2000-23889 RESO RESOLUTION NO. 2000-23889 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A TWO MONTH EXTENSION TO THE LEASE AGREEMENT, DATED FEBRUARY 10, 1995, BY AND BETWEEN THE CITY AND GAZIT MERIDIAN, INC. FOR THE SECOND FLOOR OF THE PROPERTY LOCATED AT 777-17TH STREET, MIAMI BEACH, FLORIDA, WHICH CURRENTL Y HOUSES THE CITY'S PARKING DEPARTMENT; AND APPROPRIATING $20,196.64 FROM THE PARKING ENTERPRISE FUND TO FUND THE COSTS OF SAID LEASE EXTENSION WHEREAS, on February 15, 1995, the Mayor and City Commis.sion adopted Resolution No. 95-21494, approving a Lease Agreement between the City and Gazit Meridian, Inc. for the second floor space of the property located 777 - 17th Street, Miami Beach, Florida, to house the City's Parking Department administrative offices; and WHEREAS, said Lease Agreement became effective March 1, 1995, was to expire on June 30, 1998, was subsequently extended by option for a two year period, and is currently set to expire on June 30, 2000; and WHEREAS, in an effort to minimize the costs related to leasing of privately owned property to house City Departments, the Parking Department was slated to relocate from its present offices at 777 -17th Street, to Historic City Hall, effective July 1, 2000, and WHEREAS, the issuance of a Certificate of Completion related to the recently reconstructed South Wing of the 1 st floor of Historic City Hall space has been delayed; and WHEREAS, the issues surrounding said delay are currently being addressed and it is expected that all outstanding matters will be resolved and the required Certificate of Completion will be in place prior to the end of August 2000; and WHEREAS, the Administration has determined that a two month extension of the existing Lease Agreement with Gazit Meridian, Inc. will provide adequate time for the subject issues to be resolved; and WHEREAS, the Administration and Gazit Meridian, Inc. have agreed to a two month extension, beginning on July 1, 2000, and ending on August 31, 2000, under the existing terms and conditions of the Lease Agreement; and WHEREAS, funds must be appropriated, in the amount of $20, 196.64, in order to fund the monthly rental payments, common area maintenance and operating costs during the extension period. NOW, THEREFORE, BE IT RESOL VED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Clerk be authorized to execute a two month extension of the Lease Agreement, dated February 10, 1995, between the City and Gazit Meridian, Inc. for the use of the second floor of the property located at 777 -17th Street, Miami Beach, Florida; and appropriate $20,196.64 from the Parking Enterprise Fund to fund the costs of said extension. FOR THE SECOND FLOOR OF THE PROPERTY LOCATED AT 777-17TH STREET, MIAMI BEACH, FLORIDA, WHICH CURRENTLY HOUSES THE CITY'S PARKING DEPARTMENT; AND APPROPRIATING $20,196.64 FROM THE PARKING ENTERPRISE FUND TO FUND THE COSTS OF SAID EXTENSION ADMINISTRATION RECOMMENDATION Adopt the Resolution. ANALYSIS On February 15, 1995, the Mayor and City Commission adopted Resolution No. 95-21494, approving a Lease Agreement between the City of Miami Beach and Gazit Meridian, Inc.(Gazit) for the use of approximately 7,000 square feet of office space to house the City's Parking Department administrative offices. Said Lease Agreement became effective March 1, 1995, and was to expire on June 30, 1998. On March 18, 1998, the City exercised an option to renew said Lease Agreement for a two year period which became effective July 1, 1998 and expires on June 30, 2000. The monthly rental is $10,098.32, including common area maintenance and operating costs. In an effort to minimize the costs related to leasing of privately owned property to house City Departments, and in accordance with recent Mayor and City Commission directives, the Administration has been striving to locate affected departments in City-owned facilities. As such, the Parking Department was slated to relocate from their present offices at 777-1 7th Street (being leased from Gazit) to Historic City Hall, effective July 1,2000. The Department was to relocate its administrative division to the 8th floor Historic City Hall space (currently occupied by Frankel and Associates and to be relinquished on June 15,2000) and a portion of its operations division to the AGENDA ITEM ~~;\ DATE 6'" (0 - au Parking Lease Extension - 2 - May 10, 2000 south wing, 1st floor Historic City Hall space (previously occupied by Iramco, Inc). However, the issuance of a Certificate of Completion (CC) related to the recently reconstructed south wing 1st floor space has been delayed because of unresolved ADA (American with Disabilities Act) compliance issues. Said issues are currently being addressed and it is expected that all outstanding matters will be resolved and the required CC will be in place prior to the end of August 2000. As such, the City Administration and Gazit have agreed to a two month extension, under the existing terms and conditions, which will provide for the ADA issues to be resolved. The Administration recommends that the Mayor and City Commission approve the two (2) month extension of the current Lease Agreement beginning on July 1, 2000, and ending on August 31, 2000 for a maximum two month rental amount $20,196.64; and appropriate said amount from the Parking Enterprise Fund to fund the costs of said extension. ~-~ LALCMC:JD:rd T:\AGENDA \2000\MA Y1 OOO\REGULAR\PKGLEASE.MEM 04/24/00 AGENDA ITEM DATE LEASE AGREEMENT EXTENSION EXTENSION AGREEMENT to be attached and for a part ofa Lease (which, together with any amendments, modifications and extensions thereof, is hereinafter referred to as the "Lease"), made the 10th day of February, 1995 between Gazit Meridian, Inc., as Lessor (Landlord) and the City of Miami Beach, as Lessee (Tenant), covering the premises known as Equity One Building located at 777 - 17th Street, Suite #200, Miami Beach, Florida, 33139. WITNESSED THAT the Lease is hereby renewed and extended for a further term of two (2) months to commence on the 1st day of July, 2000 and to expire on the 31st day of August, 2000, and to comply with all provisions of the Lease during its unexpired term. This renewal and extension shall be upon all the terms, conditions, covenants and agreements contained in the Lease, except Lessee shall pay as a base rent for the leased premises the following sums: The total combined monthly payment for the use ofthe leased Premises, including Minimum Guarantee Rent (MGR), Common Area Maintenance (CAM) and operating costs remaining at Ten Thousand Ninety Eight --321100 Dollars ($10,098.32) IN WITNESS WHEREOF, the parties hereto have signed and sealed this Lease Agreement Extension this I " day of May. 2000.
