93-20699 RESO • 1 RESOLUTION NO. 93-20699 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ORDERING THE ACQUISITION, CONSTRUCTION AND INSTALLATION OF THE "NORTH BEACH STREETSCAPE IMPROVEMENT PROJECT" AS SET FORTH ON THE MAP ATTACHED HERETO AND INCORPORATED HEREIN BY REFERENCE AS EXHIBIT "A"; PROVIDING A DESCRIPTION OF THE PROPOSED PROJECT; DETERMINING THAT CERTAIN REAL PROPERTY WILL BE SPECIALLY BENEFITTED BY THE ACQUISITION AND CONSTRUCTION OF SAID PROJECT; DIRECTING THE DIRECTOR OF PUBLIC WORKS TO PREPARE OR CAUSE TO BE PREPARED PLANS, SPECIFICATIONS AND ESTIMATES OF COST FOR SUCH PROJECT AND A TENTATIVE ASSESSMENT ROLL; PROVIDING FOR NOTICE OF PUBLIC HEARING; DETERMINING AND PROVIDING FOR THE MANNER AND METHOD OF COMPUTING SUCH SPECIAL ASSESSMENT TO FINANCE SUCH PROJECT; REPEALING RESOLUTIONS NO. 90- 19917, 0- 19917, NO. 90-19918 AND NO. 90-19964; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Miami Beach, Florida (the "City Commission") , on June 17 , 1992 , enacted Ordinance No. 92-2782 , (as the same may be amended from time to time the =Ordinance") which Ordinance provides for the establishment of a procedure for the imposition and levying of special assessments to finance the acquisition and construction of local improvements within the City of Miami Beach, Florida (the "City") ; and WHEREAS, the City Commission finds and determines it to be necessary for the continued preservation of the health, welfare, convenience and safety of the inhabitants of the City to provide for, acquire, construct and maintain the "North Beach Streetscape Improvement Project" described herein (the "Project") and to defray the costs of acquisition and construction thereof by special. assessments against property specially benefitted by the Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AS FOLLOWS: Section 1. Authority. This Resolution is adopted pursuant to the provisions of the Ordinance, Chapter 166, Florida Statutes, and other applicable provisions of law. Section 2 . Authorization of Project. The City Commission hereby authorizes and orders the acquisition and construction of the Project, as more specifically described in Exhibit "A" attached hereto, all to be located within the City. J t Section 3 . Description of Property Specifically Benefitted; Initial Cost Estimate. The City Commission hereby finds and determines that the property described in Exhibit "A" attached hereto shall be specially benefitted by the acquisition and construction of the Project. The Cost (as such term is defined in the Ordinance) of the Project is initially estimated to be $12 , 000, 000. The City shall pay for approximately 11% of the Cost and the balance of such Cost shall be assessed against the benefitted property owners as provided in the Ordinance. Section 4 . Plans and Specifications; Estimated Costs and Tentative Assessment Roll. The Director of Public Works is hereby directed to prepare, or cause to be prepared, in triplicate, plans, specifications and an estimate of the Cost of the improvements constituting the Project, and to prepare, or cause to be prepared, in triplicate, the Tentative Assessment Roll (as such term is defined in the Ordinance) , all as provided in the Ordinance. Such plans, specifications, estimate of Costs and Tentative Assessment Roll shall be filed by the Director of Public Works as provided by the Ordinance. Section 5. Notice of Public Hearing. After the plans, specifications, estimated Cost and Tentative Assessment Roll have been filed by the Director of Public Works as provided by the Ordinance, a Notice of Public Hearing shall be published in a newspaper of general circulation, stating that a meeting of the City Commission shall be held to hear objections by all interested persons on this special assessment and other issues authorized by the Ordinance. The City Manager shall select an appropriate hearing date and the City Clerk shall cause to be mailed a Notice by first class mail to each property owner proposed to be assessed as required by the Ordinance. The Notice required to be published and mailed shall advise of a City Commission hearing not earlier than fifteen (15) calendar days from the publication or mailing as required by the Ordinance. Section 6. Description of Special Assessments. The Cost of the Project shall be assessed against the property described in Exhibit "A" attached hereto in accordance with the benefits received by such property and designated on the Tentative Assessment Roll. Special Assessments shall be levied on a "front footage" basis, all substantially in accordance with this methodology. In establishing the Tentative Assessment Roll, the Director of Public Works shall employ the method