impact events, coupled with an enhanced Electrowave circulator program, will alleviate the mobility problems and gridlock anticipated during the multi-event weekend ofthe Millennium. The Administration has developed a list of vacant lots that could be available for use during the Millennium Weekend to alleviate the severe parking shortage anticipated Citywide. Many of these lots have been used successfully in the past to accommodate parking during high impact events. The attached list is provided as an overview oflots recommended for use as either valet or self parking during Millennium Weekend. It is anticipated that the operating hours for valet/self parking will be from 6:00 P.M. to 6:00 A.M., and hotel/employee parking will be 24 hours. Afi:he City Commission meeting of October 20, 1999, the Mayor and Members of the City Commission requested the city to review the proposed sites, reflect the anticipated use and hours and assure disturbance to neighborhoods from operations in the proposed lots would be limited. The Administration has amended the parking plan to eliminate the use of the "Beach Parcel" and to limit the use of the St. Francis site parking garage for hotel employees only. The attached lot list defines the potential uses and hours of operation of the proposed list of parking lots for approval for use during the Millennium Weekend. AGENDAITEM~ DATE~ The Mayor and City Commission should declare an emergency parking situation for the Millennium Weekend of December 31, 1999 through January 2, 2000; and authorize the use of vacant surface lots Citywide to be utilized for valet parking and self-parking. The Administration further requests that the Mayor and City Commission authorize the Manager to require all parking operators to secure the appropriate insurance and Occupational Licenses required by City Code to operate self-parking and/or valet parking operation, but to not require that the lots be physically improved as required by code for use as valet or self-parking lots during the Millennium Weekend.
