A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, APPROVING, ON FIRST READING, A LEASE AGREEMENT
BETWEEN THE CITY AND SUNRISE COMMUNITY, INC., FOR USE OF
APPROXIMATELY 2,500 SQUARE FEET OF CITY-DWNED PROPERTY, LOCATED AT
8128 COLLINS AVENUE (ON THE WEST SIDE OF COLLINS AVENUE BETWEEN 81sT
AND 82ND STREETS) FOR THE PURPOSE OF OPERATING AND MANAGING A
VOCATIONAL TRAINING SITE FOR DEVELOPMENTALLY DISABLED ADULTS, SAID
LEASE HAVING AN INITIAL ONE (1) YEAR TERM, COMMENCING RETROACTIVELY
ON SEPTEMBER 1, 2005, AND ENDING ON AUGUST 31, 2006, WITH TWO (2)
ADDITIONAL ONE (1) YEAR RENEWAL TERMS, AT THE CITY'S SOLE DISCRETION;
FURTHER WAIVING BY 5/7THS VOTE, THE COMPETITIVE BIDDING AND
APPRAISAL REQUIREMENTS, AS REQUIRED BY SECTION 82-39 OF THE MIAMI
BEACH CITY CODE, FINDING SUCH WAIVER TO BE IN THE BEST INTEREST OF
THE CITY; AND FURTHER SETTING A PUBLIC HEARING ON JULY 12, 2006, FOR
THE SECOND READING (AND FINAL APPROVAL) OF THE LEASE AGREEMENT
WHEREAS, the City had been providing services for the developmentally disabled at the
City-owned commonly referred to as the Log Cabin Training Center, located at 8128 Collins Avenue,
from 1975 until 2005; and
WHEREAS, on March 10, 2005, the City issued Request For Proposals, No. 12-04/05 to
identify a qualified provider to ensure the continued provision of services to the developmentally
disabled population served at the Log Cabin Training Center (the RFP); and
WHEREAS, on July 6, 2005, the Mayor and City Commission selected Sunrise
Community, Inc., as the top ranked firm pursuant to the RFP; and
WHEREAS, the Administration was authorized to negotiate an agreement with the Sunrise
Community, Inc.; accordingly, the Administration recommended that a lease be negotiated for the
City-owned building, located at 8128 Collins Avenue, encompassing approximately 2,500 square
feet (the Property); and
WHEREAS, the Administration would hereby recommend that the Mayor and City
Commission approve the attached Lease Agreement on first reading, and hereby set the public
hearing for second reading and final approval of the Agreement; and
WHEREAS, Section 82-39, as amended, further provides for the waiver of the competitive
bidding and appraisal requirements, by 5/7ths vote of the Mayor and City Commission, upon a
finding by the Mayor and City Commission that the public interest would be served by waiving such
conditions; the Administration would also hereby recommend that the Mayor and City Commission
approve said waiver.
NOW, THEREFORE, BE IT DULY RESOLVED BYTHE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve,
on first reading, the attached Lease Agreement between the City and Sunrise Community, Inc., for
the use of the one story building located at 8128 Collins Avenue, encompassing approximately
2,500 square feet of City-owned property, for the purpose of operating and managing a vocational
training site for developmentally disabled adults, for an initial term of one (1) year, commencing
retroactively on September 1,2005, and ending on August 31,2006, with two (2) additional one (1)
year renewal terms, at the City's sole discretion; further waiving, by 5/7ths vote, the competitive
bidding and appraisal requirements, as required by Section 82-39 of the Miami Beach City Code,
finding such waiver to be in the best interest of the City; and further setting a public hearing on July
12,2006, for the second reading (and final approval) of the Lease Agreement.

