A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, APPROVING, ON SECOND READING, FOLLOWING A
DULY NOTICED PUBLIC HEARING, A LEASE AGREEMENT BETWEEN THE
CITY AND SUNRISE COMMUNITY, INC., FOR USE OF APPROXIMATELY 2,500
SQUARE FEET OF CITY-OWNED PROPERTY, LOCATED AT 8128 COLLINS
AVENUE (ON THE WEST SIDE OF COLLINS AVENUE BETWEEN 81sT AND 82ND
STREETS) FOR THE PURPOSE OF OPERATING AND MANAGING A
VOCATIONAL TRAINING SITE FOR DEVELOPMENTALLY DISABLED ADULTS,
SAID LEASE HAVING AN INITIAL ONE (1) YEAR TERM, COMMENCING
RETROACTIVELY ON SEPTEMBER 1, 2005, AND ENDING ON AUGUST 31,
2006, WITH TWO (2) ADDITIONAL ONE (1) YEAR RENEWAL TERMS, AT THE
CITY'S SOLE DISCRETION; AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE THE LEASE AGREEMENT
WHEREAS, the City had been providing services for the developmentally disabled at the
City-owned commonly referred to as the Log Cabin Training Center, located at 8128 Collins Avenue,
from 1975 until 2005; and
WHEREAS, on March 10, 2005, the City issued Request For Proposals, No. 12-04/05 to
identify a qualified provider to ensure the continued provision of services to the developmentally
disabled population served at the Log Cabin Training Center (the RFP); and
WHEREAS, on July 6, 2005, the Mayor and City Commission selected Sunrise
Community, Inc., as the top ranked firm pursuant to the RFP; and
WHEREAS, the Administration was authorized to negotiate an agreement with the Sunrise
Community, Inc.; accordingly, the Administration recommended that a lease be negotiated for the
City-owned building, located at 8128 Collins Avenue, encompassing approximately 2,500 square
feet (the Property); and
WHEREAS, on June 7,2006, pursuant to Resolution No. 2006-26230, the Mayor and City
Commission approved the Lease Agreement on first reading; waived by 5/thsvote, the competitive
bidding and appraisal requirements; and set the public hearing for the second and final reading; and
WHEREAS, said public hearing was held on July 12, 2006.
NOW, THEREFORE, BE IT DULY RESOLVED BYTHE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve,
on second reading, following a duly noticed public hearing, the attached Lease Agreement between
the City and Sunrise Community, Inc., for the use of the one story building located at 8128 Collins
Avenue, encompassing approximately 2,500 square feet of City-owned property, for the purpose of
operating and managing a vocational training site for developmentally disabled adults, for an initial
term of one (1) year, commencing retroactively on September 1,2005, and ending on August 31,
2006, with two (2) additional one (1) year renewal terms, at the City's sole discretion, further
authorizing the Mayor and City Clerk to execute the Lease Agreement.

Item Summary/Recommendation:
On March 10, 2005, the City issued an RFP to assume the administration and management of the Log
Cabin Training Center and its various programs. The City-owned building located at 8128 Collins Avenue,
provides a variety of vocational training services for developmentally disabled adults. Sunrise Community,
Inc. submitted the first-ranked proposal to the RFP.
On July 6th, 2005, the City Commission approved the Administration's recommendation to proceed with an
agreement with Sunrise Community, Inc. However, after careful consideration and extensive review, the
Administration is recommending a lease agreement instead of a management agreement as they are not
only taking over the program but also are currently occupying a City owned building. Additionally, Exhibit 2
of the lease includes specific language to ensure that existing programming and services remain the
same and delineates the Development Services Monitoring by the City.
Sunrise Community, Inc. will pay the City $600 per month ($7,200 per year) plus fixture rentals of $450
per month ($5,400 per year) and will be responsible for the operating expenses and interior/exterior
building maintenance for the sole purpose of providing vocational training programs and support services
(defined as Adult Day Training, Supported Employment, and Supported Living in the State of Florida
Medicaid Waiver Services Manual).

ANAL YSIS
The City of Miami Beach established and maintained the Log Cabin Training Center from
1975 through 2005 as a service of the City designed to provide vocational training and
support for developmentally disabled adults. The Center houses three programs: Adult Day
Training (ADT), Supported Employment (SE) and Supported Independent Living (SIL).
On March 10, 2005, the City issued a Request for Proposal (RFP) to assume the
administration and management of the Log Cabin Training Center and its various programs.
The City-owned building located at 8128 Collins Avenue, Miami Beach, Florida, provides a
variety of vocational training services for developmentally disabled adults. The Sunrise
Community, Inc. submitted the first-ranked proposal to a Request for Proposal (RFP).
On July 6th, 2005, the City Commission approved the Administration's recommendation to
proceed with an agreement with The Sunrise Community, Inc. However, after careful
consideration and extensive review, and in light of their occupancy of a city-owned facility,
the Administration is recommending a lease agreement instead of a management
agreement. The lease agreement incorporates the Scope of Services requested in the RFP.
Exhibit 7.\ of the attached lease includes specific language to ensure that existing
programming and services remain the same and delineates the Development Services
Monitoring by the City. Pending the formulation and approval of this lease agreement,

