A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING
AND AUTHORIZING THE CITY MANAGER TO ISSUE
CERTIFICATIONS OF CONSISTENCY WITH THE CITY'S
CONSOLIDATED PLAN TO DOUGLAS GARDENS
COMMUNITY MENTAL HEALTH CENTER OF MIAMI
BEACH, INC. TO UTILIZE FUNDS PROVIDED DIRECTLY
BY THE U.S. DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT, TO CONTINUE PROVIDING HOUSING
TO FORMERLY HOMELESS PERSONS WITH
DISABILITIES AT THE MAYFAIR HOTEL, 1960 PARK
AVENUE, MIAMI BEACH, AND TO CONTINUE
OPERATING AN OUTREACH TEAM PROGRAM
PROVIDING MOBILE OUTREACH AND CASE
MANAGEMENT SERVICES FOR HOMELESS PERSONS.
WHEREAS, on July 1, 1998, the Mayor and City Commission approved the City's
Consolidated Plan; and
WHEREAS, Douglas Gardens Community Mental Health Center (Douglas Garden) has
proposed to continue providing housing to formerly homeless persons with disabilities at the Mayfair
Hotel, 1960 Park Ave, Miami Beach, and to continue operating an outreach team program providing
mobile outreach and case management services for homeless persons; and
WHEREAS, the U.S. Department of Housing and Urban Development (HUD) requires that
applicants for Federal funding under the Shelter Plus Care Program and the Support Housing
Program obtain and submit Certifications of Consistency with the Consolidated Plan from the
entitlement jurisdiction where the proposed activity is located; and
WHEREAS, in accordance with the City's adopted Consolidated Plan, each request for a
Certification of Consistency with the Consolidated Plan requires City Commission review and
approval; and
WHEREAS, the Administration has reviewed the proposed activities and found it to be
consistent with the Consolidated Plan.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Manager is
authorized to issue Certifications of Consistency with the City's Consolidated Plan to Douglas
Gardens Community Mental Health Center of Miami Beach, Inc., to utilize funds provided directly
by the U.S. Department of Housing and Urban Development, to continue providing housing to
formerly homeless persons with disabilities at the Mayfair Hotel, 1960 Park A venue, Miami Beach,
and to continue operating an outreach team program providing mobile outreach and case
management services for homeless persons.

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
ANAL YSIS
On April 25, 2000, Douglas Gardens Community Mental Health Center of Miami Beach, Inc.,
(Douglas Gardens) requested two Certifications of Consistency with the City's Consolidated Plan
as part of an application for funds from the u.s. Department of Housing and Urban Development
(US. HUD). Douglas Gardens is submitting a grant application to US. HUD for $600,600. This
grant will be utilized by Douglas Gardens to continue to offer twenty-two (22) units of permanent
housing for formerly homeless persons with disabilities at the Mayfair Hotel, 1960 Park Avenue,
Miami Beach, for a period of five years.
Douglas Garden is also submitting a second grant application to US. HUD for $122,199. This grant
will be utilized by Douglas Gardens to continue operating an Outreach Team Program providing
mobile outreach and case management services for homeless persons from their office at 701 Lincoln
Road, for a period of three years. The Outreach Team Program works in conjunction with the Metro-
Dade County Homeless Trust's "Continuum of Care", and the majority of referrals are made to
emergency and transitional housing providers funded by the Trust. The Homeless Trust-funded
emergency shelter for persons from Miami Beach is the Salvation Army shelter, located at 1907

N.W. 38th Street, Miami. The Homeless Trust has pre-paid beds at this facility to increase
accessibility. Once a referral is made, the homeless client is provided with transportation to the
service provider. The Salvation Army case manager coordinates with Douglas Gardens' case
manager to identify subsequent housing options for the individual clients.
These two applications from Douglas Gardens are to be included in an application to be submitted
to u.s. HUD by the Miami-Dade Homeless Trust (Homeless Trust) in response to the annual Notice
of Funding Availability (Super NOF A). The Homeless Trust submits a County-wide application to
U.S. HUD on behalf oflocal housing providers requesting funding under the Super NOF A.
U.S. HUD requires that applicants for funding obtain and submit a Certification of Consistency with
the Consolidated Plan from the entitlement jurisdiction where the activity is to be located for each
application. In accordance with the Consolidated Plan adopted by the City, each request for a
Certification of Consistency with the Consolidated Plan requires City Commission review and
approval.
On May 1, 1996, a Douglas Gardens representative appeared before the City Commission
requesting a Certification of Consistency with the City's Consolidated Plan for a proposal to acquire,
rehabilitate and operate the Mayfair Hotel as a residence for formerly homeless persons with
disabilities. The City Commission did not act to issue the Certification of Consistency.
On May 29,1996, Douglas Gardens filed a complaint with the Department of Housing and Urban
Development (U.S. HUD) , styled Douglas Gardens Community Mental Health Center of Miami
Beach. Inc. v. City of Miami Beach C.D.. et aI, U.S. HUD Case No. 04-96-0292-8, alleging
violations of the Fair Housing Act, involving the Mayfair Hotel. The case alleged discrimination
on the part of the City against Special Needs groups.
On January 22, 1997, the City Commission adopted Resolution No. 97-22269, approving and
authorizing the Mayor and City Clerk to execute a Conciliation Agreement by and between the City
of Miami Beach, Douglas Gardens and U.S. HUD, in settlement of the lawsuit. As part of the
settlement, the City issued a Certification of Consistency with the Consolidated Plan to Douglas
Gardens to provide housing services.
Also as part of the settlement, the City provided Douglas Gardens with $750,000 in HOME Program
funds to acquire the Mayfair Hotel. Subsequently, Douglas Gardens acquired the property and
completed a rehabilitation of the building in 1998.
Every year, since 1995, Douglas Gardens has been providing twenty-two (22) units of permanent
housing for formerly homeless persons with disabilities at the Mayfair Hotel, 1960 Park A venue,

Miami Beach. Supportive services for the residents of the Mayfair Hotel are provided at the Douglas
Gardens Clinical Offices at 701 Lincoln Road. Also, Douglas Gardens has operated the Outreach
Team Program since 1995 from their office at 701 Lincoln Road.
The Administration has reviewed the documentation submitted by Douglas Gardens describing the
activities, and has concluded that the continuation of these activities are consistent with the City's
Consolidated Plan. The Consolidated Plan identifies long term objectives in Chapter 4, "Five Year
Strategy". Under the Homelessness Strategy (Continuum of Care), page 54, the Plan specifies that
Douglas Gardens will continue to provide supportive housing for the formerly homeless, and
operates an Outreach Team Program. The Plan also supports efforts to assist special needs
populations in general.
The Administration recommends adoption of the attached Resolution of the Mayor and City
Commission of the City of Miami Beach, Florida, approving and authorizing the City Manager to
issue Certifications of Consistency with the City's Consolidated Plan to Douglas Gardens
Community Mental Health Center of Miami Beach, Inc. to utilize funds provided directly by the
U.S. Department of Housing and Urban Development to continue providing housing to formerly
homeless persons with disabilities at the mayfair hotel, 1960 park avenue, Miami Beach, and to
continue operating an Outreach Team Program providing mobile outreach and case management
services for homeless persons.