of assessment authorized herein, provided he may utilize such formulas for dealing with irregular lots and such assumptions of depth of improvements as shall not be inconsistent with such method of assessment. All special assessments will be collected and shall be payable as provided in accordance with the terms of the Ordinance. No liens on property benefitted by the Project shall attach until the completion of the Project and the Preliminary Assessment Roll has been approved, after a public hearing, by adoption of the final resolution of the City Commission. Section 7 . Recordation. The City Clerk is hereby directed to record this Resolution in the Official Records Book in the office of the Dade County Clerk. Section 8 . Effective Date. This Resolution shall take effect immediately upon its adoption. 2 p • Section 9 . Prior Resolutions Repealed. City Resolutions No. 90-19917 , adopted on February 21, 1990, No. 90-19918, adopted on February 21, 1990, and No. 90-19964, adopted on April 18, 1990, are hereby repealed in their entirety. Carlton 444, City Manager SUBJECT: INITIAL RESOLUTION ORDERING THE ACQUISITION, CONSTRUCTION AND INSTALLATION OF THE NORTH BEACH STREETSCAPE IMPROVE- MENT PROJECT ADMINISTRATION AND CITY ATTORNEY RECOMMENDATION: The Administration and the City Attorney recommend that the City Commission pass the attached Initial Resolution. BACKGROUND: In 1989 , the City was awarded a planning grant under the State's Safe Neighborhoods Act for environmental design and community involvement as a means of preventing criminal activity. This concept, known as Crime Prevention Through Environmental Design (CPTED) , was enthusiastically endorsed by the North Beach business and residential community as a means of physically improving their commercial district, yet making the area a safer and more viable place in which to live. Out of the safe neighborhoods grant evolved a movement from the North Beach Development Corporation (NBDC) to implement portions of this design. The concept was eventually expanded to encompass what is now the $11. 7 million "North Beach Streetscape Improvement Project" . The City, in conjunction with the NBDC, undertook an extensive planning phase and public information process with the North Beach community and on February 21, 1990, the City Commission adopted Resolution No. 90-19917 which ordered the improvements and established a special assessment district. This resolution also provided for said improvement to be an assessable project in accordance with sections 29 and 30 of the City Charter. In December 1990, after a competitive selection process, the City Commission entered into a contract with the consulting firm of Kimley-Horn and Associates, Inc. , to develop - under Phase I - a conceptual streetscape plan graphically depicting the locations of sidewalk, curb, gutter, street furniture, lig!-,ting and other miscellaneous items. 57 AGENDA R. The reason for the delay was a ruling in a Boca Raton case which left bond counsel in Florida uncertain as to the legality of using Chapter 166 as a means of levying special assessments. In February 1992 , the Florida Supreme Court held in City of Boca Raton v. State of Florida that the use of Home Rule Powers under Chapter 166 of the Florida Statutes for special assessments was a valid and proper use of municipal power. On June 17 , 1992 , the City Commission went forward and enacted Ordinance No. 92-2782 providing for the establishment of a procedure for the imposition and levying of special assessments to finance the acquisition and construction of local improvements within the City. More specifically, this Home Rule Special Assessment Ordinance set up the legal mechanism for improvements to any special assessment area in the City, including the North Shore area. In November 1992 , the City Commission approved, under Resolution No. 92-20657 , Phase II (Final Design) of the project. Phase II is currently underway and consists of the preparation of final construction plans and specification documents. After extensive advertising and noticing, a public information meeting was held on December 8, 1992 to review the project's functional drawings and give the affected North Beach business and residential community an opportunity to meet with the consultants and city administrators and ask questions. All in attendance endorsed the concept and supported the establishment of a special assessment to pay for the improvements. ANALYSIS: The North Beach Streetscape Improvement Project will consist of street and sidewalk modifications, attractive landscaping, pedestrian-oriented lighting and street furniture, including benches, tree grates and attractive trash