Item Summary/Recommendation:
On March 10, 2005, the City issued a Request for Proposal (RFP) to assume the administration and
management of the Log Cabin Training Center and its various programs. The City-owned building
located at 8128 Collins Avenue, Miami Beach, Florida, provides a variety of vocational training
services for developmentally disabled adults. The Sunrise Group, Inc. submitted the first-ranked
proposal to a Request for Proposal (RFP).
On July 6th, 2005, the City Commission approved the Administration's recommendation to proceed
with an agreement with The Sunrise Group, Inc. However, after careful consideration and extensive
review, the Administration is recommending a lease agreement instead of a management agreement
as they are not only taking over the program but also are currently occupying a City owned building.
Additionally, Exhibit 2 of the lease includes specific language to ensure that existing programming
and services remain the same and delineates the Development Services Monitoring by the City.
The Sunrise Group, Inc. will pay the City $600 per month ($7,200 per year) plus fixture rentals of $450
per month ($5,400 per year) and will be responsible for the operating expenses and interior/exterior
building maintenance for the sole purpose of providing vocational training programs and support
services (defined as Adult Day Training, Supported Employment, and Supported Living in the State of
Florida Medicaid Waiver Services Manual).

Adopt the Resolution.
ANALYSIS
The City of Miami Beach established and maintained the Log Cabin Training Center from
1975 through 2005 as a service of the City designed to provide vocational training and
support for developmentally disabled adults. The Center houses three programs: Adult Day
Training (ADT), Supported Employment (SE) and Supported Independent Living (SIL).
On March 10, 2005, the City issued a Request for Proposal (RFP) to assume the
administration and management of the Log Cabin Training Center and its various programs.
The City-owned building located at 8128 Collins Avenue, Miami Beach, Florida, provides a
variety of vocational training services for developmentally disabled adults. The Sunrise
Group, Inc. submitted the first-ranked proposal to a Request for Proposal (RFP).

On July 6th, 2005, the City Commission approved the Administration's recommendation to
proceed with an agreement with The Sunrise Group, Inc. However, after careful
consideration and extensive review, and in light of their occupancy of a city-owned facility,
the Administration is recommending a lease agreement instead of a management
agreement. The lease agreement incorporates the Scope of Services requested in the RFP.
Exhibit 2 of the attached lease includes specific language to ensure that existing
programming and services remain the same and delineates the Development Services
Monitoring by the City. Pending the formulation and approval of this lease agreement, the
Sunrise Group, Inc. has paid rent through March 2006. The Sunrise Group, Inc. will bring
the payments up-to-date upon execution of the attached lease agreement.
A companion lease agreement for the Log Cabin Enterprises, Inc., a nursery, is also being
submitted to Commission for consideration and approval. This will allow the two entities to
remain independent due to the relationship of client and provider, while allowing the City the
benefit and protection of a lease agreement.
The Lease Agreement, as negotiated, includes the following additional terms and conditions:
· BASE RENT:
The Sunrise Group, Inc. will pay an annual Base Rent in the amount of Seven
Thousand Two Hundred Dollars ($7,200).
· ADDITIONAL RENT:
The Sunrise Group, Inc. will pay annual furniture and fixtures rent in the amount of
Five Thousand Four Hundred Dollars ($5,400).
· OPERATION, MAINTENANCE and REPAIR:
The Log Cabin Enterprises, Inc. has agreed to be solely responsible for the
operation, maintenance, and repair of the premises.
· TENANT RESPONSIBILITIES FOR UTILITIES:
The Sunrise Group, Inc. has agreed to pay charges for water, gas, electricity, sewer,
cable, telephone and any other utility service provided to the facility including, without
limitation, all hookup fees and impact fees.
CONCLUSION
Based on the recommendation of the Log Cabin Training Center Selection Committee, the
Administration recommends that the Mayor and City Commission approve the attached
Lease Agreement between the City and the Sunrise Group, Inc. for the use of the one story
building located at 8128 Collins Avenue, Miami Beach, Florida, encompassing approximately
2,500 square feet of City-owned property for a term of one year commencing retroactively on
September 1, 2005 and ending on August 31, 2006 with two additional one year renewal
terms, at the City's sole discretion; further waiving by 517ths vote, the competitive bidding
and appraisal requirements, as required by Section 82-39 of the Miami Beach City Code,
finding such waiver to be in the best interest of the City; and further setting a public hearing
