A RESOLUTION TO SET A FIRST PUBLIC HEARING ON
MAY 6, 1998 TO CONSIDER A PROPOSED DEVELOPMENT
AGREEMENT TO BE ENTERED INTO BETWEEN DILIDO
BEACH HOTEL CORPORATION AND THE CITY OF MIAMI
BEACH IN ACCORDANCE WITH THE REQUIREMENTS OF
THE FLORIDA LOCAL GOVERNMENT DEVELOPMENT
AGREEMENT ACT FOR PROPERTY LOCATED AT 155
LINCOLN ROAD, MIAMI BEACH, FLORIDA
WHEREAS, the Florida Local Government Development Agreement Act allows for the City
of Miami Beach to enter into development agreements from time to time in order to facilitate
development proposals that would provide substantial public benefit; and
WHEREAS, the Lincoln Road street end is the only street end in the City of Miami Beach
with no public access; and
WHEREAS, The City of Miami Beach has spent upwards of $16 million to improve
pedestrian mobility on Lincoln Road between West Avenue and Collins Avenue; and
WHEREAS, the City of Miami Beach is embarking on a Beachwalk project to connect all
the street ends from 23rd Street to Lummus Park; and
WHEREAS, the DiLido Hotel Corp. has come forward with a rehabilitation plan to improve
the DiLido Hotel at 155 Lincoln Road; and
WHEREAS, said developer is willing to grant and improve beach access to the citizens of
Miami Beach by, among other things, providing an easement that continues uninterrupted from
Collins Avenue to the beach; and
WHEREAS, the developer desires to utilize the additional floor area attributable to that
portion of Lincoln Road adjacent to their site by virtue of the vacation of a portion of the Lincoln
Road right of way; and
WHEREAS, the developer is willing to expend up to $500,000 to improve said roadway
along with the Beachwalk; and
WHEREAS, the proposed project, if implemented, will add to the supply of first-class,
quality hotel rooms available in the City, increase the tax base and eliminate identified slum and
blight.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission of the City of Miami Beach, Florida hereby set a public hearing on May 6, 1998, to
consider whether it should enter into a development agreement to facilitate the above, and the Clerk
is hereby directed to effectuate all required notice (which notice shall be at the expense of the
applicant, DiLido Beach Hotel Corporation) at 11: 00 a. m .

RECOMMENDATION:
It is recommended that the City Commission adopt the Resolution setting a first public hearing on
May 6, 1998 to consider the development agreement.
BACKGROUND:
The Administration has been meeting with representatives of a development group that wants to
rehabilitate the DiLido Hotel at the northeast comer of Collins Avenue and Lincoln Road into a Ritz
Carlton Hotel. The proposal would involve a $90 million renovation with a two-story addition to
portions of the existing building (no tower is proposed). No public investment is being sought for
the project.
The street end of Lincoln Road is the only one in Miami Beach which is not open to the public.
Several prior, unsuccessful attempts have been made with the current owners and the owners of the
adjacent Decoplage Condominiwn retail area to negotiate an easement that would tie Lincoln Road
to the beach and the proposed new Beachwalk.
The developers ofthis project are willing to grant such an easement, and are also willing to provide
for the physical improvements to the easement and the beautification of Lincoln Road up to
$500,000.

The developers are asking that the City vacate the northerly 50 feet of the right of way of Lincoln
Road (which currently terminates prior to reaching the beach) adjacent to their site so that the
underlying property can be calculated as part of the proj ect FAR. An easement would be granted
back to the City for roadway and pedestrian purposes which would be continuous from Collins
Avenue to the Beachwalk.
ANALYSIS:
In accordance with the Florida Local Government Development Agreement Act, the developers are
requesting that the City of Miami Bach enter into a development agreement that would address,
among other things, the proposed development of the site (including renovation and additional
construction), the development regulations applicable to the site, the vacation of a portion of Lincoln
Road, improvements to Lincoln Road to be effectuated by the owner and/or City and the granting
of certain easements for beach access.
The City Commission must hold two public hearings to enter into a development agreement. This
resolution would set the first public hearing for May 6, 1998. A draft agreement is being prepared;
and, if the Commission approves the resolution setting the hearings, the agreement will be presented
in the packet of the May 6, 1998 City Commission meeting.
CONCLUSION:
Due to the substantial benefit that would be derived from the project as proposed, and the support
of the adjacent Decoplage Condominium Owners Association, it is in the best interest of the City
to approve the Resolution and set the public hearing for consideration of the agreement.