Sunrise Community, Inc. has paid rent through March 2006. Sunrise Community, Inc. will
bring the payments up-to-date upon execution of the attached lease agreement.
A companion lease agreement for the Log Cabin Enterprises, Inc., a nursery, is also being
submitted to Commission for consideration and approval. This will allow the two entities to
remain independent due to the relationship of client and provider, while allowing the City the
benefit and protection of a lease agreement.
The Lease Agreement, as negotiated, includes the following additional terms and conditions:
. BASE RENT:
Sunrise Community, Inc. will pay an annual Base Rent in the amount of Seven
Thousand Two Hundred ($7,200) Dollars.
. ADDITIONAL RENT:
Sunrise Community, Inc. will pay annual furniture and fixtures rent in the amount of
Five Thousand Four Hundred ($5,400) Dollars.
· OPERATION, MAINTENANCE and REPAIR:
Sunrise Community, Inc. has agreed to be solely responsible for the operation,
maintenance, and repair of the premises.
· TENANT RESPONSIBILITIES FOR UTILITIES:
Sunrise Community, Inc. has agreed to pay charges for water, gas, electricity, sewer,
cable, telephone and any other utility service provided to the facility including, without
limitation, all hookup fees and impact fees.
Section 82-39 of the Miami Beach City Code, governing the sale/lease of public property, as
amended, requires a competitive bidding process, a Planning Department analysis, and an
independent appraisal to determine the value of the leasehold interest, as well as two (2)
readings of the proposed lease, with the second (and final) reading followed by an
advertised public hearing to obtain citizen input.
As required, the Planning Department's analysis ofthe proposed lease is attached as Exhibit
1.
On June 7, 2006, pursuant to Resolution No. 2006-26230, the Mayor and City Commission
approved the Lease Agreement on first reading; waived by 5/ths vote, the competitive
bidding and appraisal requirements; and set the public hearing for the second and final
reading on July 12, 2006.
Based on the recommendation of the Log Cabin Training Center Selection Committee, the
Administration recommends that the Mayor and City Commission approve the attached
Lease Agreement between the City and the Sunrise Community, Inc. for the use of the one
story building located at 8128 Collins Avenue, Miami Beach, Florida, encompassing
approximately 2,500 square feet of City-owned property for a term of one year commencing
retroactively on September 1, 2005 and ending on August 31, 2006 with two additional one
year renewal terms, at the City's sole discretion, further authorizing the Mayor and City Clerk
to execute the Lease Agreement.

SUBJECT: Sunrise Community, Inc. - 8128 Collins Avenue
Pursuant to your request, this memorandum will serve as an analysis of the lease Agreement
between the City of Miami Beach and Sunrise Community, Inc. for the use of the City-owned
property, located at 8128 Collins Avenue.
Section 82-38 of the Code of the City of Miami Beach requires that any proposed sale or lease
of City-owned land be analyzed from a planning perspective so that the City Commission and
the public are fully appraised of all conditions relating to the proposed sale or lease. The
following is an analysis of the criteria delineated in the Code:
1. Whether or not the proposed use is in keeping with city goals and objectives and
conforms to the city comprehensive plan.
Consistent - The property is located within the RM-1 Residential Multiple Family Low
Intensity future land use category, and surrounded by the RM-1 Residential Multiple
Family Low Intensity and ROS Recreation and Open Space future land use categories.
The lease agreement between the City and Sunrise Community, Inc. is consistent with
the future land use category description contained in the Comprehensive Plan.
2. The impact on adjacent property, including the potential positive or negative
impacts such as diminution of open space, increased traffic, noise level or
enhanced property values, improved development patterns and provision of
necessary services. Based on the proposed use of the property, the city shall
determine the potential impact of the project on city utilities and other
infrastructure needs and the magnitude of costs associated with needed
infrastructure improvements. Should it become apparent that further evaluation of
traffic impact is needed, the proponent shall be responsible for obtaining a traffic
impact analysis from a reputable traffic engineer.
Consistent - The property subject to the lease is part of the "West Lots" across Collins
Avenue from North Shore Open Space Park. The property has been and is currently in
use by the Log Cabin, and no change in operations is proposed. There would be no
diminution of open space as no new construction is being proposed. No additional utility
or infrastructure is expected to be necessary.
3. A determination as to whether or not the proposed use is in keeping with a public
purpose and community needs, such as expanding the city's revenue base,
creating jobs, creating a significant revenue stream, and improving the
community's overall quality of life.

Consistent - This proposal does not accrue funds to the City, however, there is a
potential to create additional jobs. The benefits of having such a facility within the City
for training and education are important.
4. Determination as to whether or not the development is in keeping with the
surrounding neighborhood, will block views or create environmental intrusions,
and evaluation of the design and aesthetic considerations of the project.
Consistent - The surrounding neighborhood consists of the North Shore Open Space
Park and the North Shore residential neighborhood. The continued use of this building
will not be out of character with the surrounding uses. View and environmental
considerations are not applicable.
5. The impact on adjacent properties, whether or not there is adequate parking,
street and infrastructure needs.
Consistent - The impact on adjacent properties should be minimal, as the facility is
already in use by the Log Cabin. The use should be contained within the subject
property. Parking is available, and the Sunrise Community's program provides other
transport options. No further infrastructure needs are anticipated.
6. A determination as to whether or not alternatives are available for the proposed
disposition, including assembly of adjacent properties, and whether the project
could be accomplished under a private ownership assembly.
Not applicable - This property is part of the larger assembly of the City-owned west lots.
No assembly of land is necessary, nor would such be under private ownership. Placing
such a public service facility on privately owned land is probably not a feasible option
economically.
7. Within the constraints of public objectives, the department should examine
financial issues such as job generation, providing housing opportunities, and the
return to the city for its disposition of property.
The Sunrise Community programs do contribute to training, education and job creation,
which are important goals for the City.
8. Such other issues as the Planning Department may deem appropriate in analysis
of the proposed disposition.
Not applicable - The Planning Department has no other issues it deems appropriate to
analyze for this proposal.
