2000-23856 RESO RESOLUTION NO. 2000-23856 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN THE CITY AND FLORIDA POWER & LIGHT COMPANY (FPL) GRANTING FPL THE USE OF THE PARKING LOT BETWEEN 18TH AND 19TH STREETS, AND THE MIAMI BEACH CONVENTION CENTER AND MERIDIAN AVENUE, AS A STAGING AREA BY FPL FOR MATERIAL AND EQUIPMENT NECESSARY TO RESTORE ELECTRIC SERVICE TO THE CITY DURING TIMES OF EMERGENCY WHEREAS, in the event of disasters such as major storms, hurricanes, other natural disasters, and military or civil disturbances, FPL will require temporary staging areas from time to time to park trucks and store materials and equipment and to act as show-up sites for the work crews of FPL, its contractors, and other utilities assisting FPL; and WHEREAS, such staging areas will be secured for material and equipment pick-up by FPL; and WHEREAS, work crews will be dispatched from the staging areas to repair electrical service to the community; and WHEREAS, the staging areas will be secured against theft, vandalism, and site abuse, and temporary lighting will be used during darkness; and WHEREAS, the City is willing to provide a staging area for as long as reasonably necessary, as determined between the parties, for FPL to restore electric service to the City. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission authorize the Mayor and City Clerk to execute the attached Agreement between the City and Florida Power & Light Company (FPL) granting FPL the use of the parking lot between 18th and 19th Streets, and the Miami Beach Convention Center and Meridian Avenue, as a staging area by FPL for material and equipment necessary to restore electric service to the City during times of emergency. WITNESSETH: Whereas, in the event of disasters such as major storms, hurricanes, other natural disasters, and military or civil disturbances, FPL will require temporary staging areas from time to time in the communities to park trucks and store materials and equipment and to act as show-up sites for the work crews of FPL, its contractors, and other utilities assisting FPL;and Whereas, such staging areas will be secured for material and equipment pick-up by FPL; and Whereas, work crews will be dispatched from the staging areas to repair electrical service to the community; and Whereas, the staging areas will be secured against theft, vandalism, and site abuse, and temporary lighting will be used during darkness; and Whereas, Grantor, a local governmental agent, is willing to provide a staging area for as long as reasonably necessary, as determined between the parties, for FPL to restore electric service. Now Therefore, the parties agree as follows: 1 . The Recitals above are adopted and made a part of this Agreement. 2. Grantor hereby grants to FPL the use and control of the area known as the parking lot located north of the City of Miami Beach City Hall between 18th and 19th Streets . .." and the Convention Center and Meridian Avenue, described in Exhibit "A" ("Staging Area"), to perform the functions described in the recitals above on an "as needed" basis. 3. FPL agrees to protect, defend, indemnify and hold Grantor, and their officers, directors, employees, agents and servants, free and unharmed from and against any and all third party (including employees of FPL and its contractors) claims, liabilities, loss, costs, or damages whatsoever, including court costs and reasonable attorney's fees resulting from or in connection with the use of the Staging Area by FPL and its contractors. FPL will reimburse Grantor for property damage to the Staging Area sustained by Grantor, as a result of the negligence of FPL employees or its contractors. 4. FPL will provide any surface improvements to the Staging Area it deems necessary for the effective use of the area, all required utility services, sanitation facilities, fuel dispensing for its equipment, mobile office facilities, tents, eating facilities, and upon termination of the use, FPL will restore the Staging Area to its original or better condition and repair any damage to the property resulting from such use. 5. FPL understands that the City of Miami Beach may revoke FPL's privilege to use the Staging Area as agreed herein upon giving thirty (30) days written notice such effect.
