94-21148 RESO RESOLUTION NO. 94-21148 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING A SECOND EXTENSION OF THE AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND NATIONAL DATA AND COMMUNICATIONS, INC. (NATIONAL DATA), SO THAT SERVICE WILL NOT BE INTERRUPTED AND THE CITY MAY HAVE ADEQUATE TIME TO ISSUE A REQUEST FOR PROPOSAL; SAID EXTENSION COMMENCING ON MAY 1, 1994, AND ENDING ON AUGUST 30, 1994. WHEREAS, pursuant to Request for Proposal 106-85/90 for providing Voice and Data Telecommunications Services at the City of Miami Beach Convention Center, the Mayor and City Commission approved Resolution No. 86-18703, authorizing the Mayor and City Clerk to execute an Agreement between the City and the successful proposer, Future Telecommunications, Inc. (the Agreement); and WHEREAS, on July 13, 1988, the Mayor and City Commission approved Resolution No. 88-19294, approving the assignment of the aforestated Agreement from Future Telecommunications, Inc. to Miami Communications, Inc.; and WHEREAS, National Data and Communications, Inc. (National Data) is the successor in interest to Miami Communications, Inc.; and WHEREAS, Resolution No. 94-21029 extended the Agreement until April 30, 1994 so the Administration could negotiate for the acquisition of the subject voice and data telecommunications equipment (the Equipment), pursuant to the City I s option to purchase same under the Agreement; and WHEREAS, the Administration has decided not to pursue this option and will instead issue a new Request for Proposal for providing Voice and Data Telecommunications Services at the City of Miami Beach Convention Center; and WHEREAS, the Administration feels that a second extension for up to four (4) months is adequate time to issue this Request for Proposal, while at the same time not interrupting the service being provided. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein approve a Second Extension of the Agreement between the City of Miami Beach and National Data and Communications, Inc.j said extension commencing on May 1,1994, and ending on August 30, 1994. () I _ City Mana~ SUBJECT: SECOND EXTENSION OF AGREEMENT WITH NATIONAL DATA &: COMKUNICATIONS, INC., UNTIL AUGUST 30, 1994, TO GIVE THE CITY OF MIAMI BEACH THE TIME TO ISSUE A REQUEST FOR PROPOSALS POR PROVIDING VOICE AND DATA TELECOMKUNICATIONS SERVICES AT THE CITY OF MIAMI BEACH CONVENTION CENTER. ADMINISTRATION RECOMMENDATION: The City Administration recommends that the City Commission approve a second extension of four (4) months to the Agreement with National Data & Communications, until August 30, 1994, to provide uninterrupted communications services to the users of the Miami Beach Convention Center while the City issues a Request for Proposals. BACKGROUND: City Commission Resolution No. 88-19294 authorized the Mayor and the City Clerk to approve the assigi.1ment of the original Agreement with Future Telecommunications, Inc. to Miami Communications, Inc. (National Data & Communications, Inc.) in July 1988. The oLiginal Agreement commenced February 10, 1986 and ended February 9, 1991 for a five (5) year term. Resolution No. 89-19806. extended the original Agreement for two (2) additional years, until February 9, 1994. Resolution No. 94-21029 further extended the Agreement until April 30, 1994. ANALYSIS This second extension will grant the City adequate time to issue a Request for Proposals, since the City chose not to purchase the telecommunications equipment from National Data & Communications, Inc. CONCLUSION: Since the extension of the Agreement expires on April 30, 1994, this second extension of the Agreement until August 30, 1994 is needed in order to provide the City with adequate time to issue an R.F.P. without interrupting the services currently being provided by National Data & Communications.
