RESOLUTION No. 2000-23898
A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING
THE SEVENTH AMENDMENT TO THE POLICE
CONFISCATION TRUST FUND FOR FISCAL YEAR 1999/00,
IN THE AMOUNT OF $112,568, TO BE FUNDED FROM THE
PROCEEDS OF STATE CONFISCATED FUNDS.
WHEREAS, Section 932.705, Florida Statutes, addresses the purpose and procedures to
be utilized for the appropriation and expenditures of the Police Confiscation Trust Fund; and
WHEREAS, the Chief of Police of the City of Miami Beach has determined that the need
for appropriation and expenditures exist and the appropriation and expenditure of forfeiture funds
is in compliance with Section 932.705, Florida Statutes; and
WHEREAS, such funds are available in the Police Confiscation Trust Fund.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby adopt the Seventh Amendment to the FY 99/00 Police Confiscation Trust
Fund Budget for the City of Miami Beach, in the amount of $112,568, as reflected in the attached
Exhibit "A".

STATE FUNDS:
Renovations to the PROPERTY WINDOW - Remove existing
plexiglass vision panel and furnish and install the following:
one bullet resistant transaction drawer, one piece of bullet resistant
Lexguard, one bullet resistant Speak thru vent, and stainless counter
top cover (The window area is where civilians respond when
they have had personal property impounded by the Police Dept.
Many of these individuals are defendants in cases and are often
,.irate over the fact that they have been arrested by our department.
Said personnel have expressed concerns for their safety especially
when they have had to turn over firearms to these individuals.
This protective barrier has been requested for a long time and
would help tremendously with giving that area the security it
deserves)

be mounted in the main PSCU work area. They will be used

May 30th to June, 2000.

Renovations to the EVIDENCE DOOR - to include: removal of the
current door and furnish and install the following: one "Dutch" type
steel door into the original steel frame utilizing the original two lower
. hinge locations for bottom half and double mortiseing the top half.
,. (This new door would replace the existing solid door at that location
and provide additional security of this highly sensitive area of the
office. This request originated from an audit recommendation to
replace the door for one designed to restrict access into the evidence
room. Instead of having to maintain the door in an open position as
we now do during business hours, the bottom half of the new door
will remain closed on a permanent basis. This door will address a
security and liability issue that is necessary to the improve depart-

ADMINISTRA TION RECOMMENDATION
Adopt the Resolution.
ANALYSIS
Florida Statute 932.705 provides for expenditures of forfeiture funds for law enforcement purposes.
The Chief of Police of the City of Miami Beach has reviewed and identified the need for the
appropriation and has established that the expenditures of forfeiture funds is in compliance with
Section 932.705, Florida State Statutes. These forfeiture funds have been deposited in the Police
Confiscation Trust Fund. The City has complied with all statutory procedures involved in the
transaction of these funds.
The Administration requests authorization to adopt the Seventh Amendment to the operating budget
for the FY 1999/00 Police Confiscation Trust Fund in the amount of $112,568 from State funds to
be used to provide for the expenditures listed in Exhibit "A".