receptacles. Additionally, detailed designs aimed at lowering crime and improving property values have been developed by the City with State funding through the Safe Neighborhoods Program and will be incorporated into the project. These streetscape designs affect traffic flow, signage, alley lighting, greenery, and create an attractive human environment. This project has been enthusiastically endorsed by the North Beach Development Corporation, the business and residential community affected in the area, and the City's Police Department. Total project cost is estimated at $11, 730, 000 of which 64% will be funded by special assessments, 28% will be funded by the Florida Department of Transportation and 8% will be funded by the City of Miami Beach. The North Beach Streetscape Improvement Project will provide such benefits as follows: - enhanced property values - economic stimulus and investment - enhanced infrastructure improved retailing and business environment - enhanced image and character for the North Beach area 58 • • COMMISSION MEMO JANUARY 20, 1993 PAGE 3 CONCLUSION: The City Commission should pass the attached Initial Resolution to provide the necessary legal mechanism to implement the North Beach Streetscape Improvement Project, and thereby make the North Beach area a safer and more economically viable portion of Miami Beach. The steps required to establish the special assessment and implement the North Beach Streetscape Improvement Project are provided as "Attachment A" . Status: Reimbursement Resolution approved at the April 22, 1992 Commission Meeting. Step 2: Adopt Home Rule Ordinance which requires two readings. Status: Home Rule Special Assessment Ordinance No. 92-2782 passed. First reading held on June 3, 1992. Adopted on second reading June 17, 1992. Effective June 27, 1992. Step 3: Rescind previous ordinances and resolutions. Status: Initial Resolution ordering local improvements and creating district to be presented to City Commission on Jan. 20, 1993. Initial Resolution recorded by Clerk. Ste 4: Director of Public Works prepares plans and specifications on a per linear foot basis. Director of Public Works causes Tentative Assessment Roll to be prepared. Director of Public Works files costs, plans, specifications and Tentative Assessment Roll (cost estimate is based on 60% plans) with the City Manager and the Clerk. Estimated Date: June 1993. Step 5: Clerk will publish in newspaper a notice of meeting at which Commission will hear objections to adoption of Approving Resolution, which resolution will approve costs, plans, specifications and Tentative Assessment Roll. In addition to this notice, Clerk will mail a copy of the notice by first class mail to each property owner proposed to be assessed. Estimated Date: June 1993. Step 6: City Commission holds public hearing and adopts Approving Resolution. Estimated Date: July 1993. Special Assessments established upon adoption of Approving Resolution (not a lien until adoption of Final Resolution). Clerk records Approving Resolution and notice of Special Assessments intended to be levied. City instructs Director of Public Works to proceed with final drawings. 60 f • I • "Attachment A" (Continued) Step 7: Advertise for sealed bids subject to bonds. Estimated Date: January 1994. Step 8: Sell bonds. Estimated Date: February 1994. Step 9: Award. Estimated Date: End of March 1994. Step 10: Acquire and construct Project and have Commission certify its completion. Estimated Date: April 1994. Step 11: After certification of the Project (but in no event more than six months after such certification), the Director of Public Works shall prepare Preliminary Assessment Roll. Step 12: Subsequent to filing of Preliminary Assessment Roll, Clerk will publish in newspaper a notice of meeting at which the Commission will hear objections to the approval of the Preliminary Assessment Roll. In addition to this notice, Clerk will mail a copy of the notice by first class mail to each property owner proposed to be assessed. Step 13: Commission holds a public hearing after the completion of which the Commission adopts a Final Resolution which will annul, modify or confirm the Preliminary Assessment Roll. Upon adoption of Final Resolution, the Preliminary Assessment Roll will become the Assessment Roll. Assessment Roll shall be kept by Clerk and Final Resolution shall be recorded by Clerk. WHEREAS, the City Commission of the City of Miami Beach, Florida (the "City commission"), on June 17, 1992, enacted Ordinance No. 92-2782, (as the same may be amended from time to time the llOrdinance") which Ordinance provides for the establishment of a procedure for the imposition and levying of special assessments