2000-23905 RESO RESOLUTION NO. 2000-23905 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A FOURTH AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT (MMP STUDY) BETWEEN THE CITY AND CARR SMITH CORRADINO, DATED APRIL 16, 1997, IN AN AMOUNT NOT TO EXCEED $20,000; SAID AMENDMENT TO PROVIPE CONSULTANT ASSISTANCE TO THE CITY, AS THE LIAISON WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION AND MIAMI-DADE COUNTY, IN COORDINATING TWO MAJOR ROADWAY IMPROVEMENT PROJECTS ON COLLINS AVENUE/SOUTH BEACH, WITH OTHER ROADWAY, BRIDGE, OR ENHANCEMENT PROJECTS ALSO SCHEDULED FOR CONSTRUCTION WITHIN THE GENERAL AREA; AND FURTHER APPROPRIATING $20,000 FOR THE PURPOSE FROM CONCURRENCY MITIGATION FUNDS ALREADY DEPOSITED WITH THE CITY. WHEREAS, on April 16, 1997, the Mayor and City Commission approved Resolution No. 97-22354, authorizing the Mayor and City Clerk to execute a Professional Services Agreement between the City of Miami Beach and Carr Smith Corradino, for the development of a Municipal Mobility Plan (MMP) for Miami Beach, in the amount of $150,000, funded by a Metropolitan Planning Organization (MPO) grant, and the Miami Beach Parking Enterprise Fund and Redevelopment Agency; and WHEREAS, on November 18, 1998, Resolution No. 98-22963 authorized a First Amendment to the Agreement, in the amount of $9,800, to compensate the consultant for the performance of additional services, above and beyond the contracted services, as requested by the City, and funded by the Professional Services Budget, Economic Development Division; and WHEREAS, on April 14, 1999, Resolution No. 99-23121 authorized a Second Amendment to the Agreement, in the amount of$62,OOO, for the development of an Implementation Plan for the MMP, funded by an MPO grant and the Parking Enterprise Fund; and WHEREAS, on November 22, 1999, Resolution No. 99-23318 authorized a Third Amendment, in the amount of $35,000, for the development of a Transportation Concurrency Management Area (TCMA) Study for the MMP, funded with Ocean Drive Traffic Mitigation funds; and WHEREAS, a Fourth Amendment is needed to provide consultant assistance to the City in coordinating two major roadway improvement projects on Collins Avenue/South Beach, with other roadway, bridge, or community enhancement projects in the area. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein approve and authorize the Mayor and City Clerk to execute the attached Fourth Amendment to a Professional Services Agreement (MMP) between the City and Carr Smith Corradino, dated April 16, 1997, in an amount not to exceed $20,000; said Amendment to provide consultant assistance to the City, as the liaison with the Florida Department of Transportation and Miami-Dade County, in coordinating two major roadway improvement projects on Collins Avenue/South Beach, with other roadway, bridge, or community enhancement projects also scheduled for construction within the general area; and further appropriating $20,000 for the purpose from concurrency mitigation funds already deposited with the City. NOW, THEREFORE, in consideration of mutual covenants and mutual promises hereafter exchanged and other good and valuable consideration, the receipt of which is hereby acknowledged, the City and Consultant agree as follows: 1. SECTION 2 of the Agreement, entitled "Scope of Work and Services Required," and Exhibit A thereto, are herein amended to incorporate the proposal attached to this Forth Amendment as Exhibit "A-3", to provide the following: a) Assist the City of Miami Beach with the coordination of the reconstruction of Collins Avenue, from Lincoln Road to 26th Street; and b) Assist the City with the coordination of the drainage/milling/repaving of Collins Avenue, from 5th Street to 15th Street; and c) Coordinate the above mentioned projects with other MMP-related projects planned for the same general area of the City, such as the Washington Avenue, Meridian Avenue and 23rd Street bridges, and Flamingo Park projects; and d) Serve as liaison between the City and the Florida Department of Transportation, as well as Miami-Dade County Public Works, regarding the project coordination efforts; and e) Services shall include recommendations and resolutions of the construction and schedule phasing, and active participation in meetings between FDOT, County, and interested parties in order to coordinate the projects effectively so as to minimize the disruption of traffic flow, and the inconvenience to the motoring public, residents, hotels, businesses, employees, and visitors. 