Comprehensive Plan Text Amendment - Hotels as Permitted Uses in RM-1 An Ordinance of the Mayor and City Commission of the City of Miami Beach, Florida, Amending Part II: Goals, Objectives and Policies of the City of Miami Beach Comprehensive Plan, by Modifying Policy 1.2 of Objective 1: Land Development Regulations of the Future Land Use Element by Adding Hotels to the List of Uses Which May Be Permitted in a Specified Area of the RM-1 Low Density Multi Family Residential Land Use Category; And, Directing Transmittals of this Ordinance and All Applicable Documents to Affected Agencies; Providing for Repealer, Severability, Inclusion in the Comprehensive Plan and an Effective Date. (File # 1442b) WHEREAS, the above amending ordinances to the City's Land Development Regulations and Comprehensive Plan were referred to the Miami Beach Planning Board by the City Commission, the Planning Board having considered the ordinances at its February 29,2000 meeting, and the City Commission having approved the ordinances on first reading on March 15,2000; and WHEREAS, pursuant to Section 118-164 of the Code of the City of Miami Beach, Florida, in cases in which the actual list of permitted, conditional or prohibited uses within a zoning category, or a change to the actual zoning map designation for a parcel or parcels ofland is proposed, the City Commission shall provide for public notice and hearings by holding two advertised public hearings on the proposed ordinance, at least one hearing held after 5:00 p.m. on a weekday; and WHEREAS, the Florida Department of Community Affairs (DCA) is currently completing its review of the above referenced Comprehensive Plan amendments and has indicated that their Objections, Recommendations and Comments Report will be mailed to the City on or about June 14,2000, and WHEREAS, in order to enable the City Commission to adopt the proposed amendments in a timely manner on second reading at its July 12,2000 meeting, the Administration is requesting that the public hearings be set at this time, in anticipation of the receipt of the DCA report; NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that public hearings to consider amendments to the City's Comprehensive Plan: 1) Transportation Concurrency Management Areas (TCMAs), 2) Environmental ProtectionlGreenways, 3) Hotels as Permitted Uses in RM-1; and to the Land Development Regulations of the City Code: 1) Hotels as Permitted Uses in RM-lICD-2, are hereby scheduled on Wednesday, July 12,2000 as follows: Environmental ProtectionlGreenways Comp Plan Amendment Transportation Concurrency Management Areas (TCMAs) Comp Plan Amendment Hotels as Permitted Uses in RM-1 and CD-1 L.D.R. WHEREAS, the Atlantic Greenway Corridor Initiative represents a major City wide objective to develop greenways, to acquire land for urban greenspace, to expand outdoor recreational opportunities, to protect natural areas, and to promote sustainable economic growth and thus should be included in the Comprehensive Plan. WHEREAS, inclusion in the Comprehensive Plan is also an eligibility requirement for certain funding and technical assistance opportunities from the State of Florida. WHEREAS, the Atlantic Greenway Corridor Initiative contains projects for which funding and technical assistance will be sought from State of Florida programs that require local government projects to be included in their Comprehensive Plan. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. The Commission hereby approves amendments to the Conservation/Coastal Zone Element of Part II: Goals, Objectives and Policies of the City of Miami Beach Comprehensive Plan, as amended, as follows: * * * Policy 2.2 All development activities that adversely affect habitat that may be critical to endangered, threatened, or rare species, or species of special concern, including native vegetative communities, shall be prohibited by the City through the development review process (Sections 17 and 18 of the Land Development Regulations). * * * Policy 2.23 The City shall continue the policy of ensuring the protection of natural areas and open space through public acqJ.lisition of land. Policy 5.2 To acquire and display inteI:Pretive signage throughout the City's greenways to provide historical. cultural and environmental information about the area to the general public. SECTION 3. REPEALER. That all Ordinances or parts of Ordinances in conflict herewith be and the same are hereby repealed. SECTION 4. SEVERABILITY. If any section, subsection, clause or provision of this Ordinance is held invalid, the remainder shall not be affected by such invalidity. SECTION 5. INCLUSION IN COMPREHENSIVE PLAN. It is the intention of the City Commission, and it is hereby ordained that Sections 1 and 2 are made part of the City of Miami Beach Comprehensive Plan, as amended; that the sections of this Ordinance may be renumbered or relettered to accomplish such intention; and that the word "ordinance" may be changed to "section" or other appropriate word. SECTION 6. EFFECTIVE DATE. This Ordinance shall take effect on the _ day of , 2000, however, the effective date of any plan amendment shall be in accordance with Section 163.3184, Florida Statutes. The boundaries of these TCMAs shall be as depicted on Map 6.1 and described in Appendix A of this element. Within these areas. increased mobility options will be pursued and redevelopment efforts will be focused. Policy 6.1 Within each Transportation Concurrency Manaoement Area, infill and redevelopment shall be encouraqed which is supportive of mobility alternatives includinq walkinq, bicyclino and use of transit. 