to finance the acquisition and construction of local improvements within the City of Miami Beach, Florida (the "City"); and WHEREAS, the City Commission finds and determines it to be necessary for the continued preservation of the health, welfare, convenience and safety of the inhabitants of the City to provide for, acquire, construct and maintain the "North Beach Streetscape Improvement Project" described herein (the "Project") and to defray the costs of acquisition and construction thereof by special assessments against property specially benefitted by the Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AS FOLLOWS: Section 1. Authority. This Resolution is adopted pursuant to the provisions of the Ordinance, Chapter 166, Florida statutes, and other applicable provisions of law. Section 2. Authorization of Proiect. The City commission hereby authorizes and orders the acquisition and construction of the Project, as more specifically described in Exhibit "A" attached hereto, all to be located within the City. section 3. Description of Property SpecificallY Benefitted: Initial Cost Estimate. The City commission hereby finds and determines that the property described in Exhibit "A" attached hereto shall be specially benefitted by the acquisition and construction of the Project. The Cost (as such term is defined in the Ordinance) of the Project is initially estimated to be $12,000,000. The City shall pay for approximately 11% of the Cost and the balance of such Cost shall be assessed against the benefitted property owners as provided in the Ordinance. section 4. Plans and Specifications: Estimated Costs and Tentative Assessment Roll. The Director of Public Works is hereby directed to prepare, or cause to be prepared, in triplicate, plans, specifications and an estimate of the Cost of the improvements constituting the Project, and to prepare, or cause to be prepared, in triplicate, the Tentative Assessment Roll (as such term is defined in the Ordinance), all as provided in the Ordinance. Such plans, specifications, estimate of Costs and Tentative Assessment Roll shall be filed by the Director of Public Works as provided by the Ordinance. section 5. Notice of Public Hearinq. After the plans, specifications, estimated Cost and Tentative Assessment Roll have been filed by the Director of Public Works as provided by the Ordinance, a Notice of Public Hearing shall be published in a newspaper of general circulation, stating that a meeting of the City Commission shall be held to hear objections by all interested persons on this special assessment and other issues authorized by the Ordinance. The City Manager shall select an appropriate hearing date and the City Clerk shall cause to be mailed a Notice by first class mail to each property owner proposed to be assessed as required by the Ordinance. The Notice required to be published and mailed shall advise of a city commission hearing not earlier than fifteen (15) calendar days from the publication or mailing as required by the Ordinance. section 6. Description of Special Assessments. The Cost of the Project shall be assessed against the property described in Exhibit "A" attached hereto in accordance with the benefits received by such property and designated on the Tentative Assessment Roll. Special Assessments shall be levied on a "front footage" basis, all substantially in accordance with this methodology. In establishing the Tentative Assessment Roll, the Director of Public Works shall employ the method of assessment authorized herein, provided he may utilize such formulas for dealing with irregular lots and such assumptions of depth of improvements as shall not be inconsistent with such method of assessment. All special assessments will be collected and shall be payable as provided in accordance with the terms of the Ordinance. No liens on property benefitted by the Project shall attach until the completion of the Project and the Preliminary Assessment Roll has been approved, after a public hearing, by adoption of the final resolution of the city commission. section 7. Recordation. The city Clerk is hereby directed to record this Resolution in the Official Records Book in the office of the Dade County Clerk. section 8. Effective Date. This Resolution shall take effect immediately upon its adoption. 2 section 9. G.