HomeMy WebLinkAbout2006-26241 Reso RESOLUTION NO. 2006-26241 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH FLORIDA, RELATING TO LOBBYING THE STATE LEGISLATURE TO CHANGE STATE LAW SO AS TO PRECLUDE CELLULAR TELEPHONE USAGE BY MOTOR VEHICLE DRIVERS WHILE LOCATED IN A SCHOOL ZONE; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Mayor and City Commission of the City of Miami Beach were deeply saddened by recent new reports of the death of minor child that was crossing the street within a school zone due to a driver's negligence and cellular phone usage while operating a motor vehicle; and, WHEREAS, the Mayor and City Commission are concerned with the health, safety, and welfare of minors crossing the street in school crossing areas; and, WHEREAS, it would promote the health, safety and welfare of all residents, and in particular would protect the youth of the state if the state were to preclude the use of cellular telephones by persons operating motor vehicles while located in a school zone; and, WHEREAS, the Mayor and City Commission desire to lobby the State Legislature to amend or modify state law so as to preclude the use of cellular telephones by persons operating a motor vehicle while located within a school zone. NOW THEREFORE BE IT RESOL VED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH FLORIDA: Section 1. The above Whereas clauses are incorporated by reference. Section 2. The Mayor and City Commission request that the State Legislature modify or amend existing laws so as to prohibit the use of cellular telephones by persons operating motor vehicles while located in a school zone. Section 3. The City Manager shall transmit a copy of this Resolution to the City's State Representatives and to the State Legislature. Section 4. The City Clerk shall provide executed copies of this Resolution to the Mayor of Miami-Dade County, each member of the Miami-Dade Board of County Commissioners, as well as each municipal clerk in Miami-Dade County for the purpose of distributing copies to members of their respective governing councils in order to seek support for the proposed change in state law. I would like our resolution to be consistent with the resolution passed by the City of South Miami. Please find attached the resolution for the City of South Miami.
