RESOLUTION NO. 2000-23833
A RESOLUTION OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA, AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE AMENDMENT NUMBER ONE
TO THE CONTRACT BETWEEN MIAMI-DADE
COUNTY AND THE CITY OF MIAMI BEACH,
FLORIDA PROVIDING FOR THE RENDITION OF
WATER SERVICE.
WHEREAS, the City purchases potable water wholesale from the Miami-Dade Water and
Sewer Department (MDWSD); and
WHEREAS, the current agreement between the City and MDWSD for the provision of
wholesale water supply services expires on March 21, 2000; and
WHEREAS, the City purchases approximately 7.5 billions gallons of water annually for
resale to retail customers; and
WHEREAS, the attached Amendment Number One provides for the provision of water
supply services from the MDWSD through January 31, 2004.
NOW, THEREFORE, BE IT DULY RESOLVED, that the Mayor and City Clerk are
hereby authorized to execute Amendment Number One to the contract between Miami-Dade County
and the City of Miami Beach, Florida providing for the rendition of water service.

CITY CLERK TO EXECUTE AMENDMENT NUMBER ONE TO THE
CONTRACT BETWEEN MIAMI-DADE COUNTY AND THE CITY,
PROVIDING FOR THE RENDITION OF WATER SERVICE.
ADMINISTRA TION RECOMMENDATION
Adopt the Resolution.
ANALYSIS
The City purchases potable water wholesale from the Miami-Dade Water and Sewer Department
(MDWSD). Water is supplied to the City through four large-diameter metered supply
interconnections with the MDWSD located at the MacArthur Causeway, Venetian Causeway, Julia
Tuttle Causeway and 71st Street Causeway. The City purchases approximately 7.5 billion gallons
of water annually for resale to retail customers.
The current agreement, dated March 21, 1995, between the City and MDWSD for the provision of
wholesale water supply services expires on March 21, 2000. The attached amendment to this
agreement is for the continuation of water supply services from the MDWSD through January 31,
2004.
The Administration recommends that the City Commission adopt the attached amendment in order
to continue the arrangement for water supply to the City from the County that has been in place for
almost 40 years.

THIS AMENDMENT, made and entered into this~day of ----.&fR-Ll-

by and between Miami-Dade County, a political subdivision of the State of Florida, hereinafter
referred to as the "COUNTY", and the City of Miami Beach a municipal corporation organized and
existing under the laws of the State of Florida, hereinafter referred to as the "CITY";
WIT N E SSE T H:
WHEREAS, On March 21, 1995, the COUNTY and the CITY entered into a contract
providing for rendition of water service by the COUNTY to the CITY, and
WHEREAS, the COUNTY and the CITY desire to make certain modifications to said
contract, and
WHEREAS, the Miami-Dade Water and Sewer Department referred to as the "Department",
operates and maintains the COUNTY's water system.

NOW, THEREFORE, in consideration of the mutual covenants and obligations set forth
herein, the COUNTY and the CITY hereby agree as follows:
1. Paragraph 25 of the Contract is hereby modified to read as follows:
25. This Contract shall be and remain in full force and effect until
January 31,2004.
2. Paragraph 3 of the Contract is hereby modified to include the following sentence:
3. This includes but is not limited to Chapter 62-555.360 of the
Florida Administrative Code requiring municipal utilities to have an
ordinance implementation a cross-connectionlbackflow prevention
program for their respective service area. Said ordinance shall include
a schedule for installing cross-connection/bacldlow prevention devices
for all businesses that represent a high risk of contamination to the
CITY's water supply.
3. Paragraph 4b of the Contract is hereby modified to read as follows:
4b. Venetian Causeway at San Marco Island
4. Paragraph 10 of the Contract is hereby modified to delete the following paragraph:
10. The water utilized by the Town of Surfside and the

Department's retail customers on Biscayne and San Marco Islands are
currently supplied through the CITY's water facilities. For the
purpose of computing the CITY's bill, the water consumption, as
measured by the Department's water meters for the Town of Surfside,
Biscayne Island and San Marco Island shall be deducted from the
CITY's total consumption. It is contemplated that the CITY may
transfer title to certain water mains which would allow the COUNTY
to serve Biscayne Island and San Macro Island directly and that the
Town of Surfside may obtain an alternate source of water. At those
times, the COUNTY shall modify its billings to the CITY to reflect
those revisions.
5. All terms and conditions of the Contract not specifically modified by this Amendment
shall remain in full force and effect.