= SUBJECT: INITIAL RESOLUTION ORDERING THE ACQUISITION, CONSTRUCTION AND INSTALLATION OF THE NORTH BEACH STREETS CAPE IMPROVE- MENT PROJECT ADMINISTRATION AND CITY ATTORNEY RECOMMENDATION: The Administration and the city Attorney recommend that the City Commission pass the attached Initial Resolution. BACKGROUND: In 1989, the City was awarded a planning grant under the state's Safe Neighborhoods Act for environmental design and community involvement as a means of preventing criminal activity. This concept, known as Crime Prevention Through Environmental Design (CPTED), was enthusiastically endorsed by the North Beach business and residential community as a means of physically improving their commercial district, yet making the area a safer and more viable place in which to live. Out of the safe neighborhoods grant evolved a movement from the North Beach Development Corporation (NBDC) to implement portions of this design. The concept was eventually expanded to encompass what is now the $11. 7 million "North Beach Streetscape Improvement Project". The city, in conjunction with the NBDC, undertook an extensive planning phase and public information process with the North Beach community and on February 21, 1990, the city Commission adopted Resolution No. 90-19917 whieh ordered the improvements and established a special assessment district. This resolution also provided for said improvement to be an assessable project in accordance with sections 29 and 30 of the City Charter. In December 1990, after a competitive selection process, the City commission entered into a contract with the consulting firm of Kimley-Horn and Associates, Inc., to develop - under Phase I - a conceptual streets cape plan graphically depicting the locations of sidewalk, curb, gutter, street furniture, lighting and other miscellaneous items. 57 AGENDA ITEM R -1- C- I - 20~ q 3 DATE COMMISSION MEMO JANUARY 20, 1993 PAGE 2 However, the proposed project was delayed until 1992. The reason for the delay was a ruling in a Boca Raton case which left bond counsel in Florida uncertain as to the legality of using Chapter 166 as a means of levying special assessments. In February 1992, the Florida Supreme Court held in city of Boca Raton v. State of Florida that the use of Home Rule Powers under Chapter 166 of the Florida Statutes for special assessments was a valid and proper use of municipal power. On June 17, 1992, the City Commission went forward and enacted Ordinance No. 92-2782 providing for the establishment of a procedure for the imposition and levying of special assessments to finance the acquisition and construction of local improvements within the city. More specifically, this Home Rule Special Assessment Ordinance set up the legal mechanism for improvements to any special assessment area in the City, including the North Shore area. In November 1992, the City commission approved, under Resolution No. 92-20657, Phase II (Final Design) of the project. Phase II is currently underway and consists of the preparation of final construction plans and specification documents. After extensive advertising and noticing, a public information meeting was held on December 8, 1992 to review the proj ect' s functional drawings and give the affected North Beach business and residential community an opportunity to meet with the consultants and city administrators and ask questions. All in attendance endorsed the concept and supported the establishment of a special assessment to pay for the improvements. ANALYSIS: The North Beach streets cape Improvement Project will consist of street and sidewalk modifications, attractive landscaping, pedestrian-oriented lighting and street furniture, including benches, tree grates and attractive trash receptacles. Additionally, detailed designs aimed at lowering crime and improving property values have been developed by the city with state funding through the Safe Neighborhoods Program and will be incorporated into the project. These streetscape designs affect traffic flow, signage, alley lighting, greenery, and create an attractive human environment. This project has been enthusiastically endorsed by the North Beach Development Corporation, the business and residential community affected in the area, and the City's Police Department. Total project cost is estimated at $11,730,000 of which 64% will be funded by special assessments, 28% will be funded by the Florida Department of Transportation and 8% will be funded by the City of Miami Beach. The North Beach streetscape Improvement Project will provide such benefits as follows: enhanced property values economic stimulus and investment enhanced infrastructure improved retailing and business environment enhanced image and character for the North Beach area 58 COMMISSION MEMO JANUARY 20, 1993 PAGE 3 CONCLUSION: The city commission should pass the attached Initial Resolution to provide the necessary legal mechanism to implement the North Beach streetscape Improvement Project, and thereby make the North Beach area a safer and more economically viable portion of Miami Beach.
