CITY OF MIAMI BEACH, FLORIDA RATIFYING THE MIAMI BEACH
REDEVELOPMENT AGENCY'S (RDA) ACTION APPROVING AN

FORTH IN THE SOUTH POINTE STREETSCAPE MASTER PLAN
WHEREAS, funding has been appropriated from South Pointe Tax Increment Funds for the
South Pointe Streetscape Master Plan (Master Plan); and
WHEREAS, funding for Phase I of the Master Plan, in the amount of $3,800,000, was
appropriated at the September 23, 1998 Miami Beach Redevelopment Agency (RDA) meeting;
and
WHEREAS, the Master Plan requires that the overhanging utility lines at streets with an ocean
view (those located east of Collins Avenue) be placed underground; and
WHEREAS, this scope of work is to be performed in preparation for the road improvement work
on each street; and
WHEREAS, Phase I of the Master Plan includes the improvements on Washington Avenue, from
the south edge of Fifth Street to South Pointe Park, and on Third Street, from Michigan Avenue
to Ocean Drive; and
WHEREAS, within the scope of work for Phase I, existing utility lines crossing 1bird Street need
to be placed underground; and
WHEREAS, this work is expected to be performed within the next 120 days; and
WHEREAS, in coordination meetings with representatives of Florida Power and Light (FPL),
226 Ocean Drive, Ltd., as owner of the property located at 225 Collins Avenue/226 Ocean Drive,
is proposing to partially fund and place the utility lines crossing its proposed development site
underground; and
WHEREAS, the site is located between Second and Third Streets, and between Ocean Drive and
Collins Avenue, and the affected utility lines run through Ocean Court, the alley; and
WHEREAS, in the Master Plan, Ocean Court is part of Phase IV and, consequently, estimated
to commence within 18 to 24 months; and
WHEREAS, however, the Engineering Department ofFPL has estimated the cost of placing the
electrical lines underground at both locations (Ocean Court and Third Street) and, by performing
the work at the same time, achieve economies of scale; and
WHEREAS, FPL has submitted a guaranteed estimate of the total cost of this scope for a total
amount not-to-exceed $37,383.00; and
WHEREAS, based on the above, the Administration recommends the RDA and 226 Ocean
Drive, Ltd. share the cost of the proposed underground placement of the electrical utility lines
from north of Third Street to south of Second Street.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission herein ratify the Miami Beach Redevelopment Agency's (RDA) action in approving
an Agreement among the RDA, FPL and 226 Ocean Drive, Ltd., as owner of the property located
at 225 Collins A venue/226 Ocean Drive, to provide underground utilities on Ocean Court,
between Second and Third Streets, for an amount not-to-exceed $37,383.00; of which $17,636.50
is to be paid by the Miami Beach Redevelopment Agency, and $19,746.50 is to be paid by 226
Ocean Drive, Ltd., pursuant to the scope of work set forth in the South Pointe Streetscape Master
Plan.
PASSED AND ADOPTED this 12th day of January, 2000.

FUNDING:
Funding has been appropriated from South Pointe Tax Increment Funds for the South Pointe

utilities on Ocean Court, between Second and Third Streets, for an amount not-to-exceed
$37,383.00; of which $17,636.50 is to be paid by the Miami Beach Redevelopment Agency, and
$19,746.50 is to be paid by 226 Ocean Drive, Ltd., pursuant to the scope of work set forth in the
South Pointe Streetscape Master Plan.

UNDERGROUND FACILITIES CONVERSION AGREEMENT
This Agrcr::ment, made and entered into this 9 th day of February, 2000, by and between the Miami Beach
~developmcnt~ency and 226 Ocean Drive Limitcq (hereinafter called the Applicants) and Florida Power &
Light Companv, a corporation organized under the laws of the State of Florida (herein~er called FPL) is forme
pro'lision of underground electric distribution facilities by FPL in place of certain existing overhead electric
distribution facilities pursuant to the Applicants' request for such f.u:ilities. In consideration of the premises,
covenants and agreements set forth herein, FPL and the Applicants agree as follows:
1. The Applicants shall pay FPL a Contribution-in-Aid--ofConstIUction (CIAC) in the amount oiS 37,383_00,
with $17,636.50 to be paid by the Miami Beach Redevelopment Agency and $19746.50 to be paid by 226
Ocean Drive Limited. The cost is valid until July 3,2000.
2. Pursuant to this Agreement, the Applicants agree to comply with and abide by the requirements, teoos, and
conditions ofFPL's Electric TlU'iff. as tho,e;e req"ireme1Jtc:, tenns i'..!ld conditions are set forth in said Tariff.
3. Upon compliance with the requirements, tenns an,: C01!C:iitions of FPL I sElectric T arifi, and this Agreement,
FPL will proceed in a timely manner with the conversion of the existing overhead distribution lines to an
underground configuzation in accordance with the construction drawings and specifications set forth in
Attachments A and B hettOf. Note that the FPL overhead distribution lines will be removed between the
poles number I through 4 as shown on AttaChment A. but that all poles and overhead service laterals, except
at location number 2, will remain. The Applicants arc n:sponsible for making arrangements with the other
utilities on the poles if they would like their tacilities n:moved or placed underground.
4. 226 Ocean~Drive Limited, as the owner of22j Collins Avenue, must provide FPL with::L recorded
easement, at the owner's e.'"Cpcnse, for the pad-mounted transformers, handhole, and underground ducts
necessary for the conversion of the lines to underground, as shown on Attachment B. They also must
artange fer the conversion of the overhead service entrance at 221 Collins Avenue to underground at their
e:ocpense.
j. The City of Miami Beach Public Works Department shall issue FPL a permit to do the necessary work that
is within the City Right.:ofWay.
6. Failure by the Applicants to comply with any of the requirements, terms, or conditions of this Agreement or
FPL's Electric Tariff shall result in termination of this Agreement. The AppIicant(s) roilY tennina.te this
Agreement without C4WSe and for their convenience at any time prior to the start of construction, and the
ClAC paid by the Applicants will be refunded to the Applicants, provided however, that the refund of the
CIAC shall be offsct by any COstS incurred by FPL in performing under the agreement up to the date of
tenninarion.
7. This Agreement is not assignable.
IN WITNESS WHEREOF, FPL and the Applicants have executed this Agreement for the provision of electric
underground distribution facilities to be effective 41S of the date first above written.