3 Policy 6.2 Within the TCMAs, traffic calmina measures maximizina mobility and providina a safer, pedestrian friendly environment shall be explored throuQh the establishment of a preliminary traffic calminq process within the City. This process will evaluate traffic calmina measures prior to makina recommendations to the Miami-Dade Public Works Department (MDPWD). The process shall ensure: a. Evaluation of all requests received by the City; b. Full public involvement; c. Recommendations to MDPWD for further study; d. Promotion of livable and sustainable neiahborhoods. Policy 6.3 The City, in cooperation with the Miami Beach Transportation ManaQement Association (TMA). shall initiate an overall parkina manaQement study within the City's TCMAs. The process shall evaluate: a. Placement of future public and private parkina facilities related to the support of alternative modes of transportation; b. Reduction of on-site parkina requirements within the City's land development reaulations in order to encouraae multi-modal use; c. Commercial delivery issues includinq the provision of loadina zones within alleys to improve street flow and emeraency vehicle access. Policy 6.4 Impact fees within the City's TCMAs shall be evaluated to ensure support of multi- modal options. This process shall address: a. The construction of enhanced pedestrian amenities; b. Contribution towards the construction of peripheral parkina facilities to be served by transit; c. The construction of bicycle facilities. Policy 6.5 Within the City's TCMAs, a Traffic ManaQement Ordinance (TMO) shall be established. in cooperation with the Miami Beach TMA. The TMO shall require all new maior non- residential development to submit a Traffic Mitiaation Plan encouraainq the use of alternative modes of transportation to the automobile which addresses: 4 a. Provision of bicycle racks; b. Provision of parkina for carpools; c. Establishment of rideshare or carpool proarams: d. Alternative hours of trayel includino flexible work hours, staooered work shifts, compressed work weeks and telecommutina options: e. Subsidy of transit fares: f. Use of lona term parkina to be developed at City's entry points. Policy 6.6 The City will work to establish fundina mechanisms includinq the passaae of a aeneral obligation bond. the Metropolitan Plannina Oraanization (MPO) process. and creation of a concurrency mitiaation bank to support the proiects contained within the City's Municipal Mobilitv Plan which address mobility options for the City. Those projects located within the City's TCMA will receive fundina priority. Policy 6.7 The Citv will work to reduce conflicts amonq modes of transportation. This shall be done throuah: a. Establishment of enhanced intersections with more viable crosswalks and enhanced siqnage; b. The development of bike paths and lanes with ballards and raised islands to increase safety at intersections by preventing vehicles from enterina special lanes. Policy 6.8 The City shall continue to coordinate with the Miami-Dade Transit Authority (MOTA) to ensure that transit service within the South Beach. Middle Beach, North Beach TCMAs maximize mobility and reflect routes which serve to facilitate movement within the City. Policy 6.9 To improve citizen and visitor awareness of mobility options within the South Beach, Middle Beach and North Beach TCMAs, the Citv shall. in cooperation with the Miami Beach TMA. establish mechanisms to hiahliaht information reaardinq the availability of mobilitv options. Policy 6.10 Transportation concurrency within the South Beach. Middle Beach and North Beach TCMAs will be maintained and tracked by the Transportation and Concurrency Manaaement Section located within the Public Works Department. 5 Policy 6.11 The City shall seek expansion of Electrowave shuttle service within its TCMAs throuoh the identification of fundino mechanisms. Policy 6.12 The City shall establish a capital improvements prooram within each TCMA which identifies mobility improvements within each TCMA. Policy 6.13 The City shall coordinate with the Miami-Dade MPO to construct an intermodal transit facility within the South Beach TCMA to serve transportation uses which shall include Electrowave and Miami-Dade Transit Authority buses, automobiles, motorcycles, bicycles. taxicabs. water taxis and possible reqional rail service. ., OBJECTIVE 7: IMPROVING HURRICANE EVACUATION To improve hurricane evacuation within the City of Miami Beach. the City shall coordinate with responsible aoencies includino the Florida Department of Community Affairs. Miami-Dade Office of Emeroency Manaoement, South Florida Reoional Plannina Council and Miami-Dade Transit Authority. Policy 7.1 The City of Miami Beach will continue its efforts to establish shelters of last resort within the City to assist with hurricane evacuation throuoh coordination with Miami-Dade Office of Emeraency Manaoement. Policy 7.2 The City shall coordinate with the Miami-Dade Transit Authority to evaluate the need for establishment of increased evacuation pick up sites within the City. Policy 7.3 The City shall coordinate with the Miami-Dade Office of Emeroencv Manaoement to improve evacuation clearance times of 5th Street/Alton Road throuah a chanqe to the hurricane evacuation route zones to take advantaoe of available capacity on alternative evacuation routes. 6 Policy 7.4 The City shall evaluate enterino into an agreement with a private contractor to assist with evacuation includinQ durino hurricane events. * * * SECTION 2. (File #1442b) ADMINISTRA TION RECOMMENDATION The Administration recommends that the City Commission set the required second reading public hearings for a time certain on July 12, 2000 for these proposed separate amendments to the Comprehensive Plan and Land Development Regulations regarding: Comprehensive Plan: I) Transportation Concurrency Management Areas (TCMAs) 2) Environmental Protection/Greenways 3) Hotels as Permitted Uses in RM-I L.D.R. Ordinance: 4) Hotels as Permitted Uses in RM-l and CD-2 ANAL YSIS The City Commission approved these amendments on first reading on March 15, 2000. Subsequently the Comprehensive Plan amendments have been transmitted to the Florida Department of Community Affairs (DCA) which is undertaking its review of the proposed amendments. The City expects to receive the DCA Objections, Recommendations and Comments Report on or around June 14,2000, after which it may proceed to adopt the amendments. The subject amendments require a seven day advertised notice of public hearing. Therefore, to enable the City Commission to hear the proposed amendments in a timely manner on first reading at its July 12, 2000 meeting, the Administration is requesting that the public hearings be set at this time.