2. SECTION 3.1 ofthe Agreement, entitled "Fixed Fee," is herein amended to read as follows: Consultant shall be compensated for the services performed herein on an hourly basis plus direct expenses for three individuals, and shall not exceed Twenty Thousand Dollars ($20,000), for providing the services as set forth in Exhibit "A-3," hereto. Invoices will be sent monthly with supporting documentation of hours and direct expenses. 3. SECTION 4.4 of the Agreement, entitled "Duration and Extent of Agreement," is herein amended to read as follows: The term of this Amended Agreement shall be for a period to begin with a "Notice to Proceed" and end after both Collins Avenue roadway projects are completed by FDOT and accepted by the City. 4. Except as modified herein, all other terms and conditions ofthe Agreement are hereby ratified and confirmed. ADMINISTRATION RECOMMENDATION Adopt the Resolution ANALYSIS The Florida Department of Transportation has programmed two major roadway improvement projects for AlA/Collins Avenue, as follows: The segment from Lincoln Road to 26th Street, scheduled for 2001; and the segment from 5th Street to 15th Street, in 2002. Faced with the challenge of coordinating these projects with the Washington Avenue, Meridian Avenue and 23rd Street bridge reconstruction projects, as well as the Flamingo Park General Obligation Bond, the Administration feels it prudent to engage a private consulting firm to assist the City with projects coordination and liaison with FDOT and Miami-Dade County Public Works. Due to the fact that the FDOT, County, and City G.O. Bond projects are components of the Municipal Mobility Plan (MMP) Project Bank and related capital improvement program, it is appropriate to amend the MMP Agreement to include this additional task, and utilize $20,000 from already collected traffic mitigation funds/South Beach TCMA. WI'D CI'1 5-10--00 AGENDA ITEM DATE nd Budget May 10,2000 Commission Memorandum 4th Amendment to CSC Agreement Page 2 The major roadway improvement projects to be coordinated by the consultant lie within the MMP- proposed South Beach Transportation Concurrency Management Area (SoBe TCMA), which has been approved at first reading by the City Commission on March 15, 2000. Therefore, it is appropriate to utilize traffic mitigation funds collected from development, redevelopment, and use intensification projects in South Beach for the purposes ofthis contract amendment. Over $300,000 in mitigation funds have already been deposited with the City in the South Beach TCMA revenue account number 158.8000.341226. The MMP Agreement History. The firm of Carr Smith Corradino has been under contract with the City to develop the Municipal Mobility Plan (MMP) and related projects since April 16, 1997, when the original Agreement was approved by Resolution No. 97-22354. The basic MMP and its Vision for Transportation were funded at $150,000 as follows: $78,500 by a Metropolitan Planning Organization (MPO) grant, $36,500 by the Parking Enterprise Fund, and $35,000 by the Miami Beach Redevelopment Agency. o On November 18, 1998, Resolution No. 98-22963 authorized a First Amendment to the contract, in the amount of $9,800, to compensate the consultant for additional professional services performed, above and beyond the scope of work of the original contract. The amendment was funded by the Professional Services Account ofthe Economic Development budget. o On April 14, 1999, Resolution No. 99-23121 authorized a Second Amendment to the contract, in the amount of $62,000, to develop an Implementation Plan/Program of Interrelated Projects for the MMP. The amendment was funded at $50,000 by an MPO grant, and at $12,000 by the Parking Enterprise Fund; and o On November 22, 1999, Resolution No. 99-23318 authorized a Third Amendment, in the amount of $35,000, covered the development of a Transportation Concurrency Management Area (TCMA) Study, as recommended by the MMP, and funded with traffic mitigation funds (Ocean Drive). o The proposed Fourth Amendment, in the amount of$20,000, would cover the coordination and liaison services previously explained. The amendment cost would be covered by traffic mitigation funds collected from development, redevelopment, and use intensification projects within the South Beach TCMA boundaries, $20,000 of which need to be appropriated.
