A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING
THE FIFTH AMENDMENT TO THE POLICE CONFISCATION
TRUST FUND FOR FISCAL YEAR 1997/98, IN THE
AMOUNT OF $ 9 4 , 400 , TO BE FUNDED FROM THE
PROCEEDS OF STATE CONFISCATED FUNDS.
WHEREAS, Section 932.705, Florida Statutes, addresses the
purposes and procedures to be utilized for the appropriation and
expenditures of the Police Confiscation Trust Fund; and
WHEREAS, the Chief of Police of the City of Miami Beach has
determined that the need for the appropriation and expenditures
exists and the appropriation and the expenditure of forfeiture
funds is in compliance with Section 932.705, Florida Statutes, and
with Federal guidelines; and
WHEREAS, such funds are available in the Police Confiscation
Trust Fund.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and
City Commission hereby adopt the Fifth Amendment to the 97/98
Police Confiscation Trust Fund Budget for the City of Miami Beach,
ln the amount of $94,400, as reflected in the attached Exhibit "A".

I, Richard Barreto, Chief of Police, City of Miami Beach, do hereby
certify that the aforementioned proposed request for expenditures
from the City of Miami Beach Police Confiscation Trust Fund, for
the 1997/98 fiscal year providing funds for expenditures as
indicated on Exhibit "A" complies with the provisions of Section
932.704(3) (a), Florida Statutes and federal guidelines.

POLICE CONFISCATION TRUST FUND
FIFTH BUDGET AMENDMENT
FISCAL YEAR 97/98
STATE FUNDS:
Additional funds required for the Construction and
Architectural/Engineering services of the Police
Department Report Control Center. The
MBPD has already appropriated a total $100,000
for this project. The lowest bid was in the
amount of $124,850 which does not include additional
Architectural/Engineering fees, alterations and improvements.
The renovations to RCC is needed to address officer safety
issues and comply with A. D. A.
Contribution to the Hispanic Community Center
for Teen Program. The purpose of this program is
to strengthen basic physical, emotional and social
protective factors that make the youth ages 10 - 17
vulnerable to delinquency and failure. The main focus
is on prevention and the core of the program will be
based on a life skills training program that will include
interpersonal resistance skills, problem solving, decision
making, etc.
LOCKING FILE CABINETS for the Internal Affairs
Unit. These are required to comply with National
Accreditation Standards
FURNITURE FOR THE GANG INTERVENTION
SQUAD in the Criminal Investigation Division. The Gang
Squad is working with worn and broken furniture (that is at
least 15 years old). The furniture was brought over
from the old station.
AUTO CALIBRATING TINT METERS
With a large segment of the public tinting car windows,
this meter eliminates the guess work with a proven
accuracy to within 2% points to determine the light
transmission of tinted automobile windows. The tint
meters will be utilized in conjunction with the
Washington Ave. Enforcement Program
CONTRIBUTION TO THE POLICE ATHLETIC LEAGUE
SUMMER JOBS PROGRAM: The Miami Beach Police Athletic
League Explorers consist of young adults sharing a common
interest in law enforcement. The Explorers get a "hands on"

experience concerning law enforcement through their many
functions, some of which include traffic control, accident
investigation, crime prevention, security, field interrogations
and arrest procedures. During the summer months, the Police
Department hires the explorers, This provides direction to the
explorers, and the Department benefits from the additional
manpower which increases programming and saves overtime
STATE COMPETITION - To allow seven Explorers and one
Police Officer to attend the 1998 Florida Association of
Police Explorers to take place in Zephyrhills, Florida

BACKGROUND
Florida Statute 932.705 provides for, but is not limited to,
expenditure of forfeiture funds for crime prevention, other law
enforcement purposes and contribution to an organization that
benefits the youth. of Miami Beach.
The Chief of Police of the City of Miami Beach has determined that
the need for the appropriation and expenditures of forfeiture funds
is in compliance with Section 932.705, Florida State Statutes.
ANALYSIS
The Administration requests authorization to adopt the Fifth
Amendment to the operating budget for the FY 97/98 Police
Confiscation Trust Fund in the amount of $94,400 from State funds
to be used to provide funding for the expenditures listed in
Exhibit "A".

In accordance with Florida State Statute 932.705, forfeiture funds
have been deposited in the Police Confiscation Trust Fund. The
City has complied with all statutory procedures involved in the
transaction of these funds.
CONCLUSION
The attached Resolution provides for the Fifth Amendment to the FY
97/98 Police Confiscation Trust Fund in the amount of $94,400 to be
used for the expenditures listed in Exhibit "A".
